    Watching this made me feel like a fabulous mom. My kids would never... ever... treat my house this way. It's really not that hard. Teach your kids to not treat your house like you live under a bridge.

      what way? some dirt transfer on poorly painted walls? paint spots on the floor? a baseboard strip that needs some windex? a lot of those things are easy fixes but when you RENT you're not allowed to go in & fix it in a way that actually fixes it. In many apts you can't just paint the walls, many don't allow it. Ti fix those paint spots are easy but not in a way that a renter could. That's an apt that hasn't been updated since around 1986, scuff marks and divots and dirt is a given. Let the owner go to Lowes with that 1700 and bring the place into the 21st century.

      @@Scion_of_light In order for a bldg to be protected & residents not allowed to alter it, the structure must be registered it's a long involved process, not just having "historic value". I owned a Victorian built in 1910, renovated it for 20 years, fixed it, drywalled, did the ceilings the baseboards the mouldings, etc. it really is as easy as I made it out to be.

    Her exact reasoning is why when one of my tenants puts in a notice to vacate I always attach their copy of the notice to a form that states what we look for and charge for upon moving out so there’s no party that acts dumb or lies

    With the plaintiff's attitude, you would have thought she had left the place immaculate, instead it had been severely damaged by her children, and the oven was a disgrace, even though she apparently had a cleaning lady. She's lucky she got anything back, because the repairs needed, due to her children, looked extensive...

      You r right about the plaintiff's attitude - and what was up with her filing in Connecticut? But I'm surprised JM didn't respond to the defendant's non response about the list of damages within 30 days - I thought usually the landlord is penalized if they don't send you a list of damages within 30 days.

      that place hasn't been updated since 1986, he should use that cash to bring it into the 21st century, and maybe he can learn how to properly paint the walls so that not everything transfers like it did in the photos. walls without primer will collect dirt for everything, you don't have to be a dirty person for that to happen. it's called a shitty paint job

    I understand that the plaintiff did damage to the residence and it was silly of her to think she would get all her money back, but the landlord should've done a walk through with her and sent her a list of damages. He did neither, then penalized her for water damage from bad pipes in the building, which is nuts. She had to take him to court just to get a fair assessment of damages to get some of her deposit back. Dude was trying to keep all her money.

      As far as the damage from the bad pipes, if a tenant does not make the landlord aware of an issue that is not their fault and just let's it go to just get worst then they are most certainly responsible.

    My wife and I are landlords. We own a few apartment complexes and a few houses.
    Most of our tenants have been great, but a few were horrible and destructive.
    For the filthy destructive tenants, I’d have to take to court and always won.
    Whenever there’s anything that goes wrong with our properties, I immediately call a plumber, electrician, etc to have it repaired.
    I had one tenant who rented an apartment from us for over 30 years. She was awesome. Her bathtub ran over one time. It flooded her apartment and the apartment below her. She had renter’s insurance and they repaired both appointments and put not only her but also the other tenants in a hotel until they were repaired

      Going through that now. My tenant trashed the place and left 90% of their thongs behind because they don’t care. Every single wall had holes. And some had BODY sized holes.

      @@mikaelawagenbach7075 If you get judgement against them in a court, then you can have their wages garnished until their debt is paid in full.
      I’ve had a couple of bad tenants who put me down as their last landlord.
      I’ll Always give the new perspective landlord my personal experience and the tenant.
      I won’t embellish, but I simply tell them the truth and tell them that I would Never Ever rent to them again.
      By law I cannot embellish, nor would I, because how do I know if it’s a perspective landlord or someone else who my crummy tenants put up to see what I would say.
      I can legally say something like, They were X months behind on rent and I had to go through the costly expense of evicting them, or they always paid their rent on time but they cost me X amount in damages.
      I’ve had previous landlords tell me about the person.
      I also do a background check and credit report on each of my tenants before I allow them to rent from me.
      When someone’s wages are garnished, employers HATE it as it costs the employer more money.
      Good Luck in getting your money back.

      Well, usually they do rough justice when the party claiming for damages is not able to produce evidence of the cost to repair, which was not made obvious in this case.

    Plaintiff did leave a mess but she is right when she said that the landlord has to send a list within a certain amount of time... usually 30 days... or return it. interesting that JM did not honor this.

    I was on the same page with JM on the verdict but the plaintiff is right. She didn't get a written reason as to why he was keeping her deposit for MONTHS. In fact, he was radio silent. He now forfeits any rights he may have had , does he not ??

      No. It has been explained in other cases the only time a plantiff gets it back, and doubled in some cases, is if the money was wrongfully withheld.

      The Judge did take it in consideration which is why he got half. $1700 for the cat damage deposit and then just a regular deposite.

    I think she dropped the ball. If the lease says he has to send a check or itemized deduction list then that should have been brought up. He sent no letter so she should have really got it all back.

    The tenant should’ve simply argued that she did not get a list of damages within two weeks, which was a requirement in her lease. She mentioned this after the case was decided, I don’t know why she didn’t bring it up as her one and only argument.

    The plaintiff is in a great big pile of denial- and her boyfriend appears to be embarrassed enough for the both of them.
    "A child learns what he lives". Obviously this mother missed that lesson, as the evidence clearly indicates a house torn asunder. 😏😬🙄

      the evidence shows an apt that hasn't been updated since 1985 & the landlord wants it immaculate. that's the real funny thing about this case. that and the shitty paint job on the walls where every single thing transfers making them appear dirty. I wish landlord would learn how to properly paint walls, they do this garbage so much it almost comes off like a scam to not return security.

    I’m watching from Australia. We do a walk through tenant and owner/ agent with a checklist and photos. Anything and everything is written down and photos. There can be no argument after that.

    The landlord is to blame she realized her son did some damages but he didn't get back to her SMH he knows he was supposed to send a letter or something and all she wanted back at the time was the pet deposit now it cost him 1700 instead of 1200

    In some apts, they do rush jobs when it comes to painting. They often will NOT prime the walls or throw just one coat of paint up, this can cause transfer of EVERYTHING from handprints to color transfer from clothing to you name it. I have this problem in my apt, every single thing transfers to the walls, we are not allowed to paint in here, walls are white, no one primed, any opportunist landlord will hold the deposit for this. As soon as I noticed this shit was happening my first thought was oh shit I'm not getting a security back. I owned a house for TWENTY YEARS I know what this is and how to fix it and how to not allow this to happen, but it's not from a tenant being dirty, it's called a shitty paint job. Today, they'll do ANYTHING to avoid returning a security deposit. Because of this shit paint job in my apt I don't foresee EVER getting a deposit back.

    Even though she did have some damages in the apartment if the landlord actually did not do a run through when she left to at least negotiate what will happen maybe this whole thing could have been avoided for apparently he didn't want to bother and then did his own way causing a lawsuit

    Do you guys in the US have house inspections during tenancy? Like in Australia the agent does inspections every 3 months so that any issues are resolved during the tenancy!

    Uh oh! LEGALLY, The plaintiff is entitled to ALL of her money back because a landlord has 30 days to give the tenant an itemized list of what and why they are keeping the deposit. If she were still a judge she would be sanctioned for that ruling. She also would not be allowed to talk to those in her courtroom the way she sometimes does however, I guess that is for tv. I think she is making a mockery of the justice system when she acts like this as well as allowing the law to be swept under the rug.

    i am a painter and landlords call me to paint walls and do touch up . i wish they paid anything close to what they claim it cost them to hire a painter to paint the walls . a two or three bedroom place can have all the walls painted for under 1 thousand dollars and many times the whole place just needs a touch up which is like 300 to 500 dollars , these landlords totally lie about the costs of painting and cleaning .

    When you have young children it's to be expected that a house will messy even dirty at times. When you have grown children it's not expected for them to destroy the house to any extent barring some sort accident. This is a disgrace.

    How does she EVER get the REAL FACTS down and REALLY understand peoples situations if she NEVER lets the people get a full explanation out? She constantly cuts them off in mid sentence talks over them and ASSUMES that she knows it all!!!! This judge is friggin ridiculous at times.....lol!!!!! Annoying AF!!!

    why is the question that Harvey asks all the time, is it the tenant or the landlord, no one seems to have pride in their homes whether rented or owned? I am shocked that such bad tenants actually have visitors to that place.... Where is their pride in their homes that they live in??? urg disgusting dirty place, clearly no one really cleans there

    I agree with the plaintiff. It should have been deemed that the landlord forfeited his right to withhold any money from the tenant bc he did not provide her with timely notice. She should appeal at her local court.

    I know the show aired for years with similar cases. And it had to be hard to come up with different questions. But, honest, 9 out of 10 times, when cases are about this that deal with tenants and landlords the question is along the lines of: "DO YOU THINK TENANTS DON´T CARE FOR THE PLACE THEY RENT?" or "DO LANDLORDS ARE ABUSIVE AND WANT TO KEEP THE SECURITY MONEY?".
    ...seems to me that, at a certain point, he just didn´t care and every time a case like this happen he´d, automatically, ask the same thing. Drives me nuts.

    This judge is all over the place.. she always says if the letter is not sent then the tenant will automatically get security deposit back and sometimes doubled. She always says her hands are tied but in this case she didn’t apply that. I swear she just rules based on how she’s feeling

    NY is double after 14 days and only one month security deposit max is allowed. The judge does not know the law, it is even in excess of $5000. Normal wear and tear is allowed.
