X3, whilst only being 'decent', 'okay', has at least something to offer beyond action. The scene involving Jean's death for instance is fairly emotionally involving. Stan Lee admitted in an interview that he wanted humanity to see prejudice from a different point of view. Its easy to hate someone based on their skin color, but what about when someone does things that are considered to be impossible?

The problem I have with Magneto on the list period is that he has become more anti-hero than villain in current comics; granted, his legacy is as a villain, but considering how he's changed over the years, I would've dropped him lower on the list because of this change. It's like ranking Venom as Spider Man's greatest villains, except you can be specfic onto which Venom it was, which is of course Eddie Brock.
I've always loved Magneto, he's not entirely evil but I always felt like he could be a sociopath to a certain extent, he doesn't give a rat's ass about human lives at all the vast majority of the time, and is even willing to let fellow mutants die should it further his goal of mutant superiority over humankind. Across most depictions of him he's also a bit of an unfealing beast driven by wrath and vengeance, unless you're someone he cares about specifically, usually only being mutants, or being a member of his Brotherhood of Mutants. I guess he wants to be a hero sometimes, but he's definitely not an angel.

The Movies did The Juggernaut NO JUSTICE. To me X-men 3 doesn't exist. They outta re-do another x-men with the juggernaut and the primary villain. The X-men cartoon here are 30 years old and I know animation has come a long way, but I almost feel that older style was more comic book like and played way better than later renditions IMO

Interesting enough, Juggernaut, Magneto and other villains joined X-Men on some occasions, and not to defeat a greater foe, but for other motives (Juggy and Charles forgiving each other, Magneto joining the most recent formation of the X-Men since there is only around 200 mutants on the world). That is why I find the X-Men rogue list so interesting...
