  • York Twp, Ohio -- A deputy with the Medina County Sheriff's Office noticed a vehicle traveling without its headlights on. The vehicle was pulled over and while speaking to the driver, he flashed an EPA badge to the deputy. The deputy noted that he was sweating. The deputy kept talking to the man and noted the man was also slurring some of his words as well as bloodshot eyes.
He was asked to perform the alphabet and another in vehicle test and failed both. The man was given several other tests where he had a hard time completing.
The man, later identified as Brad Ostendorf, was charged with the following:
    - Breath more than .17%
    - OVI first offense
    - Headlights
    - Using weapons while intoxicated
You can't make this stuff up, while under limited driving privileges' awaiting his trial, Mr. Ostendorf was arrested again for OVI by another agency, we are working to get that video.
Eventually he ended up pleading guilty on both cases. His sentence is the following:
    - $1500 in fines
    - 12 points
    - License suspended for 2 years
    - 180 days jail, 170 suspended, 3 days mandatory
    - Probation for 1 year
⚠️ Footage from this video was obtained via the Ohio Public Records Act (R.C. 149.43) All suspects featured on the channel are to be presumed innocent until proven guilty in a court of law ⚠️

@@jimijames63 cause he is a federal law enforcement officer. Keep in mind that every agency of the federal government has many employees with many different duties. The IRS for example does not exclusively employ auditors, people love to say "why would an IRS agent need a gun" thinking that the armed personnel at IRS must be auditors. IRS has an entire Criminal Investigations division.

Big props to the wife for simply chewing out her husband’s ass instead of taking it out on the cop. Too many times I have seen dash cams of cops who get pulled over for DUI and their spouse is with them trying to pull the “they haven’t been drinking and they’re a cop blah blah blah” bs. My heart goes out to this wife and it’s shitty she got pulled into this but I’m so fuckin happy she took out all her anger of her POS husband and didn’t blame the cop for simply doin his job.

As an Australian watching this I am going nuts! In Australia the p[police just have you take a breath test and that's it!! two minutes!! If you fail you get locked up! What a waste of time this process is - the guy is plastered. "Follow me home" - yeah that's not going to happen!

No one passes these. The test is just a pretense to gather more evidence against someone. Just like the dogs that always alert on every car because the handler cue’s them or it just wants the toy/treat and positive response from the handler.

Same in UK. Here the police can eve stop cars for random breath tests especially around Christmas time ..its a breathalyser and thats it. You pass or fail ...no nonsense..

    • @mariusvanc
      @mariusvanc 2 года назад +1

In Canada you have to submit a breath sample to the machine at roadside stop, no cause required, and you can be stopped for any reason. Refusing to is the same as being convicted of DUI, you lose your license immediately.

In the US courts, the standards for proof are very high and we have some intense defense attorneys that make a massive amount of money defending these cases, so they have motivation to be really great lawyers and they get a lot of people off. It’s not a waste of time, it is called “gathering evidence” for the case.
