  • A small-town mayor in rural Indiana has made it his personal mission to oust the residents of a tight-knit working-class neighborhood, bulldoze their homes and build a fancy new subdivision for much wealthier people. The only things standing in his way are a plethora of state statutes, the Indiana and U.S. Constitutions and, now, the Institute for Justice, which has filed a lawsuit against the city on behalf of dozens of property owners.
    Following the U.S. Supreme Court’s notorious decision in Kelo v. City of New London, which permitted cities to take private property for “economic development,” the Indiana Legislature enacted sweeping reforms to prevent the use of eminent domain for private gain. To evade this law, city officials in Charlestown, Indiana, working in concert with a private developer named Neace Ventures, have concocted a scheme to destroy the working-class Pleasant Ridge neighborhood through a process that amounts to eminent domain by other means.
    Their plan is both simple and sinister. Charlestown Mayor Bob Hall has turned the city’s once-benign housing maintenance code into a bludgeon. City inspectors have begun issuing crippling fines for property-code violations-including even trivial ones such as a torn screen, chipped paint or a downed tree limb. The fines accumulate at a rate of at least $50 per day, per violation, quickly leaving homeowners with thousands of dollars in fines and no way to pay.
    While homeowners try to address each violation, the fines continue to accumulate and the city finds new violations to compound the penalties. Faced with crippling fines, the homeowners find themselves confronted with an offer they cannot afford to refuse. Neace Ventures steps in and offers to buy the property for $10,000. Neace does not have to worry about the fines or repair orders because the city has agreed not to enforce the law against the developer.
    The inspections regime has been a windfall for Neace Ventures. Not only has it compelled more than 150 property owners to sell-it has also forced them to sell at a considerable loss. The tax assessed value of the homes is between $25,000 and $35,000, and their fair market value was much higher before the city destroyed the market by vowing to demolish every property. The net savings for Neace, so far, is near $2 million.
    Mayor Hall’s alternative eminent domain scheme is illegal and unconstitutional under local and state statutes, as well as the Indiana and U.S. constitutions. The Institute for Justice has teamed up with residents to file a preliminary injunction asking the court to put an end to the mayor’s mission to destroy their community.

      @@winddmmy New London to be exact, and the case is Kello v New London. The houses there were bulldozed, and the corporation which wanted the site changed their minds and didn't use it. The properties which used to contain tax paying homes are now a city owned eyesore where people dump their old TV's and used couches.

      happy wombat The election was the first Tuesday of November 2019. Its highly unlikely that development will happen but don’t quote me on that as I have yet to find any news pieces that support that. I’m just assuming that a new mayor and council wouldn’t want to piss off the people that put them in to prevent that.

      Here's what you're missing. The government, under eminent domain, can seize you property for public use If it will not be used for such a purpose, then they must put it up for public auction. It cannot be transferred to a private entity for a sweetheart price. If it is, the original owner is due additional compensation and the recipient MUST report the difference between the market price and what they paid to the IRS as imputed income. Take a look at how the New York Times acquired their new location by such a process. They still haven't paid the IRS the taxes on the imputed income they received through the corruption of New York City. Hell - New York State as well as the city should be seized under enterprise corruption.

      Sweetness LTL You seem to be mistaken as to what Agenda 21 is. Agenda 21 is not at all about taking away homes or making "cookie cutter" developments. It is simply about getting governments to allow clean drinking water and get rid of houses that cause severe risk (such as fire risk from unkept wiring, or so old as to being on the brink of collapse.) Many conspiracy theorists have twisted the narrative to include things that it does not imply. Here are a couple points in the actual document.
      a. To provide all persons urgently with the opportunity to earn a sustainable livelihood.
      b. To implement policies and strategies that promote adequate levels of funding and focus on integrated human development policies, including income generation, increased local control of resources, local institution-strengthening and capacity-building and greater involvement of non-governmental organizations and local levels of government as delivery mechanisms.
      How about instead of taking alex jones on his word for it, read the damn document. Here is the interesting part of this, *the united states has not implemented this into law.*

      Sweetness LTL Agenda 21 is all about communism. By the way the new name is Agenda 2030 because the powers that be planned on implementing it by 2030. No matter what name you put on it the ultimate goal is abolish all private property rights and ALL citizens move into high rise cities.       Eminent Domain is a crime, it must be stopped. It should not be justified under any circumstances, not even roads, hospitals or schools. Politicians pushing for Eminent Domain should be prosecuted under US Code Title 18, sections 241 and 242: Conspiracy Against Rights (241) and Deprivation of Rights Under Color of Law (242). Punishable by 10 years in prison.

    A town near me in Bradford, Ohio did this to an old man. Ended up arresting him on some bogus charge after harassing him with fines. The night he was arrested they burnt his house to the ground with all his belongings. The news got involved got him lawyer and the city ended up having to build him a brand new home. I remember hearing the old man treated the mayor and told him he had a 5 gallon can of gas he carried in his car and he would get his revenge one day whether that was true or not I'm not sure but some one coming to the end of their life they have nothing to loose. I remember hearing a story of old miner with terminal lung cancer, being fired just before the retired to screw him out of his retirement. One day after being fired, he walked right into the mine owners office and shot him dead right at his desk. Rumors are he told him just before he shot him dead, If I can't have my retirement you'll never see yours.

    A separate federal lawsuit was filed in 2018 (by IJ ?) against several city officials and Pleasant Ridge Redevelopment, claiming homeowners' rights under the equal protection act had been violated. The city settled that lawsuit in 2019 for $1.5 million.

      Pat Macken I live in this neighborhood. I live on Audubon. what they're doing is telling the homeowners such as myself the town meetings only days in advance so we can't get there. we can't go to our jobs two days before the meeting and ask off.

      I think the original idea was for actual emergencies like a state of war or massive disaster after which the property would be returned. That I can actually understand being a thing. Like most laws they tend to make it vague enough they can expand it's reach as needed. Laws need to be specific. Like, eminent domain is okay in these specific situations followed by a list.

      The original intent was for emergency or infrastructure, but now it is for the ever ambiguous "greater good", which usually means in terms of how the politicians want more money.

    It's simple, The Mayor wants to basically increase the number of higher income residents, which will increase the number of higher income businesses, increasing the property value overall, and increasing the amount of taxes the city can collect. Basically Gentrification but trying to be done at a faster rate so he can reap the benefits before his term of office is up.

    This is why I tell people that you can’t actually own a home.
    You “own” it but you have to pay the government for the privilege of living in it, ask permission to build additions, and at the end of the day, they can just come take it.
    You don’t really own it. The government does.

      Michael Clark I hope that all this can be resolved peacefully and with common sense but I fear that some nut will go off his rocker and shoot up people like this mayor. Not necessarily a horrible thing to happen to a scumbag like him but certainly much worse than peacefully taking back their American way of life using the fed court.

    Back in November/December, a judge ruled that the town of Charlestown, In. violated the Eminent Domain law not to mention giving preferential treatment to the developer who had undersold a lot of properties that they themselves owned and that the city did nothing to apply the same fines to the developer of those properties that were in disrepair. The city was accused of stealing from the poor to give to the rich and that the mayor was given an ultimatum by the court: the judge ruled the City of Charlestown must enforce its property maintenance code in a "consistent" way against a neighborhood group and a private developer, siding with homeowners who filed suit over redevelopment of the Pleasant Ridge neighborhood. It also imposed an injunction on the city itself: if the city waives fines for property owned by development partnership Pleasant Ridge Redevelopment LLC as it has agreed to do, it must do the same for the Pleasant Ridge Neighborhood Association - or any other property owners.

    This is called, eminent domain! This is happened to my family first hand in St. Charles Illinois when they wanted to expand the library. They took my aunts home by the use of eminent domain. She fought for 10 years and still lost. I hope you folks have better luck than my family did!!

One of the modivating factors of the American Revolution was to NOT repeat the British system of "jailing and deporting" the poor and ppl in the USA are being sent to prison for debt? The Founders are rolling in their graves! I say leave the poor alone and let them pay their debts when they are able.

    THIS HAPOENED IN ARVADAFA, COLORADO! In the mid 1990's through early 2000's, Arvada, a suburb west of Denver was becoming a hotbed for New home development. One particularly hot area was the "olde town/ water tower" district.
    The developer made a shady deal with Arvada, they agreed to pay the city $100 for every old house ( dating back to the 1920's) they condemned or closed on via eminent domain. Within a couple months,over 130 homes, including an apartment complex were condemned. By 2004, the city had condemned 490 homes. These were replaced by trendy high-end townhouses and lofts.
    All the while, long time residents protested, tried to stop the project, filed lawsuits..... But ultimately lost and ended up having to move.
    Today, the area is filled with upper end homes, shops, and restaurants. BMW's, and Lexus vehicles drive the streets once used by Ford's and Nissan's.

    This happens all the time in cities. I live outside Chicago and there they are always condemning homes or neighborhoods to the benefit of developers. This mayor is the same as any other mayor that wants higher taxes for his town. Building bigger homes means more taxes for the community. Good luck for the people of that town.
