      You might accidentally deliver a load of mulch or even build a section of fence, but building an entire house is not an accident. Either gross error or intentional skullduggery on the part of the builder.

      Also it's not so awful if you get the house for free which this 100% should be happening. Once this is all resolved she can either keep it or sell it for max profit.

      her getting the house for free is better than the developer removing it and restoring the land, including trees, at their own expense. Which is what should and probably is the baseline. Developer should be happy if she just keeps the house since they save money

      It happens all the time, the last fence we constructed for a builder was 14 inches in the other property, and I told them many times to hire surveyors, but guess what? They were too cheap to do it , and now we have to move almost entire fence to the right property line. More money hahahahahah!

    That´s a huge and unforgivable mistake made by the building company. The owner should be let to choose between keeping the building for herself WITH NO FEES ON THE PLOT OWNER or the house being dismanteled/ demolished and the lot being returned to its former status WITH NO FEES ON THE PLOT OWNER

      Finally someone with common sense. Exactly what should happen. She should also be recompensed for any money she's spent trying to resolve this, including the extra property taxes that she had nothing to do with raising, but still is on the hook for.

      @@Jedi007c6 America land of the fee, not just Hawaii it's down to something called the 'America Rule' that requires each party of a lawsuit to pay their own legal costs regardless of the final result. Since such costs are not included in any final settlement it allows the rich to file frivolous lawsuits & bankrupt the poor by dragging them through the courts to either coerce a settlement or force them to sell anyway to cover the fee's. You don't find this in other Western countries there the loser has to pay the winners legal fee's.

      I'm surprised she's not countersuing for the property taxes AND to make them restore the land to how it was before. Unjust enrcichment? Fine. If it was me, a demolition crew would tear the house down before trial, where I'd present the plaintiffs with the bill.

    I’m going to assume the lawsuit is worthless. They built something on someone else’s property. How hard can it be for a judge to understand that. You don’t have permission to build on my property. And now you’re trespassing.

    These developers, Keaau Development, didn't realize they had built on the wrong lot? They are either stupid to the lowest degree, or they did it intentionally for financial gain (maybe hoping that the lot owner wouldn't notice until after the house was sold and they had their money). Whichever the case, you wouldn't want to buy a house built by these people. The short-cuts and construction defects are likely spread throughout every house they build. And now they're suing the legal property owner? Wow.

      Notice a trend? Most of the European settlements that are notable today are in areas the Natives considered to be bad areas. They only developed into decent places to live because of the infrastructure and technology the Europeans brought with them.

    they were required to conduct an evironmental impact statement for the native species on the land. So if they were so reckless to do this, they probably have destroyed a lot of native habitat on other sites.

      It was built one lot over from where it was supposed to be built. I have purchased property all over the country and I usually go out at identify the 4 corners of my property using a variety of methods. Some areas are easier than others. Sometimes I get GPS coordinates of the property corners or boundaries and other times I don't. The purpose of building inspectors is to ensure the home is being built to the building code of the municipality.

      @@ChrisHarding-lk3jjusing a method that isn’t 100% still makes you liable for using the privately owned property (which includes land) of others so it’s of little to no consequence wether you’re too lazy to hire a professional surveyor to do the job right if you can’t do it with certainty you aren’t violating others rights. However the inspector part of your comment is 100% correct

      Inspectors are responsible for the actual building, not property lines. That falls to surveyors, which the construction company opted not to use.

      It’s not an inspectors job to ensure what is being built can be built there. Only that it complies with building codes. They don’t survey, not their responsibility.

    It’s insane that the developer is suing her; and now, she’s countersuing which maybe she might not have done if they hadn’t sued her first. And they totally deserve if she wins for the cost of protecting the property, increase of taxes on it, plus the loss of foliage. The developer is implying she’s lying about her new age-like reasons for not wanting to switch lots. It doesn’t matter. It’s her land! She can want to keep it for specific new age location reasons … or just because there’s a free house on it because of someone else’s mistake. She doesn’t have to be altruistic to a development company. If I were in her place, I’d do the same thing and I wouldn’t have new age reasons. (Btw, I hope her lawyer also puts defamation for calling her a liar in that countersuit. Seriously, they DESERVE any grounds they can think of for suing her in the first place!) I hope she wins that countersuit, can then sell the land and house; and is able to buy an even better plot of land OF HER SPECIFIC CHOICE for her retreat somewhere else.

      have you looked at local reale estate costs across the USA? 500k for a 1 acre single story home is pretty average. The days of 200k and 300k homes is LONG gone. It's what happens when investment firms buy up 85% of homes in the united states and then don't sell them.
      Remember: you'll own nothing and be happy.

    Sounds like the the builder, developer, and real estate agent CONSPIRED TO COMMIT FRAUD.
    Why aren't charges filed? Too many donations to local politicians, maybe?
    This woman should immediately file a counter-suit for all the damages her property incurred because the constructing of that house means the land cannot be returned to its natural state.

    I live here on big island.
    I know this neighborhood.
    That house costs 80-100 thousand to build.
    Not 500.
    That is a crime infested area...in the prospective flow from the volcanoe if it erupts.
    Thats why the land is so cheap and impossible to get home insurance.

    Yokel laws! When you bulldoze and build a house, nothing is “accidental’ about it. The mistake was the building company’s - not the land owner's or the county's. The land was not surveyed nor verified by the county or the landowner - that is the construction company’s responsibility, not the landowner’s. The land owner can counter sue - for a whole range of restitution and compensation. The construction company is also guilty of trespass.

    they didnt build a whole house accidentaly... they shuould leave that house and keys to her now. they tried to steal her land and even have guts to send her to court? for what? that she didnt allow them to build in her land? and how did they get all the papers to allow them to build in that property, that means they have even corrupted someone on the way...or did they make mistake too ? if the judge does not rule in her favor he shouldn't be a judge anymore. they trasspess, they build illegaly, they even didnt have a build premit for that house or if they had how did they get it without her consent, and than send the case to court? on what bases? they even damaged her site without any consent...

    They would be leveling that house and replanting every blade of grass and wild flower that got destroyed. As well as a monthly fee for not being able to use my property and storage of their materials, including back pay from the first day they had any material dropped off on my property.

    Seems obvious, if the home was built on 'her property', it is now inclusive of her property, and demolition would be TRESSPASSING. See your state codes for NO TRESPASSING SIGNS and put them everywhere!!

    I know a lot of people are like - how could this happen?
    But this is more than a mistake - this is the second one of these kinds of things I've heard in the past few months.

    I am not sure why she has to pay extra property taxes when the county gave them the permit, and it is their responsibility to assure that the permit they are giving is legal. And, giving someone a permit to build a structure on land that is not theirs is, well, not legal. The county should not be unjustly enriched because of their mistake.

    They suppose to do a land search too. My husband does real estate and all kinda craziness people do. Land search first to check the right owner then you get a land surveyor.

    if it had been built with out permits the city would have it bulldozed, building should be completely removed and then land restored to its original condition as best as possible, that means bringing back in native trees and plants, and reimbursing her for all legal fees IMO

      A small, local builder made this mistake. They wouldn't have a million dollars to pay in a settlement. They'd just declare bankruptcy and start up another company under a relative's name. That's the Hawaiian way.

    Tell them "I want the house bulldozed."
    Watch their jaws drop. It's illegally placed on her land and they can be required by the court to remove it, AND return the land to its original state (implying, they'd have to reseed all the plants too).
    They'll turn that dinky home into a gorgeous studio like she wanted at an even lesser cost for her, to avoid the deconstruction costs. She's got em by the balls.

    That is another universal law they should have. A survey of the land each time a house is sold, instruct the owner's of the property lines and also any renters. It would save many people having fights and going to court. Give them photos of their property lines. I have had residents take out the survey rods and place them inward of our property, taking away from our property. This is against the law and there is a state statute against it.

    Not lawyer, not legal advice.
    That being said.
    To sue for damages you need two things.
    1. Liability
    2. Damages
    Owner is not liable.
    Owner incurred no damages to the builder.
    They messed up. they need to own it.
    If anything, the builders are in fact 1. liable. 2. have incurred damages to the land owner by a. modifying the attributes of the property that was important value to her purchasing it, b. caused her to pay more tax, c. likely has to end up paying more to get her project built because she needs to undo the work these builders did.
    She can sue the builders.

    The land owner should be offered money to take the house. The house might not be to her liking or might be in the wrong area of the land. It would cost her thousands to have the house removed.

    This suit is one of the dumbest actions they could possibly have taken. If you have a fully grown tree on your property and someone cuts it down against your will can easily be hundreds of thousands of dollars in reparations. Cutting down all the vegetation on your property, possibly doing irreparable damage to the nature on and around it, will be more money than you could possibly understand. This will be one of the easiest counter suits ever, and now with the court of public opinion on her side.
