This is why the justice system is a mess. The court needs to penalize the builders. She should be compensated for all this nonsense. Screw the developers. Due your due diligence.
She must win because this case sets precedence for land owners vs. builders getting away with usurping land for profit.

How do you accidently build a house somewhere?
because they did not have a survey done per the local Hawaii news... depended on the locations of the existing telephone poles in the area.

Somebody has not done a title search at all, or done it improperly. There's a lawyer's office, or the development company, that did not do due diligence. "She" has to resolve it? No way, they are trying to get her to think that so she won't sue and report the real culprits.
So I guess she can start charging a land lease

Rent out the house to pay the increased taxes until it is resolved although I don't see what can be resolved except the builder sucks up his mistake or the land owner sues the builder. The builder suing the land owner doesn't seem like it will succeed.

Wait how can the builder charge the land owner where house was mistakenly built or perhaps they meant the builder is charging the land owner who was having the house built 🤷🏻 weird to say the least. Something is fishy here for sure 👍
Go to the blueprints. If the developer planned the house on her property, it is the developer who should be sued. If the Builder built on the wrong land not provided in the blueprints, then they should be 100% liable. The own has no part of the dispute between the developer and the builder. She should immediately put up a fence around her property with a no trespassing sign.
The AG should charge the builder with grand larceny in the 1st degee and threaten him with a 30 year prison sentence unless he 'resolves it." He owes her at least 5 million dollars. And removing the house entirely and restoring all the vegitation. Or he can do 30 years in prison, liquidate his company and pay her everything from the liquidation.

Legally they can not make her pay. She can sue them for not using a surveyor. sue for trespassing etc emotional damages.

I'm betting the court is going to force her to switch plots with the developers as they're side-by-side & they're not going to let her walk away from this with a free 1/2 mil home. Not fair, but I bet the court does that & that's why the developer is suing her for their mistake.
Interesting take. I think the court will make the developers tear down the house and return infant, native vegetation so it can grow back. I think the judge will say it’s their responsibility to clean up their own mistakes and that that’s the cost of being in business.

If this is allowed to stand then contractors will just start building houses wherever they feel like. They will just start stealing peoples land!!
Counter-sue for the cost of demolition. The case will settle quickly.

The reporter asked the land owner what is wrong with a free house on her property. The builder and developers are not offering her the house for free. Even in a fantasy world where she was offered a free house, she didn't ask for the house, and it's not in line with her intentions for her property. The reporter made the property owner sound ungrateful and crazy.

The "Squatters" are probably victims too. Swapping lands with some compensation or for a better land would be an fair option, if this was an honest mistake. But if she want's the land back, then the investor has to tear it down.
Hard to tear it down if she builds a fence around it and puts up a no trespassing sign.
