I don't have a problem with no having license or registration but I DO have an issue when someone doesn't have insurance! I had my new car totaled by an unlicensed, no insurance driver and it cost me a deductible ($500)even though I didn't do anything wrong and was sitting still at a stoplight. Doesn't seem quite fair does it???

I live on my family's 6000 acre farm and drive everything from from grain trucks, tractors, to 4 weelers and semi's. Havn't had a license since 1989 and had several stops by law enforcement and as long as I stay on the travels between fields I am left alone.
I have a friend in Kansas who has done this for twenty years, after he won in court they are always instructed to let him go because he knows his rights and the law

I see now, IF, he was on private property, they have no business there. However, if he was on a public roadway, lack of registration IS probable cause for the stop. Driving without a license is an arrestable offense as the officer can be held liable for any damage or injuries he may cause if they allow him to continue. They can't just leave the vehicle on the right of way. It has to be towed or he can use them for leaving it to be burglarized. Traveling TO his private property cannot be done legally on a public roadway. There's more to consider than what he's showing us.

Yet for an example a friend of mine did have there car brake down on the highway, they were broke and could not afford to get the alternator at the moment. Long story short the car ended up staying there for over a week. After a lil more then a week he had the money and bought the alternator. I ended up taking him there to put it in and get it out of there. When we get there there were two business cards. One from the state police and one from a towing company. With a note on the back saying that they understand the car most likely broke down but they would really like to remove it from the side of the road and that the tow company was willing to tow the car to wherever needed and would just give him a bill if he did not have the money at the time...Now if this car did not have private plates on it and instead had the states public plates on it the car would have been gone and put into the impound the day it broke down...

There is no paperwork in Florida that says you can drive without a drivers license and registration. Florida law is crystal clear all motor vehicles are required to have a registration when driven on public roads.

And they still towed my vehicle cause they claimed it's protocol. They also took 2 legal firearms without cause and searched my vehicle for no reason just looking for something without my consent and found nothing. If you currently have a DL you have to notify the DMV that you are returning your license in good order and make sure you let them know it is not to be suspended and you want a receipt to reflect that. I was stopped by Tulsa Police. The first thing I asked "Was I speeding?". I was driving a wheelchair which would only go 5 mph and had a 100 pound lab (Service Dog) running beside me. They said I was banned from the store property and I knew it. I informed them that they had the wrong person. They told me to get off the property and not come back. I started home with them watching. I went part way home and turned around. As I went by them I waved and went into the store. The police were stunned and just watched me go by. I told the manager what had happened and he said you don't look anything like that woman. I was friends with the manager. He couldn't believe they stopped me.

Yes he is in the State of Florida to operate a motor vehicle you're required to have a driver's license and liability insurance if you're a passenger you have the right to travel. By boat by bus by air by horse by carriage but not by driving anything more than 49cc. On the public roadways this protects the public and yourself.

One of our biggest problems is the people that pull us over for not having the right stickers and licenses get paid by the money people pay for stickers and licenses.

Dude, roll all windows up and only crack the drivers side 2 inches, just enough room for them to correspond with you and get your credentials. The reason is that, they can say that they smell weed in the vehicle because of the cross wind, and make sure that your doors are locked, that way they can't just open the door without your permission and snatch you out. Don't know if your vehicle has this feature but, if you have keyless entry, you can leave the keys in the car and roll the window up to prevent unlawful search and seizure, most Ford vehicles come standard with this, you use your fingerprints and numeric code to get into the vehicle without keys in case you lock your keys in the car.

In Canada with that if you’ve never had a license, they give you a temporary license number and suspend your license. It’s literally a slap on the wrist because there’s really no license to suspend. At most it’s a $1000 fine but I’ve been there no insurance no license with a car that’s in my name

I see now, IF, he was on private property, they have no business there. However, if he was on a public roadway, lack of registration IS probable cause for the stop. Driving without a license is an arrestable offense as the officer can be held liable for any damage or injuries he may cause if they allow him to continue. They can't just leave the vehicle on the right of way. It has to be towed or he can use them for leaving it to be burglarized. Traveling TO his private property cannot be done legally on a public roadway. There's more to consider than what he's showing us.

No i myself of anyone i know has not ever parked there car in the middle of the road. Yet for an example a friend of mine did have there car brake down on the highway, they were broke and could not afford to get the alternator at the moment. Long story short the car ended up staying there for over a week. After a lil more then a week he had the money and bought the alternator. I ended up taking him there to put it in and get it out of there. When we get there there were two business cards. One from the state police and one from a towing company. With a note on the back saying that they understand the car most likely broke down but they would really like to remove it from the side of the road and that the tow company was willing to tow the car to wherever needed and would just give him a bill if he did not have the money at the time...Now if this car did not have private plates on it and instead had the states public plates on it the car would have been gone and put into the impound the day it broke down...

There is no paperwork in Florida that says you can drive without a drivers license and registration. Florida law is crystal clear all motor vehicles are required to have a registration when driven on public roads.

Can someone tell me more cause I got towed today for not having license but I told them I wasn't doing commerce. And I stated shuttlesworth vs Birmingham and Murdock vs Pennsylvania. And they still towed my vehicle cause they claimed it's protocol. They also took 2 legal firearms without cause and searched my vehicle for no reason just looking for something without my consent and found nothing. Cops can not pull you over or tow your car . If you currently have a DL you have to notify the DMV that you are returning your license in good order and make sure you let them know it is not to be suspended and you want a receipt to reflect that. They said I was banned from the store property and I knew it. I informed them that they had the wrong person. They told me to get off the property and not come back. I started home with them watching. I went part way home and turned around. As I went by them I waved and went into the store. The police were stunned and just watched me go by. I told the manager what had happened and he said you don't look anything like that woman. I was friends with the manager. He couldn't believe they stopped me.

Yes he is in the State of Florida to operate a motor vehicle you're required to have a driver's license and liability insurance if you're a passenger you have the right to travel. By boat by bus by air by horse by carriage but not by driving anything more than 49cc. On the public roadways this protects the public and yourself.

I was allowed to drive away freely when I did this here in Iowa. The cop actually WAS familiar with the Federal law meaning US Federal Common Law.

Don't know if your vehicle has this feature but, if you have keyless entry, you can leave the keys in the car and roll the window up to prevent unlawful search and seizure, most Ford vehicles come standard with this, you use your fingerprints and numeric code to get into the vehicle without keys in case you lock your keys in the car.

As stated in 16 C.J.S., Constitutional Law, § 202, p. 987:
"Personal liberty, or the right to the enjoyment of life and liberty, is one of the fundamental or natural rights, which has been protected by its inclusion as a guaranty in the various constitutions, which is not derived from, or dependent on, the federal Constitution, and which may not be submitted to a vote and may not depend on the outcome of an election. It is one of the most sacred and valuable rights; as sacred as the right of private property; or as occupying a preferred position as contrasted with property rights; and is regarded as inalienable."
This concept is further amplified in 11 Am.Jur., Constitutional Law, § 329, p. 1135 wherein it is said:
"Personal liberty largely consists of the right of locomotion -to go where and when one pleases - only so far restrained as the rights of others may make it necessary for the welfare of all other citizens. The right of a citizen to travel upon the public highways and to transport his property thereon, by horse drawn carriage, wagon, or automobile, is not a mere privilege which may be permitted or prohibited at will, but a common right which he has under his right to life, liberty, and the pursuit of happiness. Under this constitutional guaranty one may, therefore, under normal conditions, travel at his inclination along the public highways or in public places, and while conducting himself in an orderly and decent manner, neither interfering with nor disturbing another's rights, he will be protected, not only in his person, but in his safe conduct."

In Barbour v. Walker, 126 Okla. 227, 259 Pac. 552, 56 A.L.R. 1049, 1053, the distinction between the right of a citizen to use the public highways for private, rather than commercial purposes is recognized:
"In Ex parte Dickey (Dickey v. Davis) 76 W.Va. 576, L.R.A. 1915 F, 840, P.U.R. 1915 E, 93, 85 S.E. 781, we find this apt expression of the court: 'The right of a citizen to travel upon the highway and transport his property thereon, in the ordinary course of life and business, differs radically and obviously [[Orig. Op. Page 11]] from that of one who makes the highway his place of business and uses it for private gain, in the running of a stagecoach or omnibus. The former is the usual and ordinary right of a citizen, a common right, a right common to all, while the latter is special, unusual and extraordinary. As to the former, the extent of legislative power is that of regulation; but, as to the latter, its power is broader, the right may be wholly denied, or it may be permitted to some and denied to others, because of its extraordinary nature. This distinction, elementary and fundamental in character, is recognized by all the authorities:…"

In Canada with that if you’ve never had a license, they give you a temporary license number and suspend your license. It’s literally a slap on the wrist because there’s really no license to suspend. At most it’s a $1000 fine but I’ve been there no insurance no license with a car that’s in my name

I've heard we are foolish and once we apply for a DL and Registration we basically put ourselves into the whole "contact for taxes due". And if you take it all back and say you want out they have to abide. I don't know anyone with the balls that's done it. And no way in hell they'd let me do it. I went from no tickets in 35 years to habitual driving affender in 3 months time due to todays crooked law practices. Love the USA go Brandon.
