jose santiago this type of scenario could go down multiple ways. Both condo owners should file a claim and the association probably should to. The likely outcome is that their policy covers their damage and your policy covers yours. The reason is that you likely didn’t do anything to be liable for. A pipe broke. You didn’t do anything. Please help me if possible. Imagine I have business liability Insurance and there is a robbery and the thieves escape. If someone on the street tries to catch them and gets injured, is that person medical bills covered by my business liability? Thank you in advance
Interesting! If anyone were to sue you in association with these injuries liability coverage would certainly apply. As for Med Pay, it’s a very accessible coverage so it likely would apply. Definitely a conversation with the insurance adjuster.
I got a quick question: my washing machine broke and it started leaking I'm in a condo. Am I liable for the damages unit below? full disclosure my bylaws says if there was no negligence then each home owner should file a claim? I am in Canada British Columbia. Could other units go after me? lawsuit?
a XDC, I would certainly file the claim and let the insurance companies figure it out. You’re right, the center of the issue will be whether there was negligence. It could be very hard to know though. Why did you washer overflow? If it was blocked by a dog toy that could be negligence. If it was a manufacturer defect, maybe not your fault. In the end, it’s not worth worrying about. Just submit the claim and let them work it out. That’s why you pay for insurance.
