    REPUBLIC ACT 11573
    AN ACT IMPROVING THE CONFIRMATION PROCESS FOR IMPERFECT LAND TITLES, AMENDING FOR THE PURPOSE COMMONWEALTH ACT NO. 141, AS AMENDED, OTHERWISE KNOWN AS “THE PUBLIC LAND ACT,” AND PRESIDENTIAL DECREE NO. 1529, AS AMENDED, OTHERWISE KNOWN AS THE “PROPERTY REGISTRATION DECREE”
    SOME SALIENT POINTS:
    1. Any natural-born citizen of the Philippines who is not the owner of more than twelve (12) hectares of land, and who, for at least twenty (20) years prior to the filing of an application for agricultural free patent, has continuously occupied and cultivated, either personally or through a predecessor-in-interest, a tract or tracts of alienable and disposable agricultural public lands subject to disposition, and who shall have paid the real estate tax thereon shall be entitled, under the provisions of this Chapter, to have a free patent issued for such tract or tracts of such land not to exceed twelve (12( hectares.”
    2. All applications for agricultural free patents shall be filed before the Community Environment and Natural Resources Office (CENRO) of the Department of Environment and Natural Resources (DENR). For provinces with no CENRO, the application shall be filed with the Provincial Environment and Natural Resources Office (PENRO).
    3. The following-described citizens of the Philippines, occupying lands of the public domain or claiming to own any such lands or an interest therein, but whose titles have perfected or completed, may file a petition at any time, whether personally or through their duly authorized representatives, in the Regional Trial Court of the province where the land is located, for confirmation of their claims and the issuance of a certificate of title to land not exceeding twelve (12) hectares:
    “(a) Those who by themselves or through their predecessors-in-interest have been in open, continuous, exclusive, and notorious possession and occupation of alienable and disposable agricultural lands of the public domain, under a bona fide claim of ownership, for at least twenty (20) years immediately preceding the filing of the application for confirmation of title except when prevented by war or force majeure. They shall be conclusively presumed to have performed all the conditions essential to a Government grant and shall be entitled to a certificate of title under the provisions of this Chapter.
    “(b) Those who have acquired ownership of private lands or abandoned riverbeds by right of accession or accretion under the provision of existing laws; and
    “(c) Those who have acquired ownership of land in any other manner provided by law.”
    3. For purposes of judicial confirmation of imperfect titles filed under Presidential Decree No. 1529, a duly signed certification by a duly designated DENR geodetic engineer that the land is part of alienable and disposable agricultural lands of the public domain is sufficient proof that the land is alienable.

      Paano sir kung ang lupa ay may title decree na na issue noong1941 pero ang owner hindi nila natanggap ang titolo dahil nagka worldwar2, huming lang kami certification sa decree # nya at isa pang certification na nakasaad ang titolo nya nasunog/salvage na ang copy sa titolo sa LRA. Pwede ba sir na ang next step na pupunta kami sa RTC para ipa cancel ang decree para ma issuehan nang Pre patent na titolo sa DENR? Ang lugar namin kaci gnawang Pilot noong 1932 na may cadastral survey at nag start mag issue ng Decree titling sa 1938.

      Atty. tanong ko lng po kung paano mapa tituluhan yung lupa nmin, sa Camotes Island po ang lugar namin sakop ng Cebu Province, wla pa po kasing mga titulo ang mga lupa sa aming lugar. Itong lupa nmin po minana nmin sa aming mga namayapang mga magulang, hinatihati na nmin magkakapatid ipinasukat nmin sa surveyor at may sketch na po kami matapos nmin ipinasukat, pero yung kabuon lng ng lupa ang may sketch plan hindi bawat hati. Ang problema po Atty. iba ang sukat sa tax dec. malaki ang sa sketch plan maliit lng sa tax dec.paano po kaya Atty. ang aming gagawin? Sana po Atty. maabvisan mo ako, salamat po ako po si Magarito Tampus.

    For application of title on agricultural free patent, when you say, “continuously tilling the land yourself” kasama po ba doon kung may katulong o tenant ang may ari sa pag haklas ng niyog o copra at hindi nakatira ang may ari sa loob ng property?

    Hi Atty! questions lang po tungkol sa abandoned agricultural land. 30 years na po sinasaka at tinatamnan yung lupa pero wala po nagkiclaim na nagmamayari nito pero nakita po sa record ng Register of Deeds may mother title po na nakapangalan sa isang tao na hindi kakilala at hindi alam kung nasaan. Tanung ko lang po kung ano ang karapatan dito ng tenant at kung pwedi ito ipa Titulo ulit?

    Atty., ang Homestead Patent po ba ay pareho lang ng Agricultural Free Patent?
    May gusto po kase akong bilhin na 2 hectares na lote at nakasulat po kase sa title na Homestead ang Patent Type nya. Kailangan din po ba ng DAR clearance ng Homestead Patent? Maraming salamat po in advance sa inyong pagsagot.

    Hi Atty, napadpad po ako dito gawa ng case sa lote na nbili namin sa province, agriland po sya.. bnebenta ng apo ( lola nya ang naka name sa deed of sale) walang transfer na nangyari gang sa namatay na ang lola ,papa nya(bale share ng papa nya ang lote).
    Pwed po kaya yun mapatituluhan kahit na walang hawak na copy ng owners copy title yung apo? deed of sale lang na nakapangalan pa sa lola nya, at tax dec of real property.
    So base sa video nyo di na po eto qualified sa free patent kc nagbbyad na cla ng tax sa lupa.

    Ma'am pano po sa amin na case kasi ang lupa ng papa ko ay foreclose po tapos ang hawak lng namin ay name sa survey plan at yong mother cloa tawag don ay nawala na dw at d na nila alam kong sino ang talagang may hawak , gusto ko po sana na e process at ipa individual cloa o d ipa land title para din my hawak rin kaming katibayan.     hello atty, ask ko lang, may tax declaration lolo ko sa tuhod, pero walang TCT no. na kasama at walang title na nakikita, naka decree sya pero puro tax declaration lang.. pano po kaya proseso neto para magamit namin yung lupa? farm lot.

    atty question po, may gusto kaming bilhin na lote whlo lot po may titulo sya from 1st owner nakalagay free patent:

    hi po atty may katanongan lang po.. may kilala po kasi ako grupo o mga tao na ngbebenta ng lupa kung saan nkatirik ang up diliman.. particular ung kahabaan ng philcoa market at lupang bakante doon kung saan UP daw ang may ari.. ang grupo na eto ay may hawak na certified true copy at sila daw ang orihinal na may ari ng lupa na iyon.. katunayan eh nghahanap sila n mgsponsor upang mabayaran ung taxes at penalties nto.. may kausap silang judge at mga buyer para mabenta eto.. possible po ba eto? sna mapanagot ang mga sindikatong eto

    Need pa ba ng DAR clearance kung ang binibili mo ay 1000 sqm lang naman, at wala kang ibang agri land, kaya hindi ka naman lalampas ng 5 hectares? Mabibili moba ang agri land na naka rights lang, walang title?

    So ang judicial confirmation for Titling ay 20 yrs! n possession of an agricultural land or house in an agril land
    What if for example Wala n original owner deceased already at anak n lang at mga apo occupying the property so who will be the owner of that agriland and the houses or whatever in the property?

      Alienable and Disposable po ang lupa kung naka-classify po ito sa CENRO-DENR na pwedeng maging privately owned. Mag-inquire po kayo sa CENRO-DENR.

    magandang gabi attorney, nag-aahente po ako ng lupa at may nabenta kami ngunit hindi ibinigay lahat ng komisyon namin ng seller, maaari po ba na makuha namin yon kapag idudulog namin sa small claim court, sapat po ba doon ang katibayan sa conversation namin sa messenger at testimonya ng buyer? salamat po

      @@YourLawyer Good morning! atty. paanu po kung wala pang tax declaration? then yung lupa namin na kami po nakaposisyon for more than 25 years, meron po itong pastuhan ng baka, kambing at manok sa matagal na panahon hanggang ngayon naka bakud din po ito, ito then po ang kabuhayan ng father ko bago sya namatay at alam naman po iyon ng mga malalayo naming kamag anak dahil pumupunta po sila dyan saamin pag may family reunion. taz bigla po sumulpot yung kapatid ng mapayapa kung tatay inaangkin yung lupa samin taz pinatawag po si nanay sa DENR at hinahanapan ng documents, wala po kami maibigay ganun din po yung ng aangkin wala pong maibigay. taz sabi po ng nang aangkin na ante at pinsan ko ay ibigay daw po yung kalahati na lupa or mawawala daw po saamin yung lupa, mamili lang daw kami sa dalawa kung alin. May kapit daw po kasi sila sa DENR. Possible po ba yun? nangyari lang po ito past days. anu po kaya need namin gawin or sinu dapat ang kausapin namin ?

    Need pa ba ng DAR clearance kung ang binibili mo ay 1000 sqm lang naman, at wala kang ibang agri land, kaya hindi ka naman lalampas ng 5 hectares? Mabibili moba ang agri land na naka rights lang, walang title?
