    1). If the promoter( landlord or investor) or builder does not Agree to the RERA clauses to be put in agreement for sale even though the project is RERA approved, what can be done in such situation? Are we as buyers still eligible with all RERA rights even though the clauses are not part of Agreement of sale or sale deed?
    2). When we approach to some promoter or builder, they insist on cash payments and term it as legal by registering the property at a lower cost than the actual sale consideration. Even though the subregistrar is aware of this, they still don’t question the buyer and seller. What action can be taken according to RERA ? If we disagree for such transaction, they deny the property to us. What provision we have to deal with such cases? Strange part is it’s such a deep rooted problem in our society, people say property dealings are not possible without black money.
    3). Where do we get to see registered real estate agents? We still see many brokers and agents are still marketing without being registered under RERA. What can be done if the agent is not revealing their RERA Registration number? Where in RERA, can we raise our voice if they are misbehaving or threatening us?
    4). What precaution should we as buyers take while giving token money? Some times it’s so fast that we can’t go for a bond paper deal for token money. Bond paper is scarce now in our city as well. Promoter and builder take advantage of that and deny the property later on after the token money is paid and many times we have to run after them to get that back. In my case the dealers threatened me of not giving my money back. They did not turn up for agreement and blamed me for delay in further payments and missed date of agreement of sale.
    5). What RERA can do if we see a Nexus of bankers, promoters and builders or any other powerful set of people who dominate and bully over the rights of a common buyer. Can we give an anonymous complaint? Anonymous because it’s not only a risk to a single person but the entire family.
    6). People in the real estate field get away with black money transactions day in day out and forcing common genuine buyers to do the same. What can RERA do to control this menace and can this be investigated from your side upon complaint? I as a common buyer might not be able to give you credible evidence as we don’t intend to gather evidence like this during our purchase but we come across these demands of cash transaction.
    7). What are the clauses for TDS? Is it applicable for property with a work order ? For example, if the total sale consideration is 80 lakhs, work order is generated for 40 lakhs and the sale deed is executed at 40 lakhs.
    8). Some promoters and builder mention the date of completion to the maximum limit in the RERA links but they don’t need that much time line to complete the project. Is there any way RERA can audit such information as per their other documents that they share with Muncipal corporation, Development Authority, Banks etc.
    9). What can we as buyers if we don’t get enough transparency in getting all the information from the promoters or builders.
    10). Many a times even with construction linked payments, the builder constructs to an extent(example until slab work) where they can gain the maximum lump sum and the buyer keeps on paying interest until possession and it’s clear that the other part of construction goes very slowly where the money disbursement is low in that phase of construction.

    Kya gazab ka mehanati analysis tha! This act has clauses to resolve almost all kind of issues that poor buyers face. So happy to know that builders can't cheat and freely draft one-sided clauses like an open bull. I think it has almost ensured the builder's accountability and, tried to narrow the loopholes and excuses that a builder can give. *But,*
    This act should have also contained Rating or Score system like CIBIL in RERA website for each construction projects and builder's company reputation. If a builder does something wrong with the project or customers, so their score should be affected negatively. Thus, it would have made them much more accountable to the public and banks.
    Also, the builders can set very lower interest penalty rate for customers late payment to almost evade from the construction delay penalty clause. Thanks for making a video on it!

      Sir kya aap mujhe yeh bata sakte hai ki Maine 2009 Mai ek builder se 2 bhk buy kiya tha 1600/rs per sqft pr aaj 2020 Mai project start huaa hai tab cost 15 lacs around thi aaj woh 55 lacs mang raha hai mumbai kalyan to mai kya kru kya iske liye kuch hai RERA mai please reply sirji.

      @@AssetYogi Is the laws applicable for non-municipal areas in Jharkhand but near to the city? And what if the all the flats owners have taken the possession (property was under construction during the law formation) but the property is not listed under RERA. Will it cause issue while re-sale in future and any other compliance?

    One question I have seen many builders getting RERA despite litigation on land, and for such projects some banks refuse to provide loan mentioning there is litigation on land and their legal team does not approve to provide loan.

      It's very true sir understand rera is for tranperancy and not to check the legality, it's for ascertaining whether all the permission are taken, again it's the responsibility of the buyer to ascertain regarding the authencity

      If your money gets stuck in a project like this from any bank... neither will the bank move the loan to any other property ... nor will they support you.
      They will in fact take all legal action in their power to get the money from you as even banks know that builders can’t be jailed in India.

    Suggestion needed-
    Sir Builder is charging extra for basement parking area(stilt parking) and according to RERA act basement is under common area builder can't sale it as parking space. But this project is small not fall under RERA. Sir please suggest what to do ??

    Sir My builder is delaying the possession saying that the OC has not come we are hearing this from the past 5 months, he's giving excuses saying that the Officer has changed and so on. The construction is complete only one wing Meters of electricity is to be fixed. What should I do Please help

    I wanted to know that what do you mean by no RERA required of the number of building is less than 8?
    Is there any area limitiation in number of building too?
    Or else all the projects are eligible for exemption from RERA.

      If any Project where Land area is more than 500 sq mts (5382 Sqft) or more than 8 8 units will have to register under RERA

      RERA registration is not under the ambit of RERA if the plot area is less than 500sq Mtrs as well as minimum flats or bungalows shoud be in Nos.

    I m going to purchase flat in Bihar.At the time of doing sale agreement builder told that no gst will be chargeable.but now he is saying that u have to pay 12%gst during registration.
    Please advise

      So, if it is not mentioned in the sale agreement anything about GST but if the promoter denies tha fact, you get warranty of 5 years by the promoter according to Section 14(3), he has to solve the issue within 30 days, if not, you can approach to the tribunal.

      It is very sad incident that the builder s not paying rent to the members of the society who are suffering huge losses and trouble as well. Redevelopment projects doesn't come under the ambit of RERA unfortunately. Govt. Should take seriously this issue so that builders should not play with the life of innocent people.

    Sir pls give your no it would be of great help want to ask you some important details of my flat, which builder has delayed giving me from 2013 till date.And Rera has given him 2 years from 2016 to 2019 extension and now is going to give him further one year more for construction after he registers in December 2019,I am very disappointed because he is cheating on me from very long time.

      The same issue is mine. Our builder has extended possession thrice from 2017 to till now but RERA is still giving time to builder till 30th June 2021.

    Can u please provide information on whether RERA is applicable for all the developers who are developing in freehold land in Noida as sanction plans has been approved by Sarpanch which is not a authority as far as I know..Also, all those colonizers, they haven't got any clearance from any authority ..what are the risks in funding those ???

      Well, Sarpanch is not the approving authority for layouts. So, I am assuming they are unapproved colonies, which do not come under RERA. There are always risks associated with unauthorised colonies. We are already seeing that in Delhi.

      Asset Yogi Agreed, these all are unauthorised constructions but many colonisers have received RERA numbers in all those freehold colonies wherein plans are sarpanch approved( which is not an authority) ..that is further raising many speculations ...

    Please clarify the followings : The promoter has taken total cost , but fail to deliver the flat . he is liable to refund the deposit with interest + compensation as per law that is equal-lent to rate of agreement but fact remain that interest will be yearly -quarterly or monthly cumulative.

    Sir, If builder added below maintained clause in seal dead then?
    That, the Purchaser are satisfied with construction work, specifications provided, design, etc of the said Apartment and same is as per her requirements & agreed terms. The Purchaser/s is/are fully satisfied with the work of Vendor and the physical possession of the said Apartment is accepted only after verification of check list of the apartment. The Purchaser shall not make any claim, compliant or objection before any forum or authority as to facilities, specification, construction work, modifications etc relating to said Apartment or Apartment Scheme.

    Nice information.
    RERA has been implemented but there is not much effective for ongoing projects. It is very disgusting that RERA have permitted to revise the proposed date of completion which is 5 years more than the date which was proposed in Agreement for Sale.

    I'VE SOME UNIQUE PROBLEM.
    My father bought a piece of land in Patna. Area is less than 500 sqM, in the name of my elder brother before my birth, Even my elder brother was minor that time. That time it was counted as family land.
    in 2011 my brother has signed an agreement with a builder for the development. As per my father wish I was the 50% owner of that land but verbal and the land was as it is in the name of my brother.
    before agreement I've talked with the builder, hence there is a clause mentioned in development agreement that due to family verbal commitment 1st party, according to agreement it is my brother, is agree to give 2 flats of his share to his brother Mr Kamlendra Kumar(My Name) and my PAN no.
    and below in the area of flats distribution area there is clearly mentioned 101 Flat Kamlendra Kumar, 102 Flat Mr. Kamlendra Kumar. Total 4 storage building, 2 flats or say 1st floor in my name, 2nd floor all 2 flats in the name of my brother
    201 Lalan Kumar, 202- Lalan Kumar. Problem occurs after agreement, builder didn't provide me the development agreement true copy. So, I've went to notary and get the true copy my self. Later on, the builder has done a re agreement with my brother to develop 2
    floors containing 2 flats each floor. what is in this agreement no one in the family do not know, Now my brother just shows the new agreement and tells every one that I've done a new new agreement with builder and not going to give any flat to kamlendra. while the 1st development agreement is available online where I am not seeing any change in the agreement.
    the construction is about to finish in 2019, and they have constructed 6 floors rather than 4 floors as mentioned in the agreement. I am not getting any flat in these 2 floors. and according to brother he is himself getting only one flat out of 4 flats.
    Ive met may advocates and some other builders too, every one is wondering how it is possible to not provide you these these flats? After questioning what could be the new agreement is? builders told me it could be agreement of extra construction which often occurs after this agreement and for this land owner also should be agreed. Since the land owner is your brother so, you were not required there.
    Since there came many problems so, the development is still going on while they had to finish it within 2 years after the agreement.
    but due to some government problem the building process was stopped in BIHAR for 2 complete years. I want to meet with builder but he refuses. Since he didn't provide me the true copy now I myself afraid of, Will I get these flats or not? what legal steps can I take? Will RERA or any government body available to watch these type of fraud except court? need your suggestion. Thanks in advance.

    Now Last of 2020, in Guwahati builders are taking flat amount asper Super Built up area instead carpet area.

    In Navi mumbai and mumbai....Increased illegal internal extra space work and construction at Gallery, Windows, rooms and flats in buildings. So,Skyscraper, society's and buildings seems ugly and unsafe. Lots of new building are risky and dirty. No rules follow by public and govt.Mumbai never compare to foreign city. Save architecture and construction design. Observe it. Govt planning to make Smart city.....but situation is different.

    Given a choice ,what is more effective and fast-RERA or NCDRC-NATIONAL CONSUMER DISPUTES REDRESSAL COMMISSION.WHER SHOUD CONSUMER APPLY FIRST.
    can one apply in both authorities -?
