- A group of Sparta, Georgia, property owners announced they have teamed up with the Institute for Justice (IJ) to challenge a private railroad’s attempt to take their land for a rail spur that would benefit a private business. IJ will represent Don and Sally Garrett, Blaine and Diane Smith, and Marvin and Pat Smith in a legal proceeding before the Georgia Public Service Commission against Sandersville Railroad’s attempt to use eminent domain to condemn and take their land.

In March 2023, Sandersville filed a petition with the Georgia Public Service Commission to obtain the authority to condemn the land owned by the Garretts and the Smiths to build a rail spur to haul materials used for making concrete out of the Hanson Quarry, owned by Heidelberg Materials. The taking of the land-which would require parcels from some 18 properties nearby-would serve no public interest. It would simply allow Heidelberg to export materials via train instead of trucks.
“Taking people’s private land and handing it over to a private company for the benefit of a private business isn’t just wrong, it’s unconstitutional and against Georgia law,” said IJ Senior Attorney Bill Maurer. “The power to use eminent domain is limited to public uses and the public is not going to use this railroad-a private business is. Neither the Constitution nor Georgia statutes permit this kind of abuse of the eminent domain power.”
Sandersville Railroad is a powerful business with political connections. Meanwhile, the landowners in rural Sparta are fighting to save properties that have been in their respective families for generations. The Garrett family, for example, has owned the land since the 1800s.
“This is more than just land to our family - it’s where we’ve shared memories and built a life for ourselves for generations,” said Don. “We’re not going to let Sandersville just go in and take it from us.”
As for the Smiths, Marvin and Blaine’s great grandmother was born a slave on the property, which was then a cotton plantation. In the 1920s, their grandfather and grandmother were able to obtain part of the land as their own. They farmed the land, and always told their children to hold onto it-and they have. The property has been in the Smith family ever since.
While the Smiths now live in Maryland, they routinely come back to visit the house they grew up in and they plan to continue keeping this land in their family for future generations.
“Our family has owned this land for 100 years, and we plan to continue owning it for generations to come,” said Blaine. “We refuse to let a private company come take the land that we hope to leave for our children and our children’s children.”
“It’s clear to anyone that Sandersville’s attempt to take land from the Garretts and Smiths serves no legitimate public interest,” said IJ Litigation Fellow Betsy Sanz. “We look forward to standing up for these property owners in their fight against this unconstitutional land grab.”
The Institute for Justice (IJ) is the national expert on defending property owners against eminent domain abuse and other property rights violations. It represents the property owners in Sparta whose land would be seized by this eminent domain taking. Those property owners include Don and Sally Garrett, Blaine and Diane Smith, and Marvin and Pat Smith.
Any elected public figure that promotes this abuse of eminent domain needs to be voted out of office ASAP.

Granted eminent domain is needed in very narrow circumstances, but it should never be used for private gain. It's just damn shameful.

Railroads have had the right of Emment Domain in the US since at least the 1830s. The only real issue in such cases is the price. The US Supreme Court has long permitted the state to take land "for the public good" even if that meant the ultimate users are private corporations.
This effort can delay the taking and increase the costs but that is about it.

Forfeiture is by far the more abused practice. I have to stop myself from thinking abt it most days cuz it's disgusting how and how much it's used to steal from law abiding citizens. One of many things that have made me lose almost all faith in the justice system which I have personally been a victim of. What’s sad is nobody ever really owns their land - they are renting it, making payments to their landlord in the form of property tax. In the end, the government will almost always get what they want. In this case, the government will most likely profit more by taxing the railroad and the company it will serve than they currently do by collecting rent from these “land owners”.
The government will NOT charge the RR much, if any tax.

For over a hundred years railroads, almost all of which are private companies, have been given the ability to purchase land using eminent domain. The legal theory is that railroads are a public benefit. Privately owned toll roads have also been constructed using eminent domain laws.
The spur line will create $1.5 million in annual direct economic impact to Hancock County. People have to understand that the County doesn't do business in some magical vacuum filled with money trees that provide free money to them. They get their money from the taxpayers. Do you want expanding businesses to contribute extra tax money to fund County operations or would you prefer them to raise property taxes to fund their operations? Inflationary times also affect the County's budget.
It is all about tax revenue. The government will profit more from taxes levied on the railroad and the private business than they currently do on these unfortunate land owners. As I stated in a current reply, you never really own your land - you are only renting it and paying your rent in the form of property tax. The government will justify this theft as beneficial to the community because it will add more money to the coffers,

Just compensation would be 3X market value for the true loss being sustained by the person or household. They never offer that. I am a native New Yorker, back in the 1930s eminent domain was used to build the Triborough Bridge and the Grand Central Parkway. in the taking of the property one home owner refused to leave and secured his home like a fort. When the authorities showed up to physically carry him off of his land and out of his house the gun battle began. As a result he was killed but he succeeded in killing two policemen and injuring a couple of others. The day may come that history may repeat itself. And it would not surprise me if and when it does. A lot of people do not understand one thing when an elderly person knows that they don't have much longer to live they may decide to take drastic measures and possibly take others down with them. The abuse of power through eminent domain can be a dangerous game. Every time I hear another eminent domain story I think about what happened in New York back in the depression.

I work for a private company that built railroad bridges. We would rent land from farmers to build a access road to the bridge. The railroad always wanted to just take it. In my personal opinion it’s chicken $:@! That one of the reasons I quit after 12 years of it. I have absolutely no respect for railroads whatsoever. Fight for your land !

Georgia law gives railroads and utilities this power, federally it is also considered an interstate commerce matter. The landowners would be really stupid to let the final outcome be eminent domain, instead of negotiating a profitable partnership. Someone already has capital set up for a project of this scale and complexity and is thinking decades ahead. I don't think Sandersville Railroad or the quarry are in it alone.

The Institue for Justice does amazing work and I am convinced they'll be victorious in helping these people stop this land grab. My rural neighborhood had a similar problem recently. A developer of 150 new homes wanted to dump all the traffic for the entire new subdivision onto a quiet winding dead end street in our neighborhood because he was too cheap to build a road directly to access a highway abutting his development. He lost because we have a great mayor who persisted until he gave up. The greed never stops. Keep up the good fight.

I am from a small town in Illinois. Railroad did it there. Took a bunch of land and homes to redirect some tracks. They had to "buy" the land from the people but it was pennies on the dollar compared to real world value.

With eminent domain everyone gets to make a profit accept the person with the most valuable asset, the landowner. Profit for the company that builds the railroad, profit for the company that operates the railroad, profit for the company the railroad services, profit for the local authorities in taxes, Prophet for the people that get jobs in all of this, ECT. The landowner gets current fair market value, no profit!. The landowners should get fair market value Plus a hefty premium or a piece of ownership in the project!. Why does the most important entity get the least?.
Eminent domain should require at least double fair market value plus all cost incurred to the landowner.
There are ways for landowners to profit. Only if it's eminent domain they will get almost nothing.

Our family currently has an eminent domain case filed against my grandparents farm. The utility has made multiple false statements claiming they couldn't find or reach a settlement with us. They've never tried. So they want the land now... about 7 acres for $10! They're attempting legal robbery.

Does Eminent Domain trump a "Land Patent", if so why get a Land Patent?
There is no land patent but there is a Land Deed. It does offer protection from government seizures of assets but I am not sure about entire takings. They also take 7 years without objection to become established. You have to do a survey, etc. It is a to the earths core deed.

There are a number of statements by IJ in this video that don't reflect the situation or the law. Most railroads are privately owned, for-profit enterprises. For hundreds of years railroads have been given the legal right to condemn private land under eminent domain to construct a right-of-way for the tracks. In this case the determination of the value of the seized land may be difficult to ascertain. Since the RR doesn't appear to be taking all of the properties but only a portion that would appear to me to severely diminish the value of the entire property. Who wants rock trains running through their yard? I would be surprised if the IJ prevails in this case, given both the courts in Georgia and, if it comes to that, the SCOTUS should they become involved.
You're missing something though. This is a limited purpose railroad. There will be no public access, passenger transport, and it only branches off of connected infrastructure. This is not the same as building a railroad for the purposes we normally think of it. This is not a railroad that will be operated for the public good.

For residential or conservation use it reduces value, which may factor in to fair market that must be paid. However, given the minerals the railroad opens access to, plus potentially two Class 1 railroad connections (from speculation) served by a business friendly shortline (unlike the large railroads) in a conservative state, the land value might increase a lot.

As far as you know. I see something else going on from some research. I think landowners should play with some business sense to minimize the screwing they might get.

In NY similar case, the Supreme Court in 2010 decided not hear the eminent domain case involving Columbia University, which finagled the state into seizing local land, and local businesses [Never before happened!]. Started on December 18, 2008 when the Empire State Development Corporation (ESDC)/rep of Columbia Univ voted unanimously to use eminent domain to seize Manhattanville property for Columbia's benefit. In May of that year, the corporation had approved Columbia's plan for the area, which it characterized as “blighted" with the State of NY approval; a bunch of indecent blessers politician$. This is Capitalism 101! Using these samples of dishonest business misconduct and crook behavior by politicians including our Justice System supporting an especially valuable exchange partner for firms, as companies benefit from relationships with them leaving small businesses and home owners dry… that’s the reason people are doomed!

Eliminate the ability of corporations to influence politicians by disallowing their ability to donate to election campaigns, and place limits on how much individuals can donate. Corporate electoral donations and large personal donations should be unconstitutional because they are a form of bribery. Allowing corporations to expropriate land just because they need profit is so incredibly wrong.
I don't know the people in this story and don't live anywhere near them, but I feel for them. They seem like excellent folk. Hope IFJ can help them because they deserve justice.

I once worked for a Republican politician as his bodyguard while he was running for US Senate against Dick Durbin, when Durbin and Obama were the two sitting US senators of Illinois.
The man, my contract, was called to a meeting in a downtown Chicago hotel. At the meeting, a former federal level politician said to us, "If you take our corporate money and do what we say, you'll unseat Durbin. If you don't, you'll lose."
My boss said, "We don't take corporate money. Says it right on our website."
They said, "If you think that you're going to win because you're an idealist, you're absolutely going to lose exactly because of that. Every politician on either side was placed by us for accepting our money."
He asked, "How do we know that you're telling the truth?"
They answered, "There's an obscure little socialist lawyer that you know personally. In 3 years, he's going to be placed as president. We're placing him. His name is Barack Obama."
We laughed out loud and left the meeting. Sure enough, the little known socialist, the self-described "social justice lawyer" got placed as president. Exactly like they said.

This struck a nerve with how the government screws the avg citizens from obtaining generational wealth through excessive taxation laws which force most families to sell off there properties in order to pay the taxes amongst the children of the parents
Well wealthier families have very intelligent lawyers who legally work around these unethical taxes by use of creating LCC banking accounts.
Companies with the lack of integrious dealings are a cancer to any civilization. It's amazing to me, how you can own something, some clown or group of clowns deem it necessary to take your land to fit their needs. These people do not need to tolerate this, but if anything be compensated for this inconvenience and the company's entire business dealings be scrutinized. Sad mentality to think this behavior is ok and acceptable, it's not and should be met with the same or more force to be rectified.
This reminds me of the Kelo case. Being a retired Sr. Right of Way Agent, I have seen some unlawful practices mostly by local agencies.
