  • After eight weeks of arguments and testimony, jurors have reached a verdict in the $220 million case against Johns Hopkins All Children’s Hospital that was the premise of the Netflix documentary ‘Take Care of Maya.’
    In 2016, at just 10 years old, Maya Kowalski was admitted to Johns Hopkins All Children's Hospital for severe pain and was removed from the custody of her parents after staff accused them of "medical abuse." Her mother, Beata Kowalski, hung herself in her garage on Jan. 7, 2016, after going months without seeing her due to the medical abuse allegations, according to the family's attorney, Greg Anderson.

      Also, because of a precedent being set, it will be much more difficult for the state to overstep and destroy another family. The mother has saved other families with her sacrifice, by shining a light so bright on this miscarriage of power, that hopefully, it won’t ever happen again. ❤️❤️❤️💔💔💔

    I’m curious as to why I haven’t heard about any criminal charges in this case. Someone needs to be held accountable. Not just financially but in a criminal court.

      They released criminal charges after the civil trial finally ended a couple weeks ago. The judge lowered the award amount by 47.5 million but stopped the hospitals attorneys from being able to appeal.

      One of the problems is also they the lady (Sally Smith) had a 10-15 minute interview with the dad before taking away custody because they said the mom had whatever gypsy roses mom had. Without any evidence. Just word. There was even evidence that she didn’t have it!

      She sobbed more when the verdict for question 34 was read. It directly says they are responsible for her death. I hope that that was a release of the pent of guilt... She doesn't deserve to think that's her fault... 😢

    That is what 7 years of trauma looks like. This isn’t about the money it’s so much deeper. My daughter suffered a rare autoimmune disorder that only 5000 kids in the US have, this could have been us. Today is a good day for justice.

    I’m not usually a big proponent of these massive dollar amount lawsuits because I know the public winds up paying in the long run in higher costs, but if there was ever a family that deserved to win and win big it is this one. How do you ever give that girl her mother back? And the judge that denied the mother a hug in the court room should be disbarred and sued along with this corrupt hospital.

      Plus with CRPS she’ll likely have more medical bills in the future, as well as therapy appointments for her mental health after all she’s been through, all that is expensive. (Not to mention the hospital charged for their treatments of CRPS even while saying she didn’t have it)

    No amount of money will ever bring back their mom and dads wife but, I’m very happy they won. Maya seems so relieved every time a verdict is read in their favor. I’m very proud of this family for NOT letting this go.

      The hospital did not off her mother. She did it herself. She’s weak minded and selfish. That should not have been taken into account in the lawsuit. Anyone weak enough to actually “finish the job” would have done it eventually anyway for whatever reason they dream up in their inbred head. Maya should be way more pissed at her own mother than anyone else. How selfish do you have to be to do such a thing!?? And I’m saying this as a person who has had very deep feelings like that… but I would never do it for a few simple reasons.

I'm speaking for all of my fellow Canadians as I send you so much love, prayers, and strength to endure the hardship and heartache of losing your mom. She must be so proud OF YOU AND YOUR FAMILY for being so strong to endure such a long and horribly difficult journey to hold Johns Hopkins All Children's Hospital accountable for their incompetence and malpractice.
    Justice and punishment are served. You've not just won justice for your family. You've also provided hope and a voice for hundreds of other families across America who have been abused and experienced so much tragedy by incompetent healthcare personnel. She was kept away from her parents, kept in the hospital against her wishes, and during everything, her mother ended up committing suicide from the trauma of everything. It should never have happened.

    Most families don’t have the strength to go through a lawsuit like this. The hundreds of lawyers for John’s Hopkins made their life a living hell from 2016 until this verdict. Thank

      I'm sure everyone following this case is. Nothing replaces our Momma but they willing never have any financial needs again.
      There was medical issues with me when I was born. My mother took me home against medical advice back in 1965. If they would have stopped her she would have turned into Mother Bear. Times have changed.
      I'm so glad this Father had the strength to fight!. Child protective services have so much to learn about the long term effects of rare deases like Lupus, Lyme, and definitely this one, Chronic Pain Syndrome. They effect the nerves and central nervous system in unpredictable ways. They are hard to diagnose and have different symptoms and mimic other diseases. Alot of us are treated like hypochondriacs. And in the meantime, something serious is wreaking havoc in our bodies left untreated.

    I'm a nurse. It's really sad how the health care system works. Money can't buy the life of her mother. That is why every time I take care my patients I consider them as my family. The damage they've done.. I couldn't fathom the pain, scars, trauma, and hurt they experienced. Maya, your family is strong. I support you all. I am amazed of this family's strength to stand up and speak their voices

      @@TzokoliTthere’s nothing, not even validation, that can bring her mother back. That can make her whole again, that can take away the trauma she went through. Yes it helps in a way to finally be vindicated and have them say this was absolutely wrong but after that moment is over. You will still be without your mom. You will still be sick and struggling with whatever put you in the hospital in the first place and you will still have all the trauma they caused instead of properly caring for you and instead tearing apart your entire world at ten years old. This is great to a point but she will still need so much support and I truly hope this family continues to be supported and can begin to heal the best they can.

    As an RN from being a Paramedic, to Trauma certification TNCC, and ER nurse, what this hospital did was reprehensible. I raged for this family. Unfortunately several bad employees made a statement for JHACH. Several bad employees destroyed the reputation of this hospital.
    NO MSW should put a child on her lap, kiss her, and say she'd like to be their 'mommy'. That is not comfort. That is a PREDATOR and yes I'm not afraid to say that. Sue me assholes!

      I agree 100%! I was an EMT prior to becoming a CCRN credentialed critical care RN and psych nurse. The trauma this hospital and MSW caused to Maya (and her family) is beyond devastating. These kids will never completely heal and Maya's need for ongoing treatment most likely will be needed for the remainder of her life. My daughter is special needs and lost her daddy as a ten year old, so I know just how much losing a parent at that age affects them. The fact that this hospital and employees/associates caused her mother to take such drastic actions so Maya could return to her family instead of become a ward of the state is deplorable. I cried with them watching the verdict when it was read. I hope it doesn't take years for them to actually receive this money.

    As an expat and a mother, I feel so sorry for Maya’s mother. She was severely misunderstood by a prejudiced bunch of nonsensical people and hence she lost her child. She saved her by sacrificing her own life. Mother to mother, I can understand why she did it, nonetheless, it was a total loss, this shouldn’t have happened in the first place. May rest in peace.

    Let's not forget it is because of Beatas determination and refusal to sign the liability form that they were able to sue. All of those families that felt forced to sign it to get their kids back are also celebrating with them as they were also wronged by this hospital and by Sally Smith. Beatas intelligence, due diligence, bravery, and love for her children made this all happen. RIP Beata she would be so happy and proud and congrats Kowalski family ❤🎉 hopefully now you guys can begin the journey of healing. ✨️

    I can't even fathom having to take my life to bring my child home. This is the most selfless thing. All Maya wanted was to be heard and believed. To get her Mother's name cleared. I cried through most of it, but when Kyle started sobbing I lost it. That poor family. I hope they can at least take a deep breath now.

    As a nurse myself I get treated poorly by doctors/nurses for my kiddos. They delayed treatment for my daughter for a year and made me feel like a nutcase. I advocated for my daughter and she was rushed into surgery for adenoid and tonsil removal for the most severe sleep apnea. I will never forgive them and their elitist behaviors. RIP Beata. Way to go Maya

      My son almost died at 17 with appendicitis. He suffered for a week until we took him to another ER. The attending physician bypassed all the bs and took him right to surgery while everyone else stood there with their mouths open. We’d never met a more caring medical professional in our lives nor have experienced such care since.

      As someone who has been dealing with chronic tonsil infections for two years, sometimes becoming severe, I appreciate you fighting for your child. People often do not realize the effect that a seemingly "minor" medical issue can have on your life. The thing is it affects you 24/7, and unless you've experienced or witnessed something like it you will never know what it is really like. I'm glad for your daughter and hope that she is doing better.

    Justice did prevail for Maya and her family. This judgment was well long overdue. Watching the documentary on Netflix gave me the insight of this case and the “Hell” this family endured. So happy they got justice and Beata is watching over her family. 🙏😔

      @@lisasallery7860 She had an unusual illness that the hospital couldnt understand , so they immediately came to the conclusion the Mother must be causing the illness in a sort of munchausen by proxy way,, the family did pay for her to be examined by another Doctor who found a diagnosis and when the Daughter was away she got better , but they couldnt afford the treatment to continue ,, eventually the hospital and all the people in the system got an order which meant the Daughter was taken off the Mother , in their eyes it was to stop the mother harming the Daughter , but they had a diagnosis that was ignored by the hospital, the Mother then committed suicide from being blamed and having her Daughter taken away,, this was years ago , it has taken that long for this family to get to court to prove the Mother was not harming her Daughter and that the hospital was wrong to take the Daughter away , which caused the suicide.
      Apparently this hospital has done it other times as well when the child presents illnesses they cant explain.

      @@lisasallery7860 The government and medical staff accused the parents, mostly Beata, Maya's mom, of child abuse, which led to the state taking custody of Maya, and at the end of one hearing, disallowing Maya to hug her mother, whom Maya hadn't been able to see, prior to Maya and Beata being separated again. The lack of that hug is what the father believes led his wife to commit suicide. It's in the Netflix documentary, Take Care of Maya.

In another video the arrogance and contempt and plain inhumanity openly displayed by the doctors warrants that there medical licences be revoked and some should certainly have a prison sentence.       The Kowalskis did not need to pay up front for their legal team. They took this case because they knew it would be a huge pay out. They would not have taken the case otherwise. That being said, the family and their attorneys deserve every penny.

      Many attorneys work on contingency (meaning they are only paid if they win). They WILL take your case for free. The problem is you have to have a very strong case for lawyers to invest years of his time to your case. They will also usually be working towards a quick settlement with the hospital. Very understandably, the lawyers don’t want to work the many years it takes for the trial and the appeals while not being paid a dime and with the risk they will never be paid.

      They opened the door for the other families. And Mr Anderson paid out of his own pocket for the experts he brought in except for Dr Cochoran, who did it for free. They have opened the door for a class action lawsuit so other families can get justice. My respect to Mr Anderson for sticking this out for five years, and Mr Whitney. I have a feeling they will have their services needed for a lot of people now.

    I watched this documentary tonight and have been sobbing all night. Maya no doubt went through the most horrendous experience but I can't stop thinking about her poor brother as well that experienced his home life falling apart then being there when his mom was found. Him yelling "mommy!" on that 911 call just broke me. I am so glad they received the justice they all deserved.

    This case broke my heart, because none of it had to happen. What these John's Hopkins employees did to Maya and her family was HORRIBLE. They literally took the law into their own hands, based on nothing but the warped opinions of a couple nobodies. They deprived the child of her family and deprived her family of their precious daughter. The poor mother, so riddled with emotional anguish and pain, ended her own life because of Dr. Sally Smith and Kathy Beedy. I hope they live the most miserable lives and relive the hell they inflicted on the Kowalski family. I lost my husband, and my children lost their father, to the same cause of death as Beata died of. Over 20 years later, the pain and damage his death left upon us is still raw. I have never recovered from it, and the hardest thing has been to live on without my soul mate. So, I especially empathize with the pain they have suffered. To Maya and her dad and brother, this won't bring back what you lost.....nothing ever could. But I hope they feel a sense of victory in Beata's memory that they WON the battle and her passing was not in vain. Prayers for this family to heal and move forward in life as Beata would have wanted them to. She asked Jack to please take care of Maya, and he did exactly that. God Bless this family as they can finally begin the next chapter of life.

    I watched caring for Maya today on Netflix in the UK and I cried throughout the whole documentary. The systematic injustice Maya and her family went through that led to her mother’s death was unbelievable brutal. I have heard a lot as a psychotherapist but I totally went to piece over this family’s pain and helplessness. The tragic loss that would’ve been avoided if those so called specialists really cared, instead they were so consumed with power and being right at all cost. What was so sad was that even when they were proven wrong, there was no admission of wrongdoing or apology just a long trail of devastation and suffering, families destroyed by a system that was supposed to protect their children. It was so cruel and heartbreaking. I pray Maya, her brother Kyle and their father Jack will finally find some peace in their hearts after the long process it took for them to seek justice. May Beata’s soul rest in peace ❤️🙏

      You're rigjht, but what's happening in the UK is far far worse - preventing parents from taking their terminally sick children for promising experimental treatment outside the UK, AND now they even put gag orders on such parents to prevent them talking to media or anyone else about the situation. Even the 16 year old girl who made it plain... put it in writing...before she went unconscious that if she were to become unconscious she would want her parents to try every possible means including experimental treatment, to heal her. The UK judges gagged the parents and pulled the plug on her. Not even to save cost for NHS because the parents had raised the money to take her to Canada. Then the laws against praying around abortion centres and trying to prosecute a person who was praying silently for praying... y'all are living under a growing dictatorship/control state and don't quite realize it yet...
      At least the Johns Hopkins situation is restricted to that hospital. In the UK, extreme forms of this sort of behaviour are now standard practice, legalised and enforced by the judiciary.

      ​@@arizonalady7569 Not for minors, as Maya was a minor she couldn't consent to leave AMA because she was deemed ineligible for consent. A parent/guardian would have to consent for her to leave AMA which Beata and Jack were immediately disqualified for after a child abuse investigation opened up. So the only person who would have consented to allow her to leave AMA was the social worker in charge of her case who molested Maya while having custody of her so unlikely she would let her victim walk out of the hospital when she had unfettered access where she was.
      This situation made it impossible for Maya to escape or do anything to defend herself against the actual abuse at the hospital even though she repeatedly asked to go home and see her parents.

    I am so glad the Kowalski's won their case, I cried watching the verdictts read out watching Maya, Jack & Kyle. The doctors involved blamed the Kowalski's for accepting prior treatment by a Chronic Pain Specialist they didn't agree with, everyone involved at the hospital didn't believe Maya had CRPS told her she was making it up & separated her from her family. They put the entire family through extreme duress. I'm so glad the jury came back with their verdicts for the Kowalski's. They validated their experiences & acknowledged their pain & suffering, well done jury. This was powerful.

    I am glad she got the financial help she deserves. She suffered horribly. Thank you to the jury for realizing that this child was tortured mentally and physically during this time. This should serve as a warning to other hospitals to protect children from this stuff. Hope they are absorbing this...and make some changes...

      @@Shellshellzee Her family began bringing her in to the doctors/hospitals after she started having random pain, her legs began functioning less, and her energy was depleting. She was normally very bubbly and energetic so this was concerning to the family. During the visits the doctors/hospital eventually made assumptions that Beata(Maya's mother) was intentionally making her sick. This caused a chain reaction of events that essentially put this family through hell. "The hospital was found liable on multiple counts of abuse, including false imprisonment, battery and intentionally inflicting emotional distress on both Maya and her mother." They took Maya away from the family, abused her, and caused emotional distress on her mother to the point of suicide. The family was going to win every case they had from the start. Investigations showed clear mistreatment on the side of Dept. of Children and John Hopkins All Children's Hospital. I'm glad the family is being financially compensated, but nothing can ever piece their family back together. Luckily this is one of the times court systems acted properly in favor of those who were wronged.

      ​@@ShellshellzeeMaya suffered from an extremely rare condition and had received Ketamine treatments for it in the past both in Mexico, and in the US. She got extremely ill, and was taken to Johns Hopkins for treatment. A doctor there accused Maya's mother of faking the illness (saying the mother was intentionally making Maya sick in a bid for attention and sympathy). The doc falsely reported abuse to CPS after the family wanted to bring Maya home from JH. The hospital and CPS imprisoned Maya against her will AND her parents' will for OVER THREE MONTHS. Beata took her own life because that's the only way the hospital and CPS would release Maya.

    I have been an RN for 30 years, 10 as a travel RN all over the country. I did ONE 13 week assignment in the state of Florida. I saw the Baker Act used as a weapon against patients half a dozen times. I confronted these doctors and admins to their face and refused to participate. I did what I could to fight for the rights of "patients"a.k.a. Sovereign human beings. I will NEVER , EVER work in FLA again. I am glad this young girl/woman receive what justice could be done. May God heal her and her family. May there be reforrn in the State of Florida and the U.S. May patients in Florida and all over the country know their human rights and be empowered by this court acknowledging the evil abuse of power of the United States Medical Industrial Complex.

      When our kids were young, we had the old school doctors...old males that, bc I was a woman, I didn't know what i was talking about. They had no idea....I'm a sec. Mathematics teacher, that knows how to do her research, based on what my kids' symptoms were. And, I had a baby sister that died back in the early 70's bc the doctors didn't listen to my mom when she took my 5 month old sister in, telling them something is wrong. Not long after, she went to Heaven and they found she had a hole in her heart that could not be repaired. So when I went in, I had my research done for our first, his coloring wasn't right, Dr said it was fine, so I went to the competition of our healthcare dr. They found a hole in his heart. Thankfully, it was on the opposite. Side my sister's was on, but we would monitor it and by 1 he it had closed on its own. Now he is talking to colleges about playing golf for them as he goes to school to become a math teacher. They said the skin that was where we were seeing the discoloration must have been very thin at the time. Anyway, I went back in to our family. Dr again bc we identified he had reflux. This time our family Dr didn't question my concerns, but rather "well what would like us to do." Hahaha, from then on we had a great relationship! He realized I wasn't going away until he listened and I am one to do my research before we come in. We found those wedges did not raise our son at the correct angle to stop the reflux, even with medicine.... However his carseat did! So he slept in what I could find that he would be upright, but strapped in. He was sleeping thru the night at 10 weeks and by 1 he was in his bed! Interestingly, he has not had 1 problem with step or his ears...our daughter who we went thru the same things with had torticollis that we identified early. And again, our doctor was wonderful...we identified it with her, and my ob. Stated he believed she was injured at birth. She was an emergency C-section and I almost didn't make it. He injured her neck, but in talking withy ob, that Dr was already leaving his practice. She was gonna be ok, so we left it be. Lol, my his and asked, when our family dr announced his retirement, "you had him trained, what are ya gonna do now?" Start all over!! But our next family. Dr. Was a woman my age...we were on the same page from day 1! Moms and Dads, don't rely on your dr to diagnose. If something isn't right with your child, look for symptoms and do your research. They may make an educated guess, with all do respect, you are with your child and know them better than anyone. Our daughter could've ended up with one side of her face noticeably higher than the other...it needs to be corrected by age 1. The sooner you seei t and act, the better off they'll be! Sorry this was so long! ;)

      It's a serious flaw in a our system (and people's perceptions) that "medical safety" is believed to justifiably override all personal rights and legal procedures. A person can effectively be incarcerated purely on hearsay and a doctor's opinion. And families can be ripped apart based on the word of a social worker. This arrangement does do some good, but it has also obviously caused much harm. Yet no one seems keen on changing or even looking at the problem.

    She lost her MOTHER! What a horrific situation. As someone else said, no amount of money will replace this loss but it may make the people who should have been caring for Maya to sit up and decide to never do anything related ever again. Those people created the circumstances that made Beata Kowalski take her own life. It is indeed very difficult to not understand a suicide as your own fault even though it is not.

      Anything past $5 to $10 million is really just an attempt to go past the insurance coverage and actually affect the responsible parties... It doesn't really affect the life of the person given the money.
      Unless a person goes to prison for the kidnapping, there's no real justice.

    My friends grandchildren were taken away from their daughter because SOMEONE called CPS in Louisiana and accused her of doing drugs. CPS came and took the children away IMMEDIATELY but NEVER EVER drug tested her til 8 months later and passed a hair follicle test. She still hasn't got her children back! My friend tried to get custody of her grandchildren but they denied her as well! They have an Attorney now fighting to win them back. The CRAZY thing is this...the 3 families they placed the children in were alcoholics, mentally abusive and cruel to the children AND they spilt them up as well! It's very obvious that the children were ALWAYS happier and healthier mentally with their Mother!

    Personally this trial and Maya 's story has helped me see as a Healthcare worker, that it is imperative to be better to my patients. In respect of Beata, I feel completely compelled to give ALL patients more...more grace and compassion when my job seems mundane and unnoticed. I can ALWAYS improve and have seen terrible treatment of patients. I will encourage others to do better with kindness and honest direction...with this family on my heart. It's not about winning, it's about learning from this tragedy.

    This case is horrific. And all this girl wants is her family to heal. Notice how she cries hardest when the verdicts of “yes” are read. She barely bats an eye when this juror is reading the large sums of money. Maya only cares about the justice, and clearing her family’s name.

    There is no doubt that their mom was looking down and smiling. She would be so so so so proud of her kids.
