  • Squatters by definition is and unlawful act. Squatters rights were written in the 1800’s and not intended to deal with residential maintained residences.
    These laws are out of whack.

      Seriously? ZERO RIGHTS period? What about a squatter's right to life, liberty, and the pursuit of happiness? Should a Squatter not have the right to a speedy trial by an impartial jury of their peers?
      What if you were to be wrongfully accused of being a squatter? Are you now guilty until proven innocent with ZERO RIGHTS period? Should you have to represent yourself in court against a trained prosecutor because you have no right to a lawyer? What if you're not only wrongfully accused of being a squatter, but you're then wrongfully convicted of being a squatter; should you not have the right to be protected from cruel and unusual punishment?
      To be fair, I'm sure this isn't exactly what you meant by your comment, but to be fair this is exactly what your comment means. So just be careful what you wish for, lest your wish become true.

      @@insidetheunicorn There should be no right to squat on property with a known owner and paid taxes. ? And maybe the burden of proof of a lease should be shifted to the occupant rather than the owner. It is much easier to prove something exists than to prove it doesn't. Perhaps we should require leases to be notarized and filed with the local government to be valid.

    I love this! Let me share some more information you as the owner of the home can call any wrecking truck company and say i have an abandoned car on my property they will come pick up car and not charge you anything because they now have a car. Which the squarrter have to prove thats thier car, and pay for it being towed and daily charges for as long as car is there. God bless you

    My daughter rented a basement room to a woman claiming to be homeless. She is on SSI. Now, after 4 yrs, the woman quit paying rent, goes upstairs to do her wash, helps herself to the refrig without paying a dime. My daughter had a Social worker come to help the woman, but the woman refused to move. The woman has grown children that dont want her. Shes been asked to leave, but refuses. She drove the car through the garage door & totaled my daighters car. This is crazy, because the police say they cant remove her. The court wants lots of money for eviction and could be a year.
    Please advise.

      Does your daughter know a bunch of tough dudes who don't ask questions? Give one of them a lease on the room and let them move out the squatter's crap. Call a tow truck company and tell them there's an abandoned car on your property. That takes care of the squatter's car.

      No good deed goes unpunished with the new tenant protection laws. We really need to change the laws so that an owner can cancel the tenancy with the same notice the tenant can. The laws have become so one-sided that many property rights have been transferred from the owner to the occupant. In some ways all the deed buys you now is a property tax bill and potential liability.

    i appreciate the work you do. you neglected to mention that the law that needs to change is not the property rights issue of 1800s , but the tenant claim, that squatters use to hold owners hostage. the rights if tenants are that they have to be notified of eviction and that taking several months to do that is the issue. being vigilant about the initial intrusion is crucial. get them out before theyve attained tenancy .

      You are absolutely right. Much of what we are seeing today is based on the just-cause or good-cause eviction laws.

    the level of anger i feel about this nonsense is beyond words. this is the kind of stuff that gets people hurt bad or killed because of the undue stress thats put on the property owner... my daughter was in this situation with crack dealing squatters, who thrashed her property for 6 months before she could finally get them out.... i would have done something i would have regretted had i found out sooner.... this law makes ZERO SENSE!

    1:32 There is a distinction between "against the law" and "not under the law". In the first case, there is a law that prohibits some action. In the second case, there is no law that prohibits some action. The former is the most common use of "unlawful" today, but in the past, maybe because there didn't used to be laws about Every. Single. Little. Thing., "unlawful" could also have the latter meaning. Back in the day, squatting referred to taking possession of a property that appeared to be unclaimed or abandoned, without necessarily registering that possession right away with the regional authorities. In that sense it was "unlawful" as in you don't have a legal deed (yet), but not necessarily "against the law".
    Edit: The way to fix these laws for today's world is to spell out more explicitly what kinds of properties are/n't eligible for squatting. How long can a property be unoccupied, before a squatter can claim possession? What if the utilities are still on? All sorts of prerequisites could be imposed.

    I squat by myself hidden in trees in a very small tent on pubic property. I don't bother anyone. I don't do drugs, steal or litter. I don't cost taxpayers money.I know I'm illegal, but i can't afford rent, and I'm just trying to do the best I can.
