I really appreciate your efforts towards explaining the terms and options in this difficult time. I am also serving my 3 months notice period and it's a very difficult time for me as I need to join my new job as early as possible.
I was very depressed because of my current situation that my current employer is not relieving me even after offering a buyout option. I was misguided by my own manager that I need his permission for that and he won't approve it.
From your video, I understand that buyout is my right and I don't need his approval, I am feeling a bit relaxed now.
I want to thank you for sharing the information, thank you mam.

They said that come to office 90 days and complete 90 days notice period.. mother feed is important for next 2 months and baby already in underweight.. that's why I am planned to resign..how to go to office..for do work..why HR people not understanding this 😭

    • @Careervues
      @Careervues  2 года назад

      Hi there
As per labor law you cannot resign while being on any kind of leave.
You must finish your maternity leave, visit your office and submit your resignation in person.
Whatever notice is applicable as per your contract you may find ways to settle that with HR. If you don’t want to serve notice there should be a way, as you have already been away for long for your maternity leave.
Let me know if you have any concerns.

Hello Ma'am: Struggling to get the 90 day notice reduced. the clause mentioned is "terminable by either Party giving the other ninety (90) days’ notice. The company may, however, reduce this notice period at its discretion by accepting / paying basic salary in lieu thereof" - would it be possible to ask for buy-out with this? Thank you

      Hi
You can surely ask to buy back your notice as this clause is mentioned in the contract.
Make sure to send a written request and it should be settled on your basic salary upon approval of your line manager & HR.
Send a polite request and see if they agree.

    Honest question.
Why is it that notice periods in the West are 3 weeks while in India the companies FORCE the employees/slaves to work for 3 months after they put down the papers?
Seems like the management gets some sort of perverse joy in seeing their former employee suffer.

During the Probation Period, you or Company may, terminate the employment by providing 1 month’s prior notice ("Probation Notice Period”) without assigning any reason, whatsoever. Company reserves the right to make or recover an equivalent payment in lieu of the applicable Probation Notice Period, after the same was conveyed in writing by either Party.
this is there in my appointment letter.
i asked my hr for buy out my notice period. he said no and you have to serve 30 days notice. what shall I do madam?

@Sudhir it’s not true that only employers can decide about the buy out. There is no law like this. You are in your early career don’t be concerned about such Management. If you have a job and leave the company by going on an emergency leave.
Ask new HR what documents they need from your training. If there is nothing crucial plan to leave, the employer can’t do much to stop you.

Hello Ma'am.Currently I m working in Here Technologies. But I got an offer letter on 24th May from Capegemini on which joining date was 23rd June.So I had to resign in current company asap in order to serve my notice period of 30 days before joining date of 23rd June.During HR interview of Capegemini I had clearly mentioned about my 30 days notice period. But after resignation, she is asking me to negotiate on my notice period with my current manager as they want me to join on earlier than the mentioned date on offer letter. She also threatened me that she would offer this opportunity to someone else if I am not available on the earlier date as mentioned by her.I also asked about buying out of my notice period with my current manager and HR.They are also not ready to compensate my paid leaves with notice period. As I have already resigned,it can't be reverted. So it seems that finally I am going to lose both the job. Please Ma'am guide me on what I should do??

Subsequently they changed it as compensation in lieu of shorter notice at management discretion in HR policy. I asked to shorten my notice period from 90 days to 60 days to which my manager did not agree even if I was ready pay compensation. Is this legal. They are not the same. Waiver of notice can be done by employer without any payment.
During buy out employee pays to buy the days he/ she is unable to serve notice.
Second answer depends on the company culture and your relationship with your boss. Good bosses support employees growth but bad ones need to handled with some manipulation.

Talk to your boss to support you for an early exit, ask him how you can help the department for an early release. Maybe your supervisor can talk to HR for you. After all the decisions are all inter connected between departments HR & finance.

Hi, I have a query on termination of employment. If my contract stated: After completion of your probation period, either you or ABC Ltd may terminate this agreement at any time by giving 3 months' prior written notice to the other party. ABC Ltd may provide you with a payment in lieu of all or part of the applicable notice period.
Does it means as an employee, I have the option to skip the notice period by paying 3 months of my salary to the employer in order for them to release me without serving my 3 months notice? This is because they only stated ''ABC Ltd may provide you with a payment in lieu .....'' and it doesn't mention ''either party''.

      Hi there,
Firstly- Your company has clearly mentioned in your appointment letter about buy back option Incase you are not able to serve the complete 3 months notice period which is good.
Second- To buy back notice generally per day salary is given by the employee in lieu of working days remaining for the notice period (excluding the weekends and public holidays).
Third- Make sure to adjust any of your pending leaves to reduce the notice if possible.
Lastly, you can request your company/ HR for a buy back calculation from their side through an email. Based on which you can settle the early release from notice period.
Let me know if you have any questions.

Buy out is calculated on the gross per day salary ( not on the basic) To start the process, the employee needs to find out the amount paid to the current company for relieving form the accounts or the human resource department based on the company’s policies. So it’s crucial that HR communicates everything in written.

try one more time to assist in whatever way you can in order to get an early release.
If it doesn’t work you have to leave without EOS benefits.
Ask future HR what are the documents required from their side, gather the documentation and leave.
Company might declare you absconding be prepared for the sake of new job.
Ask a lawyer for advice, see if you can go legal in your situation & take a call.

      Hi Sonali,
If you have worked with the organization for more than 6 months I recommend you get an experience certificate. If it’s been less than 6 months you can resign and request an early release from notice. This video might help: ruclips.net/video/XUzpimVwzos/видео.html

I am really humble and glad after seeing your Notice Period Negotiations & Buy Out Options video, which I found very informative.
I am now serving a notice time with my present employer, and they have asked me to serve a 90-day notice period, which I am not willing to do, and instead of 90 days, I am willing to serve a 30-45-day notice period. I received a fresh offer that they want me to accept as soon as feasible. I requested my current company for a BuyOut Option, but they said the business would suffer if we gave you one, and they threatened me with legal action if I did.
My present company has ceased paying me for the last two months, and when I inquired, they stated. "If someone resigns, the corporation keeps the standard 60-day pay for all employees."
Can I join a new employer in this situation without serving a notice period or receiving a releasing letter?
Any advice from you, Ma'am, would be greatly appreciated.

@@Careervues Yes, my employment contract includes a buyout option. Please see the clause below.
      8. TERMINATION OF YOUR EMPLOYMENT
8.1 Termination on notice by you
You may terminate this agreement at any time by providing advance notice of 90 days.
The Company may at its discretion pay you in lieu of all or part of the notice of termination
period to which you are entitled, calculated based on your gross salary. If you leave without
providing notice, you must remit 3 months' gross salary to the company. You undertake not
to dispute the amount and shall pay the amount before requesting for a formal relieving letter
from the organization & at the same time organization has full right to initiate appropriate
legal proceedings against the Employee in case of breach of this employment agreement.

You have an entitlement but upon company’s discretion. They way to sort this is - give them exact dates for not serving notice period and tell them you need to go on an emergency treatment after that.
You are ready to pay the amount of time in lieu.
Unfortunately relieving letter will be processed after the last working day as per notice ( if everything gets approved) which you may need for the new job.
If you have an offer request for the joining documents list from future HR and check how to proceed forward.
Let me know if you have further questions.

As per labor law, a permanent employee has to serve the notice as per company policy.

      Hi Naveen,
They are playing games. 10 days is nothing much for your employer to agree.
Ask them for a settlement through accrued leaves ( it’s legal to do so, if you have pending leaves) or check your contract about resigning & buyback notice and approach them in accordance.

      Hi Surajanshu
Check your contract about probation, if you have completed the probation period you will be considered a permanent employee even without notification. Based on your duration in the company your notice period is decided.

      Hi Surajanshu,
It might change as maximum probation is 9 months for some specific cases ( generally it’s 3-6 months)
Notice period after resignation as a confirmed employee varies from 2-3 months. Hopefully it remains 1 month only bit if the company is making all permanent employees serve 2 months as standard then it would be 2 months for you as well.
