That means that the taking can only be for direct public use and for no other reason. Dire military need in wartime is public use. A park is public use. A public school is public use. A highway is public use. A railroad is public use. Malls, apartment complexes, company headquarters, and other private development is never public use, even if there is the potential for public gain or benefit. The framers of our constitution chose their words carefully and meant literally what they said. If the framers had meant public gain or public benefit, they would have said public gain or public benefit and not public use. Our courts, including the SCOTUS, have done an excellent job twisting the letter and meaning of the constitution around to suit the demands of the wealthy and the corrupt. It is time we straighten these bad decisions by reversing them to suit the original intent and meaning of the founders and the constitution they wrote to protect us from this sort of tyranny. Eminent domain was never meant to be used to force transfer of title of land from one private owner to another just to satisfy the greed and unwillingness of a developer to pay a private owner what the current owner wants for their property. My city is growing into a metropolis. I fear emminent domain may befall my neighborhoood since our University is growing. Perhaps investing in the pulic education of IT may help so we can learn from home and prevent relocating families. Maybe hold classes in buildings that are not being used such as a Church . Since they tend to be used only a couple days a week for their sermons. Save our gardens. Save our planet.

IDK why commenters keep saying it has to be public benefit, that's literally not true. The Supreme Court has been clear that property can be seized for ANY purpose the government chooses. The only requirement is that the government has to pay the fair market value (which essentially is tax related value the property owner previously reported). This is the problem when people don't know the law, they get outraged that the law is enforced. The complexity of the law is to blame however.

Malls, apartment complexes, company headquarters, and other private development is never public use, even if there is the potential for public gain or benefit. The framers of our constitution chose their words carefully and meant literally what they said. If the framers had meant public gain or public benefit, they would have said public gain or public benefit and not public use.
Our courts, including the SCOTUS, have done an excellent job twisting the letter and meaning of the constitution around to suit the demands of the wealthy and the corrupt. It is time we straighten these bad decisions by reversing them to suit the original intent and meaning of the founders and the constitution they wrote to protect us from this sort of tyranny. Eminent domain was never meant to be used to force transfer of title of land from one private owner to another just to satisfy the greed and unwillingness of a developer to pay a private owner what the current owner wants for their property. Under Kelo, Trump would have won. This must be forced to never happen again.

Perhaps investing in the pulic education of IT may help so we can learn from home and prevent relocating families. Maybe hold classes in buildings that are not being used such as a Church . IDK why commenters keep saying it has to be public benefit, that's literally not true. The Supreme Court has been clear that property can be seized for ANY purpose the government chooses. The only requirement is that the government has to pay the fair market value (which essentially is tax related value the property owner previously reported).
This is the problem when people don't know the law, they get outraged that the law is enforced. The complexity of the law is to blame however.

How about considering rephrasing your choice of words. The last photo you showed at the end of this video proves Trump was right and why that building needed to either be moved or torn down. Trump was trying to help the city grow and prosper but the way you are presenting it as Trump being the bad guy was used to win the case throwing Trump under the bus. When the reality was seeing that house in the middle of a commercial area is one of the reasons Atlantic City failed.

I am not a democrat. At the same time, I'm not going to support some asshole, buying off the government, just to have some private park, helipad, parking space built. That is not what eminent domain is supposed to be for. EVERYONE'S private property rights should be honored. NOT just for the rich and powerful!

His argument was ridiculous. Eminent domain is not necessary for building schools or hospitals, and Trump wasn't trying to build either of those. He was trying to build another building for his own private business dealings. He isn't just a bully who doesn't respect property. He is also extremely dishonest.
