    “Police officers in Southaven, Mississippi, this week fatally shot a man who had no active warrants because they mistook his house for the house of a suspect.
    Local news station WMC Action News 5 reports that Southaven police on Monday killed resident Ismael Lopez on Monday evening after arriving at his house in an attempt to serve an arrest warrant for a man named Samuel Pearman, whose house was located about a dozen yards away from Lopez’s.
    Lopez’s wife, Claudia Linares, tells Action News 5 that she and her husband were sleeping when they were awakened by commotion outside. Her husband went up to investigate the noise first, and Linares says that by the time she got up to join him, he had already been shot by police and was lying dead on the floor.
    Attorney Murray Wells, who is representing Lopez’s family, says that “bullet holes suggest [police] shot through the door” of Lopez’s house.
    Police claim that Lopez opened the door and pointed a gun at them, and that they only shot him after repeatedly asking him to drop his weapon. However, some neighbors are disputing the officers’ account.”

    Funny how police can make many mistakes, bad judgement calls and are still given the benefit of the doubt. Meanwhile, when you get woken up out of a sound sleep - you are expected to make every decision perfectly.

    Let me guess... There is not one body camera or any dash camera that captured this "incident". This is what kills me about Law Enforcement a profession I've been in for almost 10yrs now. The level of unaccountably with Local Law Enforcement is criminal. Notice this just doesn't happen on the Federal side (which I am). Its literally beating into us at the FLETC (Federal Law Enforcement Training Center) that before we engage anyone we had better establish reasonable suspicion and probable cause before putting cuffs on. Because we know a 4th Amendment violation is a career killer.
    I've said this before and I'm glad Ana picked up on it. When ever I served a warrant there were two agents tasked with location verification. One says this is the house and the other verifies. Why? If we get it wrong not only will the agency be sued but, we as individuals can be sued as well. All the more reason to get it right. Cenk is right on the money. When you allow cops to get away with these actions simply because, you have a bias against the victim/assailant. You have not only authorized this action, you have also given them legal precedence to do it to anyone and everyone.

    This is why I'm more anti-cop than not. Not because they killed an innocent man, but because they are trying to cover it up. Like they are above the law. Like justice and truth is not as important as covering their own terrible mistakes.

      stylz1 I mean it is and isn't a cop thing. It's human weakness. Covering up a failure to avoid punishment, and abusing authority to do it. We see that in damn near every institution. Just in the institution of policing it can have immediate, fatal consequences. Poorly vetted, and trained police.

      Well said my friend. I understand that 100%. I was giving the cop the benefit of the doubt. As you put, "it's a human weakness" Another human weakness is not being perfect. Making mistakes. It happens and always will happen. In my opinion, poor training doesn't make a bad cop with terrible moral character. Covering up a lie, cheating justice, not manning up... Those are the characteristics I don't want in a police officer and as a secret code of conduct. Training can be fixed. Humans who aren't cops don't swear an oath. Don't live by the same code as those who do. Yes it is a human weakness. Doesn't mean we should not strive for better. Not enforce living by a better code.

    Welp just another day in the neighborhood. This happens all the time. I remember a couple years ago, they killed a 7 year old kid because they kicked in the wrong door and invaded the wrong house.

      Michael Kyle - problem is, very few are sensible on either side now. Politics has become even more corrupt with the influx of big money in the system and there is such little work across the aisle that's actually beneficial these days. Sad.

    Sooo, maybe people who answer their door due to a disturbance in the middle of the night should just start shooting first and ask questions later? I mean if its a criminal with a gun they will shoot you and if its a police officer with a gun, they are just going to shoot you, so might as well go down fighting, right? I mean seriously, the guy had NO criminal history, so in what universe would he fail to follow the orders of the police officers UNLESS they failed to identify themselves? At the very least the Cops should be charged with negligent manslaughter, but not with our multi-tiered justice system right!

      Because the cops like to catch the criminals when they are asleep. They think there is less chance of confrontation and violence that way. I learned this when in 2011 the US Marshals came in to my home through a window got me out of bed cuffed me and qusesioned me about a fugitive they were hunting that was allegedly staying there per information I later learned they were falsely given my address. I did not know the person they were looking for. They never showed ID till the end of the incident. My home was searched with no warrent shown. I bearly got an apology from their supervisor and they never paid for the damages to my window. I know why I am distrusting of law enforcement in some situations and dont blame others. If had access to my pistol that night I probably would have been shot, I realy thought it was a home invasion at first.

    This is my home town. And I honestly had a feeling this was coming. I have heard many stories about cops in our county doing awful things. Strip searching females on the side of the rode in the back of a police vehicle is only one example. We shouldn't live in fear of the ppl there to protect us.

    As a CCL holder, if someone breaks into my house that's unidentified, that's a home invasion. It shows admirable and expected restraint that Lopez did not shoot the cops. The police seem to have executed this man with no regard for the law. There but for the grace ...

    Even if he did have a gun I thought it was America and you were allowed to have a gun to protect yourself?
    He was an innocent man with a gun protecting himself and family from random intruders at his home in the middle of the night.

    I experienced a similar scenario last year: cops come to my door in the early AM, long before the sun was up. We (my infant daughter, my 5 year old, my wife, and myself) were woken by the classic "cop knock." I don't live in the best area - we have had people murdered in recent years and a living facility for drug addicts and schizophrenics is just up the road, so our guard is always up. When you're suddenly woken up you're disoriented and confused, which is im sure what cops want when they apply these tactics. Seems high-risk to me; tactically there's nothing better than surprise, but it's also a great way to needlessly escalate a situation. Anyway, these cops were of course at the wrong house trying to serve a warrant just like the case in the video. They didn't apologize or anything and were hostile during my entire interaction with them. Thanks guys. I suppose I should count myself lucky I wasn't blown away.

    Just from the fact that shots were fired through the door before actual contact has been made amounts to murder at worst, manslaughter at the least. Discharging your weapon when you are in no eminent danger is a crime no matter who you are.

    As a society, we’ve allowed cops with this recklessness all because many cops believe-they can and will get away with no consequences.Our legal justice system that has given cops more immunity and a pass on their criminal behaviors. What needs to be done more is for cops to account for mistakes ma, such as no-knock warrants and 911 operators and dispatchers not giving more info to responding units in the field.

    These cases make me think that the conspiracy theorists had something right when they said martial law would rule. Every day there's another "shoot now, ask questions later" (and cover it up) kind of situation in the U.S. but not here in Canada. We had 2 of those last year. One where a mentally disturbed man had a block of kitchen knives and he was shot dead. The area was secured and nobody harmed and they didn't taze him or shoot him in the leg, they put a dozen in him. It made me feel like we were in Detroit for a minute.

    How did the police even get permission to serve this warrant after sundown? Warrants may not be served after sundown without an explicit request, specific reasons for that request (an immediate need is most common), and the magistrate has to approve it. Sooooo what even was their reason for that? In a residential area?
    This is exactly the reason why after-dark warrants are discouraged to begin with! Police can't see the numbers on the house.
