    Truck Drivers need to start talking about long haul truck drivers do not receive any overtime pay after 8 hours in a day or after 40 hours in a week. Everyone else our country gets paid overtime pay after 8 hours in a day or at least after 40 hours in a week. When the truck is not rolling, the long haul truck drivers don't make any money at all. This means when you are sitting in traffic because of a Big crash because you are still responsible for the tractor and trailer full of merchandise but you stop being compensated when the truck is stopped. Or when you are fueling the truck. No pay. Pre trip the truck no pay. Waiting to be loaded or unloaded no pay. Waiting to get a tire repaired no pay waiting to get your reefer trailer repaired no pay. This needs to be addressed. Truck Drivers are using a clock to decide when they can drive or not drive. They should also be using a clock to dictate how the driver is compensated. It's wrong to cheat the truck drivers out of their money. One more thing. If they tell you the miles paid from Salem Oregon to Montgomery Alabama is 2500 miles. The miles you actually drive is 2800 miles. You get cheated about 300 miles for every trip from the west coast to the east coast. How is that legal. It's theft is what it is. Highway Robbery.

      It's actually both their faults, as a trucking company you are just as much beholden to the laws and regs as the drivers, should never be coercing your driver's to do anything illegal.

      @@pedrogonzales4151 You as a driver should know what to do Pedro. You do what is right. If you break down & give in to the shenanigan's, you are going to be held responsible. Remember you cheat once & get away with it, you will cheat again. If you are serious & want to put an end to it, Start with your company's Safety Director. Every company I have ever worked for has a Safety Director, & he/she was just hated by the Driver Managers because he was constantly on their butts about pushing the drivers out of their HOS. When they force dispatch you on something that you cannot legally do, call them on it. If they tell you that you don't have a choice, you tell them yes you do. They threaten to fire you, don't even talk to them any longer. Once they tell you that, You tell them you aren't driving any further & will have their truck & freight towed to a safe storage facility & impounded until you receive your last check. If you do not act, one way or another, when something does happen, you as the driver has the ultimate responsibility & will be held & charged just like this truck driver in this post. Pedro, you as a truck driver are micro-managed by a Driver Manager who is the same person as your Dispatcher. He knows who you are, what truck you are driving, he knows your HOS because your information is directly in front of him on his computer. Pedro, there are recording devices on your truck, that track & record it's every move. It is recording all your engine dynamics like speed, rpm, when you brake is it a hard brake or a soft brake which is recorded by the pressure on the brake pedal. They know when you are stopped & moving, & thru computer GPS, they know where you are, with in a few inches of acracy. There are Dash Cams, there are the ELD's, there is the truck manufacturer computer. In a fatal accident, they are going to look at everything & they are going to pull up & look at the recorded history of that truck & the actual driving history of the driver on the ELD. That's what these things are in the truck for. To protect you as a driver, & also to protect the company if the driver has been falsifying his/her driving hours. If you are out of HOS & get into an accident where someone is injured or killed, your company is going to put as much space between you & them as they can. Remember Pedro, You are the Captain of the ship. Don't be afraid to jump ship, some of the carriers out their are not so nice. Find you a company where they allow you to drive legal.

      @@pedrogonzales4151 YES Pedro. DOT does go into the companies. They are suppose to be checked for violations once a year. Also when the CSA Points which are Safety Points awarded to the driver and carrier whenever the driver gets a violation, ticket, or gets in an accident. Each company gets points when the drivers gets points, so the company 's points are a reflection of the Safety Scores of all the drivers. That scoring system is based on the best score you can have is "0" & the worse is "99". The "99" Points is where they will come in & shut you down. They will be poking around long before they reach that point.

      Artira was the name I used, but it’s a company out of Chicago with Ukrainians. There was even another company name on my truck decals that I can’t remember. But they have over 10 company names always switching.

    I am going to blame the FMCSA for the REDICULOUS regulations in place. The cost of living that is forcing these companies to cut corners and endanger their drivers and the lives of everyone on the roads who are completely oblivious to what is going on, thr companies for trying to make law breaking a company policy, and finally the drivers that allows them to be bullied by these companies to break the laws. The listed above are ALL at fault, and ALL should be paying for the accidents, not just the drivers.

    There is a whole lot of blame in this. The driver is to blame. The company is to blame. Driver should not have even worked for this company and definitely should have said GFY. Company was totally wrong and blatantly criminal negligence and should not be running trucks on our American roads. I hope the families of these families get a whole lot of money because that still won't be enough to pay for these disgraces to our industries stupidity that caused these lives.     Run a paper logbook alongside the E log, log it exactly as it goes, shut down when you should. Company doesn't like it? Wants to retaliate? Fires you? Fine. There's labor laws in the US and plenty of attorneys just chomping at the bit to sue them. Remember, apathy is a stepping stone.

      In a case like this, if the law has heard the driver accuse the company of wrong practices, especially in this situation, they should be government audited immediately. When they do that, their drivers logs are looked at the way they're policing them, the company that is.

    Never knew about falsifying logs until I leased with a foreign company!
    Told my dispatch I was taking my 34 he said no just call the number I gave you. Called and they gave me 11 more hours.. I was shocked !!!
    They had the delivery window so small that you had to falsify your logs, if you didn’t make the appt time they make you wait an additional day to get unloaded.
    Parked that truck and said F that !!

    I know there are many companies that are shady, and will try to get drivers to do things they shouldn't, but like they say, the driver is like a captain of a ship, use good judgement even though the company doesn't. Better to get fired for doing the right thing then killing someone or getting killed for doing the wrong thing.

    I had the same problem from a dispatcher when I was told to do that and I said I can't cause being in violation he told me that they would get me foe grand theft I said okay so I stopped at a scales told DOT avout what was told to me which I had it on a dispatcher buster.i let DOT heart that he told me to stay at the scales.so DOT went and closed them up and find them really bad and did a full audit and they could not pay the fines and lost there authority can never get it back.with that accident deal he had he should have that dropped or dropped down

    I drove for triton. They literally use that exact language about dropping off the co driver. Once your clock is burnt they then force you to drive another shift under the ghost drivers logs.

    Sounds like K&B Transportation out of South Sioux City Nebraska. They are the worst Ive ever worked for falsifying log books and have been reported to DOT many times, and on all truck drivers reviews

    My trainer taught me "sleeper berth" when you're getting loaded. Sleeper berth when you're strapping down/securing the load. Sleeper berth when you're tarping. Sleeper berth when you're unloading. Sleeper berth when you're folding your tarp. I quit at the end of my first week and just paid the $4000 for the training. I don't operate like that. When the responsibility is on your then you make the call and you make the call in your favor not theirs. When something happens you can bet everything you have that they're going to say "We never taught him that." and then it's all on you.

      Yeah, the driver trying to put all of the blame on the company is a bunch of BS. Yes the company shares some blame because they allowed it to happen, but ultimately he did this because he wanted to make money. He's just doing what everybody does when they get caught breaking the law and trying to pretend like it wasn't his fault.

    Coercion occurs when a motor carrier, shipper, receiver, or transportation intermediary threatens to withhold work from, take employment action against, or punish a driver for refusing to operate in violation of certain provisions of the Federal Motor Carrier Safety Regulations (FMCSRs), Hazardous Materials Regulations (HMRs) and the Federal Motor Carrier Commercial Regulations (FMCCRs). Coercion may be found to have taken place even if a violation has not occurred. An example of coercion is when a motor carrier terminates a driver for refusing to accept a load that would require the driver to violate the hours of service requirements. The following must have occurred in order for coercion to have existed:

    I've been fired several times for not running illegally. I even had a dispatcher lie on me to cover her own a$$. For running drivers illegal. This was before Electronic logs.

    First flatbed company I worked for fired me for refusing to falsify logs. Trainer falsified not only logs, all training documents. Started solo driving. Left me alone first 5 months. Then started stacking loads, didnt your trainer show you how. They want you to load & secure while in sleeper berth & or unload.
    When I told them no. They fired me. Filed a complaint with DOT. Never heard back from them.
    They always refused to fix the truck also. Forcing me to drive with no abs, no cruise control. Yea, I drove more carefully, till i was finally able to get them to fix it. Company shop manager, said that truck should have not been on the road. It had a temporary brake fix. I was like, no shit, tell that to my fleet manager & office manager. I logged in the dvir two times a day, pre & post. So had a log if I got a dot inspection. Went across the country & up & down the west coast. About 7k miles like that.
    Second company was better in that they did not want falsified logs. Though would not fix the truck.
    Finally took it to freightliner & told them fix it. I will pay for it. Told the company, if you refuse to reimburse me. My attorney will file a lawsuite for reimbursement. They decided to pay for the repairs.
    I have heard the same kind of stories from other drivers. Numerous companies.
    Trucking companies, despite all their saftey talk. Really do not give a shit about safety. They do not care if you as a driver gets killed, or anyone else. It is all about their profit & loss. If something does happen, they sure as hell will throw the driver under the bus.
    Both companies fucked me on the miles as well. Failed to reimburse, screw me for every penny the could.
    Recently got my own authority & first truck. I will never drive for a trucking company again. They are asshole dangerous desk driving sperm burpers!

    A 43 year driver here, no driver should allow him, or herself to drive illegally, this driver allowed himself to drive illegally, no driver should be running illegally anywhere, the company made me do it, the company didn't put a gun to your head to drivr illegally, you operated the truck, you willingly chosed to do something that was wrong, lf you knew the company was doing this, you should have reported it, you could have refused to drive, you deserve all the pain a possible lawsuit you're going to get.

      David, that's on you. I've been out here trucking for over 30 years. When you go through orientation is where you are going to find out how good a company you are fixing to start up with. First of all, look at yourself. What are you bringing to the table. How long you been driving? How many Safe Miles? I did over a million miles twice with 2 different companies over the 30 years. I stayed at one company as an over the road flat bed driver for over 11 years. What made me quit? They left me an over weight load, that they wanted delivered from WI to MI. They heard the scale in WI was closed for repairs, so they figured just run it 15,000 over gross, and nobody would care. I, the driver cared. I cared because if I got caught, I was paying the fine. I also heard that I didn't have a choice, I was taking the load. What they weren't counting on was me telling them to stick it where the sun don't shine. So much for flat bedding. They were a good company to run for before this crap. They had some new management people & were going through some growing pains. The 2nd company I still drive for but locally now. I did a million miles as an over the road driver in a brand new Pete they got for me. I got into it about a month after starting with them. I quit back in 2017 to go drive for my brother &work in the oil industry. Enough about me David, lets get back to picking on you. Remember when I told you that you should be able to pick a good or shady company out during orientation? Here's some pointers on doing just that, in fact lets do one better. Get the low down during the job interview, where they bring you in & loosen you up. They will be collecting your drivers record, & also do personal records check on you to see if you're in trouble with the law. They will also do a credit check on you. They will get the information from you, that they need for these things during the interview. That's where you ask them for a copy of their Drivers Handbook. A good company would be more than willing to give you a copy to look over while they are looking over you & your characteristics. Once they accept your application & you pass their employment physical and they agree to hire you as a driver than you get to go to be oriented to the company. This is where you find things in the Drivers Handbook are somewhat a little different than what they are telling you. You find this out by asking questions. What happens when I break down on the road? Will I get paid? Will you put me up in a Hotel until my truck gets fixed? What happens when I get shut down because of the economy, no freight? Will I be paid? How do you determine my miles for my pay? Is it Hub Miles or Household Movers Guide? Hub miles are actual miles that you actually drove with the truck & is what you shoot for. If they are not paying that, ask why not. Household Movers Guide pays out somewhere between 17% & 25% of the actual mileage be driven. I suppose the companies are looking for some type of a return on their investment by doing this. Ask them if you are paid empty (Deadhead) miles & also find out about Bobtail Pay. A good company will pay you your regular mileage rate when doing either. A bandit company won't pay you at all if you are not loaded. Ask them about trailer moves when you get back to your company. Do they pay you for spotting you own equipment around in your drop yards or are you expected to just do it& not get paid. What about weather delays where you are dispatched into problem areas. Are you paid for time waiting storms out? Also ask about customer delays at docks where the customer delays you, sometimes this can last for days. A good company would cover these costs. Some other issues to find out about are home time Vacation & Holiday Pay. These are just some of the things to look for and questions to ask. You didn't have to pay a penny for this information. You don't need a data base list to figure out a problematic carrier. Look up their DOT # & go look at their CSA Safety Sat Score. Learn how to read the reports & see all the violations & what they are doing about them.

    In many ways, it should be the fault of company and the driver, both are knowingly and willfully committing the acts; however, additional penalties should be forced upon the company because of their insisting and bullying to force drivers to drive illegally. I can say with how I have to deal the Amazon loads and they do not give truly enough safe travel time to accommodate drivers during long haul operations, I have had to drive in PC mode for extended periods to just so I am not late. Example, last year I was trying to get back to Washington State from Colorado and I was only given like 26 or so hours to get from a to b. Also, my truck had a top speed of 70mph. I would have been late if I took the right 10-hour break. Even when I was close couple hours left to get there with 6 hours left to appointment time, I stopped to try to take a 2hr rest, Amazon woke me up asking why I stopped moving even though I had plenty of time to get to the destination. Amazon Logistics does not care about the drivers; they do not dispatch loads correctly for team or single drivers. More often I see loads that SHOULD be team drives dispatched as single driver.

    He should have gotten it in writing they wanted him to false his logs! Shut Down got his 10 hours before going to the bunk call the Weight Station and let them know he was being forced to Drive!! And He will leave them The Truck. But he has to make sure he has it documented what he did and said at the Weight Station its against Federal Law to Force a Driver to Drive illegally. When he gets home SUE! The Truck Company

    Company I drove for (past tense) as a day tripper sent me on a run they knew damn well would have delays at the receiver. Coming home it was clear I was running out of hours. Safety Director was editing on the fly on the back end of the E-log system until I got parked. Thankfully, they're no longer in business.

    Yeah, there are some shady companies out there doing real crooked things, and yes, rates are low while other costs are up. The rules in place are foolish. Unfortunately, the way it’s seen, the driver is where the buck stops. If false logs are discovered by DOT, not only does it trigger an out of service order, but it can spawn criminal prosecution. If I have to cheat by having ghost drivers then I’m doing too much!

    Once you level your terminal you are in charge of everything that happens. If the company tell you to do something illegal and you do it then it is your at fault and responsible. If your company tell you to drive illegal then you should call the DOT or get a hold of the CHP or State Troopers. Don’t ruin your life by running illegal. Companies won’t suffer the consequence, and they will just replace you. This guy lost his job anyway. It’s better to lose your job for doing the right thing than to lose it and go to jail for ruining illegal.

    I used to run team loads for one company. When i started getting low on hours, i would pull in to truck stop and then log out. Go get new bills printed for dot then log back in to a fresh clock. IA to PA sleep at the dock

      Obviously the company should share some blame because they allowed this to happen. However, the truck driver doesn't have a right to sue anybody. He's the one who actually falsified his logs and he did it so that he could make money. Nobody forced him to do it, they just allowed him to.

      @@carlpeacock5517 The company allowed the falsification to happen. They likely even encouraged it and, it's quite possible that you can't work at that company unless you're willing to do this. However, the driver falsified his logs because he wanted to make money not because somebody held a gun to his head. I absolutely think that the real victims should sue the company as well as the driver but I don't think the driver is a victim here. The driver is a co-defendant.

    Marten transport was alway telling me to falsify my logs when I worked for them and when I called the safety department I was to to do it or they would fire me and black ball me witch they did . They fired me and put a lot of bad things on my DAC and when I tried to get it removed DAC told me that Marten transport was there boss

      1. There are exact steps to take to challenge DAC reports, some are time sensitive.
      2. DAC doesn't answer to Marten.
      They must type what their told.
      You still have a right to challenge it.
      But follow the steps, even if late.
      3. Make sure to post on Reviews about Marten on their Google and everywhere else you could.
      Make it a quest

    I worked for a couple different companies that made me do things I didn't want to. First company had me use PC to falsify my logs when the day got messed up. It would look like I started my day at noon when I really started at 8am.
    Another company wanted to chase the money so when we need to make deliveries on time and need 1-4 more hrs of drive time or start the day early with only 4 hrs of sleep, call this number and tell them you need more time. They would doctor up the log book to make it look legit. I knew it was wrong but if I wanted a job I had to do it. Not proud.

    My answer when I've had dispatchers that have tried to get me to break HOS Rules and falsify a log has always been No i absolutely will not do that my license my my logbook and my livelihood and that has always put them in their place and for the one's that kept insisting i do what they say then my response is well i can always call the DOT and then you'll be getting a phone call that your not going to like and that usually the end of that.
    I've never been further harassed or fired for holding my ground.

    Most people who work for these companies that falsify logs are pushed there for a reason…me personally I worked for a company like that for 2 years just because when I first got my cdl a mega carrier screwed my DAC so bad no one else would hire me. And no I’m not a bad driver

    If you ask me both parties are responsible. But I would give more responsibility to the driver. No one can make you do anything unless you allow it.. if you are willing to read the rewards of running illegally you need to be willing to accept the consequences if your caught.     One of the trucking company I worked for had the computer rigged so you could move the truck a mile before it would put you on line 4. They always wanted me to move my truck to the loading dock and unload while on break.

    A lot of people dont understand that even if its changed or edited, it still leaves an electronic trail. Ive been inspected before after my eld had to be fixed and i ran paper for 2 days. Tied me up for 2 almost 3 hrs while they contacted the provider. Wether you know it or not, you might not be able to log in but that computer still tracks every movement of the truck. So they had me wait while they got everything emailed and put it up against my paper for those 2 days. Everything checked out but i honestly didnt know about that until they explained it.

    Bro CTS NATIONAL a third party for sherwin Williams will go in your logs and change them with you not knowing and will certify them like you did it. No company should be allowed to go certify or change your logs without your permission.
