Daily reminder to never take field sobriety tests. Only do what you're required to by law, which is the breath test AT THE PD. The portable breath test is not admissible.

This judge has BIGTIME substitute teacher vibes. It’s pretty cringey…I LOVE LOVE LOVE your pacing in the cross, Larry. You really give them time to sweat and stew in their own juices while you thoughtfully craft the next round of volleys. Very well done.

Obviously the officer lied about about the pbt results or he would have gladly said that on camera and if someone is twice the legal limit would they be able to walk in a line backwards, of course not

This county does not recognise the HGN eye test that the rest of the states and the National highway traffic and safety administration that every state has adopted but this special county has not had a hearing on it despite it being adopted everywhere else, how special is this county, they follow the same tests that the National highway traffic and safety administration the bible of Road Traffic Safety they rely on to ensure the safety of the public using the roads.

FST's are totally subjective. When a cop decides he is going to arrest someone they will "notice" all manner of fault. FST is adminstered simply to collect evidence to be used against a person.

Seen this a few times and didn't pickup that she almost hit a car. The officer did nothing about that case of being out of control /dangerous driving etc. The officer let her drive on and around the corner after that happened. Any police officer would have immediately put on the lights and stopped her.
It is almost certain that this incident was a lie. No officer would react as he claimed.

It is completely obvious that this officer was intentionally harassing this woman, whether due to her race or because she was a woman, or because he's just a power tripping jerk. For whatever reason, he definitely intended to harass her and charge her with intoxication. The proof is when she repeatedly asked for her breathalyzer results, he not only refused to answer, but he further threatened to charge her with 'resisting arrest' when she continued to ask.

On the basis of the testimonies in this video, I would have to find the defendant Not Guilty.
Because there's reasonable doubt as to the accuracy of the PBT. Especially if the defendant had just vomited, which would would have put some of the shot into her mouth.
And there's also reasonable doubt that that cop lied about the PBT results - especially in the context of him not telling the defendant the reading, despite her repeatedly asking for it.
That cop with that moustache, hairstyle and general demeanour, comes over as one of those bullying, tyrannical, overbearing, sleazy, over-quick to arrest type of cop.
The bodycam videos should be interesting...

44:02 "I'd write down everything I needed to write down to conclude my investigation" -> translation -> "I'd write down the minimum I needed to justify my arrest"
1:25:18 how convient the cop, after struggling to remember minor details from a recording he had just watched moments prior, he _magically_ remembers what she blew on the PBT, which he failed to write down on the citation, and actively refused to share with the defendant at the time of the arrest. "I believe it was a [0.]165" not something more vague (and plausibly deniable) like "around/about/roughly twice the legal limit" or even a "I believe it was a 0.16-something", instead he gave a specific number to try and bluff his confidence and memory to the jury
1:27:40 prosecutor makes a bad faith conjecture, as I can personally attest that I have to vomit into a cup from food poisoning before, as a passenger in someone else's vehicle, were we drove with the windows closed, we had to do it twice in fact (same vacation trip, once on our way there and once on the return trip. McD and BK did me dirty that vacation). so trying to use that as proof against her is ridiculous and clearly done in bad faith.

The "Follow the pen with your eyes" test is irritating. I've had them drag their pen clear out of my line of sight and hold it there for 15 to 20 seconds. So, there I am, struggling to keep looking hard right or left, unable to physically move my eyes farther each way. The pen is out of sight, and the strain is causing my eyes to get tired and tremble. And I'm getting p¡ssed off at the deliberate causing of inaccurate data.
