- York Twp, Ohio -- A deputy with the Medina County Sheriff's Office noticed a vehicle traveling without its headlights on. The vehicle was pulled over and while speaking to the driver, he flashed an EPA badge to the deputy. The deputy noted that he was sweating. The deputy kept talking to the man and noted the man was also slurring some of his words as well as bloodshot eyes.
He was asked to perform the alphabet and another in vehicle test and failed both. The man was given several other tests where he had a hard time completing.
The man, later identified as Brad Ostendorf, was charged with the following:
- Breath more than .17%
- OVI first offense
- Headlights
- Using weapons while intoxicated
You can't make this stuff up, while under limited driving privileges' awaiting his trial, Mr. Ostendorf was arrested again for OVI by another agency, we are working to get that video.
Eventually he ended up pleading guilty on both cases. His sentence is the following:
- $1500 in fines
- 12 points
- License suspended for 2 years
- 180 days jail, 170 suspended, 3 days mandatory
- Probation for 1 year

Attempting to establish something in common with an officer is one of them. Just like how people build relationships with people who have similar interests. I don't know that you call that an abuse of power. I've watched videos of people get out of speeding tickets because they were funny and made an officer laugh. You might need to call that an abuse of comedic power as well.

In Australia we’re guilty until proven innocent.
No one passes these. The test is just a pretense to gather more evidence against someone. Just like the dogs that always alert on every car because the handler cue’s them or it just wants the toy/treat and positive response from the handler.
Same in UK. Here the police can eve stop cars for random breath tests especially around Christmas time ..its a breathalyser and thats it. You pass or fail ...no nonsense..
In Canada you have to submit a breath sample to the machine at roadside stop, no cause required, and you can be stopped for any reason. Refusing to is the same as being convicted of DUI, you lose your license immediately.
In the US courts, the standards for proof are very high and we have some intense defense attorneys that make a massive amount of money defending these cases, so they have motivation to be really great lawyers and they get a lot of people off. It’s not a waste of time, it is called “gathering evidence” for the case.
