  • I live in one of the only developments I have EVER seen that does NOT have an HOA. The developer never set one up, the community was developed in three phases over the span of about 15 years, and somehow it made it through to the end without ever getting an HOA. That makes it one of the most desirable neighborhoods in my city to live in if you want city amenities (well/sewer/garbage/debris pickup).

      The people who have the abilities to effectively run organizations like HOAs are rarely the same people who have the time and interest to run them. Ergo, the organizations are often somewhat poorly run by people with nothing better to do.

They SHOULD be trying to get contractors to build amenities in the neighborhood and seeing if they can get people to help with yardwork. But the people who wind up there have 0 clue how to do that, and start doing the only thing they know.

      @@brandonaitken1180 Many times, things get worse over time. A new regime comes in with "New ideas". I wouldn't trust a good situation to always be that way and conversely, a bad situation turning good.

    I have told this many times. I had an HOA advise me that they had voted my property into their HOA and that I had 30 days to come into compliance. I sent a response that I was not part of their HOA. 30 days later I started receiving violation notices in my mailbox. I sent a cease and desist letter. A month later, I received a notice of intent to seize my property if I was not in compliance in 10 days. Two weeks later I received notice of a scheduled hearing. At the courthouse, the attorney for the HOA recognized me and asked if I represented the homeowner, and I told him that I was the homeowner. I told him that I was not part of the HOA and they had been advised of that in writing several times. In court, the HOA president told how I had ignored all notices and refused to pay fines. When it was my turn, I asked her how long the property had been a part of the HOA, she gave the date they had voted my property in. I asked her if she had membership documents signed by me. She said "No, you refused so we voted you in" The judge, and their attorney both said HUH ? ? ? I then asked her about putting violation notices in my mailbox and she said that was the only way since I refused to install a notice box at my garage door. I asked her if she realized that putting main in a US mailbox was a federal crime. She said "not in a HOA" I saw their attorney shake his head. The judge asked her how she thought that the HOA could vote someone in without their consent, she said the annexed the property according to their by-laws. I asked the judge for a judgment as a matter of law, and consideration of my counter-claim. The judge said "granted to both, state your counter-claim" I outlined my compensatory damages, and then asked for putative damages in the amount of $5000 per violation notice, and an additional $10,000 for the frivolous case. The judge granted $350,000 in putative damages, and just over $50,000 in actual damages for time, and earnings lost responding and researching their claims. HOA woman said that the HOA could not pay the judgement. I told the judge that I would accept the vacant 20 Acres of association property adjoining my property with the release of HOA claims. The HOA voted the next week to release the property and remove Caren (Yes her name is Caren) as HOA president. I found out that she wanted my property as access to the additional acres the HOA had purchased to build additional homes to sell. Subsequently, the members of the HOA voted to dissolve the HOA as without the additional anticipated acreage income, they could not continue to fulfill the HOA obligations. The entire neighborhood (save a few) is much happier with the HOA gone.

      That is an amazing story. HOA's are a disgrace to homeowners. I have not heard ANY good things come from the people I know that live in an HOA.

      But they are wanting to start one that is the perfect time to make sure to limit their power by setting limitations to their power so the only thing they can do it upkeep communal areas and any private road they might be on. Keep the Karen's locked down so they won't have any power other than doing EXACTLY what the by-laws state.

      @@jordanstclaire many states, disclosure of the house being part of an HOA is required by law.
      In many more states, it's not.
      I hear all the time about people buying into an HOA and not knowing it's part of an HOA until they've already paid for the house and moved in. At that point it's too late.
      I've even heard some people not realize they were in an HOA until after multiple fines or liens against their house. I even remember one news story where they didn't know until after their house was foreclosed upon by the HOA for unpaid fines which they were not sending to the homeowner.

      Guess it depends on who runs the HOA. Ours has a voting system that we vote on rules and who is the president, vice president and treasury secretary.
      The one in my neighborhood is pretty relaxed and we pool money together for things like security cameras, a front gate , yard maintenance and every 5 years or so we get the streets repaved.
      If you feel like yours is being too strict I'd suggest speaking to other neighbors and seeing if yall can vote on some rule changes or maybe relaxing some of them to fit your needs.
      Worst case you can lobby to have your president impeached or vote someone else in and usurp control.

      ​@KrolKaz I lived in one where the first three rules were, 1, You are elected for 2 years and can not run again for 6 years. 2, Any rules you make can be canceled by the next person. 3, If no one is elected, there is no governing board. After the first 4 years, we went self governing.

    I just purchased my first home recently and I’m so glad there’s no HOA. After renting in a HOA neighborhood for several years, the freedom to do whatever I want with my house and land is incredibly freeing. I’m thinking about staining my bricks navy blue, which would be UNTHINKABLE in my previous neighborhood. The cows out back are a plus. I love cows.

      I chose a color halfway between blue and purple for my front door and shutters. It matches the violets and hyacinths in my yard. The siding is gray. I love it and there is no way an HOA would approve. I had a basic deck built in the back to replace the crumbling concrete patio-one neighbor objected because there are no fancy railings or built in seats. Too bad. I had a party with a dozen guests when it was built and none of them complained.

      HOAs are voluntary. You choose to buy in one of those communities. Many single family home communities with associations maintain the parks or pools in the communities. For condos and townhomes they are very necessary. They carry insurance on the exterior of the buildings, maintain the amenities, parking lots, and roof of the buildings. If there wasn’t an HOA, then all of the homeowners of these units would have to pay out-of-pocket for building repair. That would be extremely expensive.

    my parents built our house, and actually was asked (along with others in the neighborhood) if we wanted a HOA, and we said NO, and that's probably the best decision they ever made

    My parents HOA for a while tried to fine them for having the wrong color recycling can. They got it from the city it was just a new color they were rolling out to new homeowners. It was a very slightly darker green. People who run those things have no lives

    I think every HOA should have a sundown clause - that they are only allowed to operate for a 5 or maybe 10 year term, and that the members must vote it back in (including redoing the paperwork necessary). Any builder hoa, that term kicks immediately after the last house is built. No more permanent deed restriction hoa.
    Something else would have to be worked out for multi family housing.

      @@zaxmaxlax you are absolutely correct. HOAs were and still are designed to segregate. It was and still is to some degree a money maker. Although, I do think thats changing. Larger cities, within core areas have some of the fastest growing home prices and less HOAs. And arguably alot more diverse than the often outer-city limits neighbourhoods. The further out of a major city you go, the less and less racially diverse it gets, generally.

    In some cities it's hard to find subdivisions without an HOA, and those that don't have one are sometimes not very nice places to live. 🤷‍♀️

    A wealthy friend had their house painted, and the HOA sent them a letter saying it wasn't an approved color & they'd have to repaint. She asked for the list of approved colors. The HOA said there isn't a list, you just have to show your color to a member of the board and get it approved before you paint, and you didn't, so you'll have to start over. One tiny problem with that plan ... that rule was in direct violation of state law. She told them to pound sand. They said they'd sue. She told them "Do you have any idea who you're messing with? I have lawyers on retainer in four states. Go ahead!" They sued her, and they got eaten alive in court.

      @@endure_3048 it's discrimination if people are treated differently based on race, gender, religion, etc. This was more of a power play - people who sucked up to board members as befitting their most exalted position as kings among men would get any damn color they wanted approved (as long as it was beige), and people who wouldn't suck up to them wouldn't get their colors approved just out of catshit petty abuse of power.

    I bought a house in an HOA and got the HOA dissolved. Apparently a lot of people weren't happy about the HOA but just chose to do nothing. It took a while to be able to bring it up for a vote but eventually we did and the majority of people no longer wanted to live under the tyranny of a bored housewife who was way too involved in other people's lives. If you live in an HOA neighborhood, talk to your neighbors and test the waters. See how they feel about it. If you have enough angry neighbors tired of living in an HOA, you can bring the dissolution to a vote in a meeting. There will be some people that won't be happy about the dissolution but, oh well.

      Fair warning, this will likely not work if the developer holds majority power (by holding a majority of the lots in the subdivision but doesn't build on them.)

    When I bought my first house last year with my wife we didn't know how bad HOAs could be. Thankfully we just happened to get a house in a neighborhood without one and I'm forever grateful!

    My parents back in 2014 got into a really nice house. The neighborhood only has a playground and a bit of landscaping. $50 monthly in 2014 which was already pretty high. Fast foward to 2024 and the HOA fee have more than doubled with very small neighborhood improvement.

      Got fined once for having the bins on the side of the house. I called and said the bins where there when I came to look at the house before signing. Why would I assume they don't belong there? Was told they have a new president that is now enforcing the rules. Again, how was I (a renter) suppose to know this, and all my neighbors have bins on the side. Long story short, I still got fined $45 and I left three months after that. @#$% HOA!

    Amen. I only lived with an HOA once. They tried to tow my car until I jumped in and barely pulled away in time. Among other harassments. The tow driver laughed at me and said "darn it!" Never HOA again!!

      Our HOA is actually really good and full of nice people. Just basic rules to keep yards looking nice. Neighbors with bad property also effect your property value. Nothing crazy strict. We can do pretty much any modification or use our property however we want. Just keep it looking decent.

      Wait until you choose the color they say is allowed... then the LRV is too high and you have to repaint the house, throw a lawsuit get that money back, and then again have to have your house repainted back to the color they "allowed", them throw a temper tantrum you take them to court again, and also they lose again. Because IT WAS ON THEIR LIST OF COLORS ALLOWED. Plus the human eye can't tell the difference between a tiny bit of a LRV to the next, they were trying to make a point and lost. But if you have certain shrubbery that the LRV damages I can see why. This house had none that would be hurt by it.

      I have a couple of entrances that I keep up and the developer turned them over to HOAs after he was done. Needless to say, a couple of the neighbors let me know very quickly that if they would have known that the neighborhood was going to be turned over to an HOA they would have never stepped foot in the neighborhood. So basically they got stuck after they bought the house.

      One of my exes parents live in an HOA and they’ve got grandkids. Thought hey let’s put a play ground set in the backyard. HOA had to pick it out because they are only allowed certain colors. The same HOA also kept sending them fines and letters for months because there was a cargo van that would always park next to their house with a license plate. It was owned by someone like four houses down from them. You would think that the license plate would’ve been run to see who it belong to right but no. Just start fining them because it’s closest to their house.

      I've seen HOAs that were run by normal, sane, working adults in their 30s, and it was fine. They had set it up so basically they could stop anyone from being an absolute tool. They didn't have a whole bunch of meetings, no restrictions on what to display, etc.
      I think the largest problem with HOAs is that it ends up being Karens who don't have to work and have an overabundance of bitterness who end up running them

    My neighborhood is one of the few without an HOA in my area. I used to wish we had one bc some neighbors didn't mow their grass, things like that. Now I've come to realize how lucky I am.

      There was one I seen where HOA tried forcing a elderly man that was a veteran to take down his American flag. His house wasn't even HOA property. The HOA even attempted to take his flag. They got mad when he made what they were doing public by going to the local news which caused other news channels including nationwide one to find out and report on it.

    I had a catastrophic medical event that put me in the ICU for six weeks with a single digit % chance to survive. My husband was deployed and under a communication blackout due to an incident and didn't know. I was kept in a coma the majority of the time. The HOA handed me a bill and fine for my unkept yard that was over $3k. No excuses or explanations justified me not having the grass mown. When my husband got home, he took the HOA to court. I don't know what happened as i was seriously out of it for months. I will never live with a HOA again.

      HOAs are evil. God forbid you have a medical emergency like you had where you need to focus on recovery, but if you're associated with an HOA, you also have to be concerned with "is your lawn mowed".

      You would think that someone would have figured out something was wrong and tried to contact you. We've cut grass for neighbors who were in the hospital before. It's what neighbors are supposed to do.

      What a great idea. You could make a serious movie on a small budget since we don't need CGI or anything fancy, just a good story. Maybe have the HOA board consist of criminals and use it show some of the worst HOA behaviors. Then have statements at the beginning and at the end of the film claiming this is a work of fiction based on true stories and it does represent the reality of HOAs in the US and demand that they be severly regulated or banned.

    Visited family in Rochester, they don’t have an HOA and everything looked so unique and each house was so comfy looking. Came back to arizona and got to see all 5 kinds of houses all over again!

It's always the moronic unlikely extreme scenario that you have to revert to, to justify an HOA. The data are quite clear, any surplus amount you might sell your home for in an HOA, which is often negligible if any, often doesn't even cover the amount you spent on HOA fees over the years. It's always special ed kind of math touted by the HOA jock sniffers. That would be you

      @@AMD1 condo boards are pretty much just HOA's under another name. Condo's are a little different because they are collective physical structures, but free standing homes; all you should have to do is pay a portion of upkeep for common spaces like community green spaces, pools, etc. If they don't have those things, then HOA's need to piss off.

      @morgan1027 yes actually I have owned two and currently own a 3500 sq ft home in a NON hoa area (of course) and my value on property has only ever gone up over the 25 years I've owned homes. My first home was even in a less desirable neighborhood and it steadily rose still. You don't need an HOA measuring your grass with a ruler to maintain home values.
      Also the types of neighborhoods which have the kinds of people who cinderblock vehicles would never be in HOA areas lol.

      @morgan1027 they maintain property value in some instances, especially in cases where the general group of people can be a nuisance, like when someone wants to leave their project car in the driveway for 5 years while they accumulate parts to fix it. In other instances, they write passive aggressive letters to me that my nieces and nephews can’t have a tent pitched behind my cabin on the lake (which is entirely out of sight of the road). Nothing like spending my money to have others think they should be able to control the ability for kids to have fun 🥰

    I went to a community with a HOA to deliver some appliances some weeks ago, it was the most boring looking place I've seen, all houses the same, painted the same, no decorations except for some wreaths or simple lights. There's more life in a hospital morgue than in a HOA run community.

    If you buy a house that does not have an hoa and someone starts one conact an attorney if you can and never sign any paperwork they give you to become part of the hoa if you dont sign they cant make you join the hoa

    HOA's can be hell. I was in one and cut my grass. They must have come around with a ruler or something and measured my grass. The next day I got a letter saying that I did not cut it low enough. So, I had to lower my mower to the lowest setting and cut it again. If I received another letter I would have to pay a fine. After that, then it was lawyers fees. Never no more will I buy in an HOA. NEVER, never, never!

    My family was hassled by the hoa, my dad ran and won for president. I ran for treasurer, my sister for secretary. The first vote after we were sworn in was to abolish the hoa. We won 4-1 to abolish it.

      There is a HOA somewhere nearby (not mine) who has 9 seats, but company held 5 of those seats, and the other 4 were for the actual people. If a vote ever came up to abolish the HOA, of course they would vote No every time and win the majority vote.

    Ugh. I remember going to my grandpa’s place after he passed to help clear his place. Come to find, the HOA had left notices about some weeds. They probably didn’t know, but it was still frustrating. The weeds were few and mostly hidden to the public eye, and not really our priority at the time. Miss you, grandpa

      honestly not really, a lot of municipalities outsource services to the hoa like trash collection, sewer/water, and even things like setting traffic violation fines in the neighborhood completely legally. not to mention, some of the bigger hoas have management companies that do their back end, not the residents.
