      Can't even get the federal minimum wage out of them so maybe it is time to simply play them back in court for their illicit practices human labor trafficking. Commercial license are unconstitutional and the tax charging politicians need sued for their misclassification of unemployed individuals that do not match the definition of the words commercial nor commerce to be holding nor training for such a license without commercial employment of the federal minimum wage or commercial ownership of a business. To meet commercial standard a person must be being compensated the federal minimum wage. The feds called it the minimum wage because it is not the option wage which is why all license and training claiming to be commercial should be shut down and sued for the federal minimum wage to meet the minimum definition of commercial and commerce trading rather than only meeting the definition of slave driving and human labor trafficking. The lawyers could even help the unemployed license holders become commercial by suing the human labor traffickers failing to meet the compensation of the federal minimum wage out of their business and off their property as the unemployed individuals will become the new owners while the human labor traffickers will be in jail for compensating less than the federal minimum wage for peoples time.

    DOT and FMCSA will send undercover people to investigate. Report them. One company I worked for had that happen and they got shut down. It was an "interesting" time there.

      Liked this comment. Also because sometimes “extra money” is exactly the reason these guys are in this situation. A better course would be to have found a better employer who will pay you your worth. A shift in trucking will happen soon, but I feel bad these folks had to take it on the chin before it got better. The “extra money” cost more in the end.

    The driver is in a tough situation. We know snitches get stitches, but he needs an attorney that can help him get his record cleared, exsponged or whatever to be able to move to an employer that appreciates him. That may involve getting in contact with the Department of Transportation Office if the Inspector General to clear his record and exposing the company to get compensated. The OIG is where Whistleblowers get heard and paid.

      The fact that he is on record, on camera, admitting fault there's really nothing that can be done. A driver must have proof of coercion like text messages or recorded phone calls before they will investigate. I've been through this in the past and that's what I was told by the DOT. If a driver is constantly breaking the hos and not reporting it then the officers look at that as complacency.

      Nothing a lawyer can do. He knew what he was doing AND admitted it. Zero chance, should’ve got out before he dug his own grave. His best bet is to record and save all evidence of his company forcing him to do these illegal stuff and sue the company.

    If that driver gets fired from that job all they have to do is keep a copy of everything. He's doing and presented to United States DOT and there will go to these companies and they will check them out the driver should get paid more money. Due to he has to take a risk of doing it but it comes down to it. He has the right to say no I cannot move the vehicle. I'm done i'm going to sleep i'm going to get my ten hour break

    Almost 30 years ago, the "safety director"/ dispatcher of a company I worked for threatened me if I didn't falsify my logs......I cleaned out my truck and quit on the spot.

    I started at Covenant transport 20 years ago, and the trainer insisted I run two logs. Covenant made me run illegally for 6 months before I quit and jumped to my current company.

    All HOS should be paid; widespread cheating would reduce 90%.
    Abolish the PAY-BY-MILE SYSTEM, PERCENTAGE SYSTEM, Pay by Load SYSTEM, FLAT RATE SYSTEM and widespread cheating would be reduced by 90%.
    There should be expensive consequences to Carriers and Drivers who cheat with a Pay by Hour System.

      The pay by hour system doesn't really work for regional or otr drivers. There's too many drivers that will set on the clock when they don't have to or shouldn't be. Like getting fuel and being on duty for an hour.

      @@Brett235 The PAY BY HOUR SYSTEM would "weed out the clock milkers" retaining more drivers being paid for all HOS.
      It's up to the truck owners to fire/let go "clock milkers."
      Owner Operators should be paid by a premium for all HOS as well. For instance: the time it takes to drive from Bangor, ME to San Diego, Californication is already in the system. Proof is the call or notification you get when you're running late.
      My contention is Drivers are not being paid on a widespread basis for all HOS.
      Some people (the Carriers and office WEASELS) claim the PAY-BY-MILE SYSTEM keeps costs down. Does it keep Safety up ?

    From 2006 to 2011 often, because I quit twice and went back to them. I drove for Knight transportation out of Kansas City. Almost like clockwork every 2 1/2 to 3 months or so after I’ve been driving all day they would give me an option to either go pick up a load and run all night or “ I maybe sitting for two or three days till I get another load“ like a dumb ass I would go ahead and run. I never got caught. The first couple years was paper logs After that it was electronic logs and they had to do the modifying. I don’t have any proof of what I’m saying just my word. After I left them I became an owner operator. I can’t tell you how happy I was to hear them be so strict on following the rules as far as everything went especially hours. I was an owner operator there for eight years. Bought four houses and one duplex. I’m done with trucking now. I got in and got out. Thank God no one got hurt. And I got out alive. No thanks to knight Transportation. Those bastards put my back against the wall. Financially hindsight I never should’ve done it but I did. It’s far as this driver I’m sure they got his back against the wall too.☮️🇺🇸

    These companies hiring drivers and then making them run illegally need to be prosecuted and shut down, the driver tossing himself under the bus and basically taking the hit for the company, cause the company probably said "we didn't tell him to do that " I agree with a few others get a lawyer and rack this company under the coals, if he has elogs they are controlled by the company and they are changing their logs, trust a good IT specialist can chase it to the computer that done the changes, just like your previous one where he was filming it and they changed it, there's a trail out there

    There are definitely companies out there that will hire him, all he has to do is go out there and look for them. Then he should call them after applying and explain the situation and tell them he doesn't want to run illegally, but if he doesn't he will lose his home and things like that at this point is life. Good trucking companies. Really appreciate honesty and a lot. Will give you a chance if you're willing to do things the right way.

    Take a picture on your camera showing the messages on the screen. Then, if they retaliate, you got proof as to why. But, in the end, it is the drivers responsibility to say no. If they persist, take a picture of the messages. In the end, if you get caught, YOU will pay-not the company.

    When I was a new driver I contacted my dispatcher and let him know I was out of hrs. He said “how did that happen? Didn’t the senior drivers teach you how to cheat? Just tear out two pages and pretend you had 2 days off. Keep going because I have 40 loads on my desk”. Being young and in need of money I did it. That’s back when I was waiting in line 45 hrs a week and getting paid nothing for waiting.

    Walk away from them it's not worth your CDL or your life. Since your alone with very lil overhead just look for a company to hire you. There will be a company that will work with your record.

      The only thing the ELD does is make drivers run faster and harder to try to make the same amount of money and the hours allowed on the eld’s before they have to shut down. It’s not safer it’s actually a lot less safe but that’s how the government wants it.

    I love driving my 68 mph truck for a company that is 100% debt free and has great shippers and receivers. The most stress in my day is dealing with rookies who jump into fast trucks and think they own the road.
    I have 32 years OTR with one speeding ticket i received in 2000, and one accident ruled non preventable, I could get a job driving for any company i want, i chose a solid company that i don't have to worry about being paid or violating laws at their insistence all while i protect my CDL and more importantly, my life, as well as those Ishare the road with.

    I make more money as a Professional Driver then when I was a Freight Conductor. Many Freight Conductors work 6 days a week on-call. 2 hour call to work and the 1 day off isn’t guaranteed for a Freight Conductor. I work 5 days a week and know when I’m going to work. I made a $100k last year as a Driver and never broke $85k as a freight conductor.
    Running over your hours or editing the clock because you need to provide for your family is your fault. People use “family” and “putting food on the table” to make it sound better. He should have managed his money better and told his family “no we can’t afford this or that”. Over running the clock or editing the clock is hustling backwards, selfish, unhealthy and a good way to work yourself and your coworkers out of a job because your actually doing two people’s jobs. Sometimes 3 people’s jobs.

    He hired on knowing he has to lie then he was honest and put him self in this situation. I understand the driver, but he is responsible for his own license he through himself and the company under the bus. If he wanted to be honest he shouldn't have started working for that company.

    I was once told by dispatch to do something unsafe I smple said to dispatch that they were about 800 miles away and that was my decision. Also as told by upper mgmt. I was the captain of the ship. I think that there wasn't really anything they could do because they aren't going to go to the DOT and say this guy won't run illegal. Now that logs are computerized and they can reset them adds to the equation, I was running paper logs at the time. In hindsight, (which is always 20/20) going down that path to begin with was his mistake. My best to all stuck in that situation.

    I had a company from IL tell me they charge the driver 60 a week for logs so if the driver wanted to run extra miles they could, however, the driver was being paid by the load not the mile. I stopped all communication with them. Red flag after red flag

    Unfortunately, you’re going to have to run for less or not at all.
    Expect to drive just to sustain yourself at your current company and hope they don’t fire you or, you get a different job for a while until your score improves. High reward comes with high risk and sometimes the risk wasn’t worth the reward.

    From my understanding, this poor guy was a victim of spousal abuse. The significant other demanded this driver to cough up money or else. This relationship forced the driver to make another dumb decision by working for a corrupt company and now the driver is paying the price. There are companies that'd look into hiring this driver but a lot of companies don't want their CSA score dragged down by a multiple offender. You hold a CDL which means you are fully aware of the rules and regulations you obide by. There's no real easy out of this one while trying to remain in the game.

    When you dance with the devil the devil will choose the tune. That sucks. I have been in this industry for 20 years and there are a lot of traps in the business. Things that will lure you into thinking there is an easier way to ... whatever. It isn't and you will get chewed up and spit out like everyone else. The only way out is the long hard path of going honest and taking all of those licks that you thought you were skipping. Sometimes that path is years long. All points fall off after 10 years. I am another tired trucker that can't figure out how to leave this business.

    I shut a company out of Kansas down for this very thing... they weren't up front about it and the safety director was doing it at the original owners son's direction, but Frank didn't need any help being corrupt.

    You always have to evaluate risk to reward when making life decisions. If you knew before hand there is no excuse. So when you get caught and lose your license or ability to get jobs, that's all on you. There is multiple things people can do to make ends meet, just simply budgeting my money, sacrificing the things I want over the needs of my family has made a huge difference for me. Being greedy wanting all you can get right now always ends in failure.

    I drove when paper logs were the only logs available. I don't know how it is now, but back in the day, I know a lot of drivers kept two or three different logbooks. It was unsafe and dangerous then. It is now as well. Tired driving kills people. Please folk, take your rest and for all of humanity, please don't drink and drive.

    I have videos of companies changing my logs an adding ghost drivers in my truck as well. The best thing you can is stay away from companies that promises you all the miles you can handle such as 1000 deliver the next day. Always remember that you are expendable and they will just keep hiring new drivers who are not intelligent enough to realize that protecting their license is far more important than making a few hundred dollars more.

    This is a msg to all CLD drivers. Don’t put your license in jeopardy. There’s plenty of legitimate companies out there. If you are being told you have to do something you aren’t. If something bad happens it’s on you and could land you in prison. Good luck to you. Maybe time out of the industry might be your only option at this point. Points will fall off and maybe some companies may give you a second chance at some point.

    We all make mistakes, some are severe and some are not but what you need to do is find a legit company to work for and seeing you’re single drive as hard as you can, but within the laws, save every cent, you can, and then look at going in the business for yourself And that means buying a truck and trailer and getting your own authority. If you just buy a truck and go in and lease to a company you’re still under their control it’ll take a couple years but you’ll get there.

    I said what I had to say in yesterday's post, but I will say this driver is going to get exactly what he deserves and hopefully God willing nobody else is involved when it does happen and it will! I have been trucking for over 35 years and have always been able to provide for my family and then some doing it legally! I realized a long time ago that I'm no good to anybody if I'm in jail or dead!

      True though. As captain of the ship, he has all the responsibility for everything that happens. When something bad happens it will all fall on him. Because he made the choice. Report them and get out now! Don't take that chance. 42 year driver here, just my 2 cents

    I really think he needs to get a attorney asap who is specialized in this type of driving for truck drivers. The issue is that once people tell you to lie they may ask you to do other things illegally.

      Attorneys aren't easy to get in contact with. They have these stupid in-between people who take your information and then send it to whichever lawyers will take the case. Waiting 2 weeks to reach a specific lawyer and hoping he knows the trucking laws. And you have to be able to afford him. I am going through this right now.

    This happens a lot with companies that force the driver to drive with the wrong book and they do it themselves, but they forget that scales cross and when they stop the driver and they check the book, the officer can realize that the book is there. evil

    If trucking companies would pay their drivers a decent living wage they would not have to falsify their logs but these companies turn the trucks down to 62 miles per hour the federal government only let you drive 11 hours in A-day... This is not the land of the free !

    i use to never run a logbook.
    it was cheaper to get caught without one than get caught with one than one falsified orhave multiple logbooks

    Do points expire over time? Aren't there certain jobs which don't have logs, or have a set schedule? If I found it too stressful, I would pull my horns in, and get a smaller, safer position. Maybe it would only be a certain time, to let points expire. Maybe Bud Light is hard up for drivers.

      The violations he received are called safety violations and those points double or triple depending on the violation. Safety violations take two years to completely fall of. It's so much every month if I'm not mistaken, and that's if you don't get caught again.

    Things can always get worse for you if you keep running illegally. If I were you I would only drive legit from now on and try to find another company. It is my understanding that your CSA points decrease every year until year 3 when they zero out again. If you can't find another company to hire you because of high CSA score, maybe find a local non CDL job until your points decrease.

    I'm just parted ways with a company like this & that company wasn't upfront about it...I did get pulled in equipment that got points on a stop by dot maybe I got out of there before things get like this video

    I'm no expert, just a driver. The biggest problem with trucking is that there are different systems of which drivers can get paid. People cite weekly pay that is not conducive for drivers who are company and drive 8-10 hours a day governed at 60-65 mph. 450-550 miles is more than enough for daily driving. You can get that at most mega carriers. The pay to expect 700-900 if you are taking strait cpm. $1050-1250/week if it's cpm plus performance bonuses, detention, breakdown and layover pay. That's the REAL DEAL and you will be good with dot as long as you're minding your hos and pretrips.
    All this other talk of 1600, 1750, 2000, 3000 per week is bullshyt. That's owner operators, special circumstances or guys leasing with 5+ years at the same spot. Or a company guy with a few 600+ days in there.

    All he he’d to do is follow the law. Don’t answer their calls. Deliver the load legally and return the equipment to the terminal and quit. This is common sense. It not that difficult of a decision.

    What is the name of that company so I can go work for them. Sender is ungrateful, Company was up front with you and you ACCEPTED it. They even coach you and you still rat 🐀. They should fire you and let you get a reality check cause it’s tough out here for us regular folks to find a company that will feed you money as much as you are willing to do the work.

    I left an oilfield company in Huntsville tx, because of all this illegal logs and everything else! All their drivers run illegal 20+ hours a day!! Not to mention owners of company still steal $ from all drivers! It seems some companies always get away with breaking law, and when caught they blame drivers!! I refuse to run illegal for anyone. It’s not worth ruining your license. Drive legally drivers!!

    There are larger companies out here that will talk you into working over your hours. That way you can both make money. If you don’t the pay gets worse and the miles go down. That is their lease purchase drivers. So it’s not just the small companies, the one I’m taking about I’ll not say their name but they have three terminals, one on the east coast, one in the southern part of the Midwest and the last is in the west. Another has one terminal in the Midwest but we’re just bought out about a year and half ago.

    You have to approve the log changes, it doesn't automatically convert
