Federal Agent Gets His SECOND OVI In 4 Months (.214 BAC)

- Montville, Ohio -- The Montville Police Department was called to a gas station over reports of a man who allegedly fell asleep in his vehicle and then was swerving all over the road. Police stopped the man, who the officers knew by name.
Eventually they determined that the man was possibly under the influence of alcohol and they asked him to perform some SFSTs. The man didn't do too well on the tests and was taken to the station for processing. He consented to a breath test which yielded a result of .241 % BAC. Legal limit in Ohio is .08, so 3x the legal limit.
The man, later identified as Brad Ostendorf, was charged with the following:
- OVI
- Breath more than .17%
This man, is a Assistant Special Agent In Charge of the USA Environmental Protection Agency, he is considered a federal law enforcement officer. This is the agent's second OVI within 4 months. As a matter of fact, his other OVI case was still pending at the recording of this video. After this OVI he changed his plea to no contest on all charges.
He was sentenced at the same time for both cases which is as follows:
- $1500 in fines
- 12 points
- License suspended for 2 years
- 180 days jail, 170 suspended, 3 days mandatory
- Probation for 1 year

It is unknown to me his employment status with the EPA especially with the his retirement coming within the next year.

His last DUI he was .267%, now he’s .214%. At this rate of decline, about 5 or so more DUIs til he’s below the legal limit

Most people with a .241 BAC would be on the ground or close to it. He's an alcoholic. I hope he gets treatment and learns to live sober.

@@markb9994 Wrong. Size is irrelevant when talking about BAC. It takes more alcohol to get a big guy to .241, but .241 is .241. Some people do have greater natural tolerance than others, but nobody functions at the level he functioned with a BAC over .20, unless they are an alcoholic.

@@markb9994 I'm a big guy too. I get what you're saying. But I spent over 40 years investigating and monitoring people who got OVI/DUI's, and pretty much anybody who functioned as good as he did with a BAC over .21 was eventually diagnosed as an alcoholic. I may be wrong about him, but I don't think so. I hope the Court at least makes him get an evaluation, and not just a DIP weekend.
I like how everyone feels so sorry for him cuz of his alcoholism but forget to mention that he didn't think twice to hop on the road and put everyone elses life in danger just to drive home. Whatever your problem you are dealing with, putting others life's at risk for your own convenience is despicable and this dude needs to be in prison, hes a POS

I used to do the same stuff and drive drunk to get more alcohol all the time. I then woke up one day and realized that I can’t do this anymore and I need to do something. I’m going through recovery right now. I feel amazing everyday now being sober!

I've been sober 32 years. It wasn't easy, and I still have my struggles when my stress level is high. But I made a commitment to myself in 1989 that I wouldn't take a drink NO MATTER WHAT HAPPENS. Because I really WANTED sobriety in my life. Just knowing that you "NEED" to isn't usually enough. You have to do it for yourself, as quitting any substance abuse issue is a total inside job. No one can do it for you. Quitting drinking is the best decision I have ever made. And I hope this man turns things around like millions of other alcoholics before him have done. ♥️

Thank you and congratulations on your years of sobriety. Yeah it's kind of crazy to see people they get in so much trouble with the law and they're told not to drink and they just can't stop themselves. I just wish everyone would reach that point to make that change before everything falls apart but sometimes I guess that happens. We had a family friend who's dating my sister. They broke up years ago bc of his escalating behavior. He had a horrible drinking problem and he's in prison now. Sadly. He still doesn't think he has a problem.

I got 2 duis in 4 months. Drank for one more month after the second one and then finally asked for help. Been sober since July 10th 2019. I have never been happier in my life.

When you get caught with a BAC more than THREE TIMES the legal limit the FIRST time, and you're a friggin' Federal Agent, you've got a problem (see the previous video on Mr. EPA here). The guy's daughter had to go pick his car up from the side of the road, and his wife picked him up from the cop shop. And this was on his 20th wedding anniversary, too. Boy, was she ever pissed off.

I too was a normal person until Crohn’s disease and over 25 surgeries and one colostomy bag later I was dependent, very depressed, and stuck in years of sickness then addiction but we are evidence of making a decision and allowing God to transform and remove a mountain we could not. I still have extreme pain and sickness but not the burden of being beaten into submission by the medication they prescribed us to help. Let’s keep going. Congratulations 🎊

I’m an alcoholic. This is not something I’m proud of and I am ashamed to have to admit to it. I don’t know why I became this way, I could blame it on losing my wife, I could blame it on losing my son, I could blame it on spending my birthday holding my father in a pool of blood while he died due to cancer. If there’s any excuse to be found then I would have to say, it was my method of coping. There is a fine line between bad habits and addiction, and the answer eludes me.
When sleep brings you nothing more than bad dreams, and you wake up to realize that you are actually living the nightmare, you reach for an escape.
It’s not a reason, nor is it an excuse, sometimes life can’t make lemonade and all you have left is lemons. We all have ghosts, some of us have demons.
Graham, just don't drink for today. If you already have, stop now. Go for just the rest of the day. It is a start. Next, look for a place to volunteer. Get out of your rut and spend some time helping others. If you can't help yourself, help someone else until you can. Animal rescues are great - they are mostly ladies and appreciate the help, especially if you are good at repair or computers or anything like that. Maybe foster a pet. Just for today, do this much. The start over again tomorrow.
I hope you’re able to find your way to a sober life so you are hopefully able to build a stable, happier life you can keep for as long as the universe allows. As a Paramedic, I’ve met far too many men & women distraught over everything they’ve lost in their lives, when a lot of the losses are often due to that demon coping mechanism. Most aren’t bad people at all, but when loved ones can’t cope with you seeming to choose alcohol over them, or with the consequences of the drinking, they have no real choice but to walk away for their own sanity & safety. It’s a shame that alcohol leaves so many broken lives & relationships in its wake
In AA the teaching is ‘don’t drink today’, where you struggle along 1 24hr period at a time.
But , AA also has the Twelve & Twelve (12steps & 12traditions of AA). So I like advising new members “we have the 12&12, treat the day like that. 12 hrs from midnight til noon & 12 hrs from noon til midnight. Justdont drink this HOUR.”
*another tactic I used was “I can easily not drink TODAY. If I’m going to drink I’ll wait til tomorrow.”
When you wake up ‘tomorrow’, it’s no longer tomorrow, it’s ‘today’.
Being an alcoholic is one thing, being an alcoholic and driving everyday is another.

When the judge suspended 170 days of the jail sentence, he all but guaranteed that Mr. Ostendorf will commit this offense again.
The first time was his 20th wedding anniversary and his wife was LIVID ( end of 1st video) I can't imagine what happened after this time...
I think it's so sad how alcohol can ruin everything 😕 hopefully he gets help.

Are you American? Do you live out west in a dry climate or somewhere in the southern US where it's generally hot and humid in the summer? Just asking because if these clouds stand out to you, I'm guessing you don't see them often. They're in Ohio. These types of clouds are more common tge further north you go. I grew up in Wisconsin and saw large versions of these clouds regularly. Like massive beautiful cotton bunches. I've since lived all around the country, and almost never see these clouds in some parts of the country.

Another alcoholic in recovery here! It was getting caught by police two times driving drunk that made me get sober. I didn’t want to live like that anymore. I am a good person but my behavior didn’t show it. I’ve been sober now for about 20 years. It was hard but so well worth it. Thank God for dedicated and professional police officers helping us even if it’s from ourselves.

After quitting alcohol 37 years ago, I started back up in 2021. I go to work and before bed I have a few drinks, I don’t and won’t ever drive after drinking

@Jay Smith you must’ve missed the first video where he was even more drunk on his 20th wedding anniversary and the wife mentions the kids not wanting to look at him.
Just speculation based on my experience- his disease has progressively worsened and he’s put his wife and kids through hell. They love him and struggle with balancing protecting themselves and wanting to help him. His kids will need serious therapy for a long time and there’s a strong chance one or more of them will develop an addiction of some sort.

Once alcohol hits my bloodstream, my prefrontal cortex shuts down and I immediately want to get into my car and drive somewhere. I haven’t had a drink in 12 years. Bless these officers for keeping us safe.
I'm all for protecting the environment, but it's more important to me that the federal authorities aren't driving drunk and putting the rest of us drivers and passengers in grave danger. Twice in four months? Really?

I drank every night when i got home from delivering mail for the postal service until one day i woke up sick went to clinic and was told that i have heart failure, had to retire with 32 years of federal service. I would not drive if i was drinking and went to work hung over but not drunk . I was a heavy whisky drinker and my heart was destroyed by the heavy drinking or the heavy smoking. Im just glad to still be alive.

Here in Romania, the legal limit is .00. Officers use breathalyzers. Over and done with in 30 seconds. They do not do any field sobriety tests. Only the breathalyzer and hospital blood draws.
Well here in amercia we have too many fukin lawyers.. so the more crap they do for a field test the more it can be proven not guilty on a technicality if you have enough money...

As a recovered alcoholic, I feel bad for the guy. He is clearly high functioning, as I was. I used to go to work, shaking, and as soon as the pub opened I was straight there. I'd have 3 doubles in 15 minutes to stop my hands shaking and then go back to work (at 9am). I would then go back to the pub every hour or so to top up and by the end of the day I was blind drunk. I'd then get home and continue to drink until I passed out. I lost multiple jobs, spent the night in jail, and was very lucky it wasn't much worse.
You have to stop, now, it will only ever get worse and worse. .214BAC is ridiculously high, only an alcoholic could function at that level. All it takes is some little kid running out in front of you whilst your drunk for you to spend significant parts of your life in prison.
idk where the high functioning part comes in because he fell asleep in his car, almost got in a car accident, was barely able to track the conversation and barely able to hold his id without dropping it.
As a fellow former “functioning alcoholic” you have earned my respect. I nearly died from self induced cold turkey detox. It saved my life and I’m so proud of anyone else who crawls their way out of the hell of withdrawals & being an alcoholic.

I got a DUI at 21, blood test was .32% I was at a red light past out, and my car rolled really slow till I hit a pole, I got really lucky. I'm 22 now, got my license back doing DUI classes, halfway done and on top of payments. They let me leave after they took my blood, I was only in there for 30 mins. I still have my car, no one got hurt, so I'm glad it happened sooner than later, it coulda been way worse

WE? I have done many dwi arrests and tests and its a designed test to evaluate...i have let many citizens "go" for the discretion of being just and fair so it is a case by case basis...
Addiction is a bitch and I hope this dude gets help. I'm an ex heroin addict so I know the struggles with having an addiction that causes significant withdrawals. Luckily if I was in withdrawal even though I felt like I was dying I wasn't and I'd be able to live if I got passed it. I've been clean for 4 years now, and I hate seeing other addicts getting in trouble or in bad spots because of their addiction. I wish you the best of luck dude, get some help you have tons of support here in the comments. We're all here for ya man!

@@dianemorris5816 it really was. Not only the withdrawals but the realization that I can't escape to a feel good place whenever I wanted now. That I had to deal with everything. It was very hard but I wouldn't go back to it. I was super lucky and got addicted when I was young and was able to come to this realization and stop it before I hit 30. I didn't do so much damage that a lot of things were not repairable. I've fixed a lot of my wrongs. I've stayed true to myself and just keep going. No matter my hardest day sober, it doesn't compare to my hardest day high.

My life was completely ruined with my first and only dui I've ever had.

@@opieutt9038 no. No accident no injuries, no deaths. I went to all my court cases, paid all my fines, paid for and went to the required DUI classes. Had my interlock installed.
The courts screwed up my paperwork and the rule is you have to have an interlock installed in every car that's in your name which is when I found out that 5 other cars that I Junked (sold to junk yards) like 10 years ago we're all still in my name. So I had to go to court and ask the judge for them to exempt them. After that I asked the judge "so I can go get my license now?" And he told me yes. So I went and got the interlock installed in my one car, showed the DMV the paperwork from the judge and got my license. Now, according to the DMV and the courts I didn't have an interlock installed for 12 months. Even though I had to go in once a month to the place that installed it and get it calibrated and send in the data from it to them. Then I moved a few hours away and had to buy a new crappy car for a thousand bucks, went to go register it and the DMV told me I still need the interlock for 12 months and that I still have 5 cars in my name. I called the DMV head quarters and they said they have no paperwork from any judges about my exemptions and that they have no record of me having the interlock installed for 12 months. So I asked "soooo according to your computer I've technically been driving illegally for the past 12 months?" And they said "technically yes".
Now I have no money to buy car, no money to install an interlock, no money to pay for the monthly interlock fee and I live 3 hrs away in the middle of nowhere so I can't just catch a cab or public transportation to and from work.
It set me back atleast $7,000 for my first and only DUI. And if I get caught driving without my license and no interlock (even though I shouldn't need one since I fulfilled my obligation) then that's jail time of up to a year.
I need like $3,000 just to be able to drive again.

He probably thought "oh god, not this pen test again!" If anyone has seen the other arrest, the pen test literally takes 10 minutes by itself. It's painful to watch.
The pen test is BS. Most cops don't know what they doing when they give it.
@@petedog9581 K9 units are bs too, or at least the bs is dependent completely on the handler. In Chicago, K9 unit accuracy for drug sniffing dogs was below 40% on positives for Mexican and Hispanic individuals. So there must be some factor making the dog alert incorrectly more commonly to minorities, or just bad training maybe but it's kind of unbelievable a 40% accuracy dog can be admissible in court.

For those of you questioning what was discussed when the camera was muted - it was redacted, not muted by the cop. You can see the cop leaning in the window didn’t move his arms when the talking was muted (@19:14) nor when the sound came back on (@ 19:51) so he didn’t adjust the sound on his camera. No doubt the discussion about his ID was related to his work or to his private identity so is not a matter of public record. Even at 20:02 where he has one hand out of sight for a second when the sound goes off again, that’s not really long enough to turn it off & when it comes back on @20:38, both hands are in view. So stop being so darn suspicious! Even when he mentions “privilege”, that would be about having to have a licence for his job, which many people are granted. So they weren’t using kid gloves or muting their mics for him.

@@allisonjames2923 they're talking about earlier in the video. the cop takes his bodycam off and puts it on the hood of the car. You can tell he knew he was doing something wrong because he started to say "technically we're supposed to" and then he took it off. You can even see the other cop follow him as he makes his phone call, and I'm guessing he got shoo'd back - because when the two officers start talking to each other again he apologizes and says it was nothing major. IMO they were trying to prevent his car from being towed but they're not allowed to. Cops gonna be cops.
When I was a Sponsor, it amazed me how a new person who was coming to meetings because of a DWI would invariably get another one within their first 90. It used to break my heart. Particularly those of us in public service. But that 3% success rate follows us around like a cinder block some times. It took me five years to get a year. I know it all too well but, "there are those of us who are constitutionally incapable of being honest with themselves" and I don't really know how I've gotten to 16yrs now but, I'm not questioning it.

Since he lost his driver's license for two years I doubt he maintained his job. Seems fair. I lost 3 people I loved due to a drunk driver - I have zero patience for that level of stupidity. Years ago I had Jury Duty for a drunk driving case. He was found guilty on all charges. If you feel you must drink just stay home. Period.

Alcoholism may be a disease, but you can't blame the drink on the conscious choice to have that drink AND get in a motor vehicle (although we've had dui arrests on bicycles already in my town). We can't blame the car for forcing the person with the disease into it and turn the key for them. We've had people in my state with more than 10 duis and they were still getting caught driving. I really think we need a three strikes law for dui, where a third conviction gets you life. The drunk driver may have a disease, but it isn't fair to the rest of society to risk their lives because of a drunk driver's disease either (if they are an alcoholic). In Wisconsin dui is becoming such an epidemic we seem to regularly have multi-vehicle accidents where multiple drivers are over the limit.

I was a functioning alcoholic for 20 plus years. I can’t tell you how many times I drove drunk and was never caught sometimes parking on the front lawn of my house or getting hung up on boulevards and walking home. Towards the end my life fell apart I lost everything except my job and met a beautiful woman before deciding I would lose her too if I didn’t quit drinking. That was 10 years ago. The girl stayed and I married her thanks to staying sober. My life is a million times better. My only regret is I did not quit sooner. If you are thinking about quitting stop thinking about it and do it. I went cold turkey but I would recommend detox and Rehab. Hope this guy got the help he needed he was in rough shape.

Oh, man, I still have visions of driving home actually praying that the cops would stop me. It's been a long time; but some memories never go away...they stick around to keep you sober. I still consider myself one of the luckiest ex-drunk around for never hitting bottom; and I know the difference between good luck and good character.

What is the point of all the different tests like the eye movement test/standing on one foot or whatever etc , because if you fail on the breathalyzer it doesn't matter how good you did on the FST? Why just not go on and do the breathalyzer and Skip all that other crap?
I have worked for the Federal Government for 35 years, not law enforcement but civil service. We take an oath to follow the rules. This hurts because you break an oath to the citizens that have a right to depend on you and to us who actually are trying to do right

This is one of the first videos I see where the police pulled over an officer, and they actually followed the policy without question.

My little sister passed away in my arms when she was 45 years old,she drank since she was a kid ,lived a crazy life with more money then anyone could have ever spent in a lifetime ,of course we all (family and friends) begged her to slow it down or stop,get help.
She would say ‘I don’t love anyone enough to stop’.
Well two weeks before she died a horrible death she stopped drinking,she said if I stop now I’ll buy a liver because mine is only working 5 percent and I’ll be ok…
I couldn’t understand how she thought she could buy her way out of this when her liver was 95 percent gone…
It has to be one of the hardest things to do and maybe I’ll never understand because I never wanted any kind of drugs in my life.
Not one day passes I don’t miss her, I guess it hurt me more because we had just lost our big sister and Daddy to cancer…
You know when you need help,you’ll get help if you don’t want to hurt the ones that love you the most…..

I live in a pretty well known city in WV, about 3-4 hours away from Cleveland. My daughters (she’s 28) father is a previous city police officer here who was *very* highly decorated. He flipped his vehicle one night when our daughter was in middle school with a BAC of .341. He immediately called another officer who drug his car off the road before the county/state cops could arrive. He walked to his home and called an ambulance. He had several broken ribs and a punctured lung. Everyone knew he was driving, but no one could prove it. My city decided that the best way to deal with him was to send him to a rehab facility in a very tropical location. Antigua, to be exact. He came back with pics of himself lounging on the beach with Whitney Houston and Bobby Brown🙄. Didn’t lose his job, the public was never informed. He is a lifelong alcoholic who missed his own high school graduation due to being in rehab…
ETA- karma finally caught up with him a few years ago when he was forced to resign his job due to an “indiscretion” he had with a 17 year old girl. He was the “resource officer” at the private school she went to. Her father is a very well known defense attorney in my area.

It’s not enough that most literally risk their lives & see a side of life that you don’t have to? You expect them to be superhuman & infallible as well? This particular guy is the head of EPA enforcement so not quite the same as other cops, but then I have no idea of what he has dealt with in his career. But if you spend years seeing the absolute worst of people & dealing with the most heartbreaking & horrible things imaginable, you’re just as likely as every other person to make a stupid mistake. I’m not saying they should get away with breaking the law. They should be held accountable just like the rest of us. But to give them double the sentence is unreasonable at best. I know when I’ve been unable to save a toddler who drowned in a dog’s water bowl; or treated a seizing baby with thumbprint bruises on her arm & learnt that not only was she seizing because of a massive brain bleed, she had evidence of old bleeds too that mean she would never have a normal life, even if she survived; or when I’ve had to find words to reassure & comfort someone trapped in a car next to their dead family... I know there are times when I’ve felt the need to have a glass of wine or two before bed. I haven’t ever driven drunk & I wouldn’t, but I can see how easy it would be to use the same coping mechanisms that millions of other people do & sc%#w up your life in the process. And law enforcement ARE held to a higher standard anyway. Most lose their job if they lose their licence, even if it’s PTSD or the stress of the job that causes them to turn to drugs or alcohol.

Got a .24 in Cali like 15 years ago. I was a PRO drinker. Cops said they were shocked I was drinking. They got behind me at 75 and let me get up to 104 before hitting the lights. They didn't write me for the speed. Wonder why. If I would have killed someone they woulda been fkt. Anyway, I'll be the first to say, I was the worst version of myself I've ever been that night. I don't drink anymore, I see now the danger I put everyone in. A little further down the 5 that night, a father and son were killed by a different drunk driver. I think it was meant to be me. And I'm thankful I was caught by those two cops that night.

Wow! Thank you for the share! As an alcoholic myself with 10 years now sober, I never drove while I drank. I did all my drinking at home. I never ever wanted to put myself or anyone else’s lives in danger because of my stupidity. I would get all my errands done and was in the house safe and sound before I poured that first drink every night. Alcoholism is such a progressive disease… I got to the point where if I wasn’t at work I was drinking, starting first thing when my feet hit the ground on the weekends… The weekdays became so unbearable having to go to work while going through alcohol withdrawal… My anxiety was through the roof and it was getting to a point that I was no longer able to function without my Seagrams 7 and diet 7-up… As a result, I was “laid off“ after 28 years of service at a well-known California hospital. I was very lucky that the vice president I supported check into account my years of service and didn’t actually fire me. I thank God that I never had any legal issues due to my drinking and was extremely relieved that my marriage survived… There are times when I struggle… I hear certain songs and it’s a trigger. I was taught in rehab how to get myself through these triggers and it has been a lifesaver…

thats why u dont do any tests cuz they'll do it until you do fail. they could get you for suspected but thats easier to fight when you havent broken any laws while doing it

I quit drinking for 20 years because the Navy thought I would be a better Sailor sober, I disagreed but the Navy won and I went to rehab since I had blown the re-up bonus they gave me and couldn't pay it back if they booted me out. Went to rehab, had one relapse afterwards. Quit drinking in '85 while in Adak, AK. I can now have a beer and not crave another one like I used to, I drink maybe a beer a month as I now recognize the consequences if I were to start drinking on a regular basis again.

Actually, they are legally allowed to mute their cameras during discussions on how to deal with a situation. Not any illegal stuff for that. Check your local area to see if that is allowed there.
As for questioning what was discussed when the camera was muted when the two cops were discussing his ID - it was redacted from the public record under FOI laws, not muted by the cop. You can see the cop leaning in the window didn’t move his arms when the talking was muted (@19:14) nor when the sound came back on (@ 19:51) so he didn’t adjust the sound on his camera. No doubt the discussion about his ID was related to his work or to his private identity so is not a matter of public record. Even at 20:02 where he has one hand out of sight for a second when the sound goes off again, that’s not really long enough to turn it off & when it comes back on @20:38, both hands are in view. So stop being so darn suspicious! Even when he mentions “privilege”, that would be about having to have a licence under special conditions for his job, which many people are granted.

As a law enforcement / Federal Agent, he should be held to higher standards. Termination of job, he broke the law, plain and simple. Considering it was a second offense in such a short duration it is clear that this man did not learn his lesson. This man has likely arrested people, investigated people, had to give sworn testimony, if he is willing to drink and drive. Then what else is he willing to do, lie under oath, false reports, make up charges. So ya. As a taxpayer i'd like to see him removed from the position. Unable to drive any Gov / county vehicle. Oh, he has a family, his problem. his choice, his decision and not the responsibility of John Q. Taxpayer.

If the police can kill us with impunity and immunity in many other ways, I honestly do not see why they should be subject to DUI/DWI laws. We exist to be bait for the police to practice killings, and adding one more method for them to use is meaningless. We've allowed them to be elevated above us and that's that.

If you have ever been to Walmart, the clerks there don't get to mute or pause or edit the video of the security cameras. If you have even visited a bank, the staff there (even the manager) doesn't get to mute or pause or edit the video of the cameras. The taxpayers are paying for bodycams/dashcams. WHAT IS THE POINT OF A MUTE OPTION!!! You can bet that there would be merry hell if anyone in any other operation messed with the security cameras. The point of the camera is accountability. Anyone who pauses or mutes or redirects a security camera like a dashcam or bodycam should be terminated immediately and not allowed to further serve in that field. More importantly, what corrupt supervisor would ever put up with this behaviour. The only reason to avoid accountability is because you are corrupt. If a supervisor does not immediately take action upon discovering video muting/editing/deleting, that supervisor should likewise be terminated and prevented from further serving with full loss of all benefits including pension. Every person in America who works around a camera is able to live without a mute button. It's time for all police to be held to this minimal standard of accountability.
"It's USAA" He makes sure he states to the cop, knowing that USAA is provided for military and veterans, and believing dropping the subtle hint that he is former military will excuse his actions. @@ethanthompson1097 Yes, it's difficult to can someone with civil service tenure. However, if properly done, it is possible. One felony conviction is generally good enough. Something like this, multiple DWI arrests will generally stick. Good enough to at least take his gun and give him a desk with rubber pencils

I do not believe they were scared because he is a Fed. You are dealing with a repeat offender that had a firearm on him the last time he was arrested...for the same violation of law. It is reasonable to have that on their minds as a possible threat.
