  • In the disciplinary trial against the prosecutor who helped falsely charge protesters as gang members, two victims testified about the personal toll the case took on them. All the criminal charges that were brought by April Sponsel against Ryder Collins and Amy Kaper were eventually dismissed after an ABC15 investigation exposed that the case was based on dubious claims and made-up evidence.

It does not absolve a lawyer of her ethical obligations that a superior (lawyer or non-lawyer) approves of ethical misconduct, or even orders her to commit the misconduct. It could be a factor in punishment, but is irrelevant to whether the ethical rules were breached because those obligations fall upon each individual lawyer and cannot be avoided by pointing the finger at someone else.

So, what will happen is Sponsel will be punished in some way, but keep her law license. The County Attorney, Allister Adell is deceased. The other supervising attorneys have resigned. Sponsel has been fired. The charges have been dropped against the defendants, and to my knowledge, no one in the various police departments have been disciplined, punished, retrained, etc. There's no recourse for the state bar against any federal agency, and this is all that will happen. The best that can be hoped for is that a class action lawsuit of some kind will be brought against Sponsel, the other supervising attorneys, and the police departments and that their immunity will be revoked for what they did if a judge finds that what they did was so egregious that they should lose immunity.
