We will reiterate it here: please stop taking our footage. While you argue that what you do isn’t unethical, we’ll argue otherwise. The video we made for the Bibimbap clip you used cost a lot of money for us to make. We drove for hours to get to that location. We brought our staff with us, who we all paid to come, to help film and edit this video. We put a lot of energy into it, and a lot of personal expense, and it’s our video. Our video. Not yours. And we don’t want you to use it. We don’t like what you do here. We don’t like this channel. And we should be able to say we don’t want any associations with this channel at all. This video you made doesn’t promote our channel. You’re not talking about us, our message, our video style. You’re not talking about the shot we used. You’re not talking about who we are as people, about why we make videos. You just took our video to use as supplementary footage for your own message. You’re treating us as stock footage. +Simon and Martina Whether you believe this or not, we never got any response to the email we sent back in Feb in addition to the takedown counter-notification (re: "To which we told you that we don’t want to ever be a part of your videos ever again"). I believe you if you say you sent it (unless it's sitting in your Draft folder) but I presume it went into our spam/deleted folders. We figured you reluctantly agreed with our position and/our you saw the benefit. Either way, we do license considerable stock footage, but yes, we also rely on Fair Use (we generally mix stock with channels as it gives a better overall tone to the video). That said, you don't get to set the rules wrt Fair Use, so yes, so long as our videos are Transformative and pass (so to speak) a "weighted average" of the Four Tests of Fair Use, we are within our rights to do so. You may not like to hear that, but that is your problem, not ours. Fair use isn't simply about promoting or reviewing (though it encompasses those things, of course), so rest assured the way we used the video would be Transformative (i.e. a mashup blends various sources and doesn't review anything, but that is transformative). What other companies do is moot as each entity sets its own Copyright risk threshold. Believe me, whether or not you like our channel or not is moot; in fact, Fair Use exists specifically to prevent people from limiting who can create what content. This is absolutely a matter of freedom of speech and expression and the fact that you think this is about your driving hours to film cooking recipes and eating food shows that, with all due respect, you need to get over yourself (and sure, you think the same about what I'm saying; I see both sides even though legally we are right and you know it). That said, YES, we also add many sources on our "black lists" as a matter of professional courtesy. To keep repeating: "[s]top threatening legal action if we try to protect our work" is bordering on defamation and if you continue to misrepresent what we said then we will consider that option (for defamation, not copyright). All I did was i) explain Fair Use which you clearly lack an understanding of and ii) mention that until you educated yourself on the matter, you should not issue takedown's because yes, there have been precedents to that end. But, for the last time, one does not need your permission so long as it's used within the parameters, which it is. That said, out of courtesy we will not use your content in the future. Our entire position herein is based on not receiving a response to our reply (I can gladly send you a screen grab of the email thread showing only the emails we sent you, with no replies received). In any case, I hope this resolves the matter.

I think it said in the intro that soups won't be included. This is likely why there was no mention of ramen, either. If it did include soups, though, I'd expect to see Pho in it, too.
+chongtak Shouldn't you have said all non native speakers of the country. Do you really think only North Americans can't pronounce names of Asian foods? Thai people can't pronounce Japanese names. Japanese aren't good at pronouncing Indian names and so on. Your comment sounds like you think only NA have this problem.
shinmusashi44 I am Cantonese born in Vietnam, raised there and partly in France I have studied Japanese at the university in ICU (Tokyo) for five years I have since lived seven years in Thailand. I can compare the way all those Asian people pronounce oher Asian food names it's not always perfect but sometimes it is. Moreover I havent said EVERYBODY from North America, I have mentionned a North American accent, didn't I? There is a difference. I know some Canadians (white) speaking Vietnamese almost perfectlybut they are extremely rare. My point was HER pronounciation with a North American accent, she is not even able to pronounce simple vowels correctly, you get my point now? However I pointed it with a touch of humour which obviously you didn't get as well.

I have watch several videos about "Americanized Chinese Foods" & I observed that the majority of dishes are popular & widely eaten here in the Philippines in restaurants, in family meals & special occasions.

I came home a little drunk, found this video, decided to make sandwiches before watching it, came up with this: Buns cut in half, toasted the inner sides, let to cool. Spread on both sides: cream cheese with homemade pickled chilli peppers (toasted off, or smoked first), olive oil and garlic. Meat: smoked ham (some countries would consider it bacon). Relish: homemade pickled cabbage, carrot and horseradish (a take on sauerkraut). :D

I only saw the comments now, otherwise I would have answered immediately. I will post this general comment and then reply to Simon and Martina below, as well. [Added later to reflect them saying that they did indeed reply to us: we never received their reply to our formal response after the first clip in February 2016. I give them the benefit of the doubt that they did indeed send an email, but I can show you the email thread showing only emails from us to them and nothing back. Had we received it, without admitting any wrongdoing, we would have not used footage in a second clip out of courtesy. This second clip was actually researched and completed in Dec 2015 but published in April 2016. So not having heard back from them, we didn't go back to flag any further use as 100% of people who receive our responses finally understand how Fair Use works and/or realize the promo benefit.] With regards to Copyright in general, since so many of the critics are clearly so misinformed: I realize that given the ability to comment online, people are quick to say something even though they ought to research the subject and hear both sides. Even though given how we use third-party footage, indeed we don't need to ask permission, originally when we started doing so we would ask. By and large, everyone welcomed it as promotion and as we grew in output, given tight turnaround times, we stopped asking for permission simply because, and I say this respectfully, indeed permission is not required via the Fair Use exemptions provided under Copyright Law. I find it very hypocritical for some to pile on and accuse us of one thing or another when those same people shout #WTFU otherwise. Are those keyboard warriors suggesting that Fair Use should only apply to traditional media companies like movie studios, record labels, video game publishers but not RUclips producers? Do all channels we feature welcome and approve of this? No, I will not lie. But that is a reflection of their lack of understanding of copyright law or hypocrisy; for example, the odd Let's Play channel may object to, but those are the same channels that themselves feature third-party footage from video game publishers... yet turn around and cry foul when we feature short portions of their content in a Transformative review. Now that all said, with regards to Simon and Martina, we did receive a takedown some ago and we issued a counter-notification in the same way we would do so with a traditional media company. We took the time to respectfully outline Fair Use, explain that we view it as promotional and beneficial, and highlighted that they ought to be careful because indeed, in these days, the tide is shifting increasingly in favor of Fair Use and if (upon being informed of our rights via Fair Use) they disagreed, they could simply provide us with cases and precedents supporting their argument. They failed to do so. Why? Because they probably don't understand or like the law. Moreover, I explained in fairly diplomatic and friendly terms (granted tone gets lost in email) that if they issue a takedown against a given channel, some channels would not solely issue a counter-notification but also sue them for actual damages (example Lenz vs Universal Records, Michelle Phan versus Kaskade, and many other cases). We never threatened them of anything, however; if anything, we gave them a clear line of communication to myself to voice their disagreement or discontent, which legally we don't even need to do. It was the polite and fair thing to do. They chose not to reply, but have now decided to go online and defame us. That upsets me and makes me very angry. And if we find them misrepresenting our position and attacking our reputation, then yes, they have crossed the line (are we suggesting in any way that we will pursue them for defamation? No. But is what they are doing harmful to our reputation? Yes, of course it is... hence why I am explaining all of this in very transparent terms to explain that what we do is not illegal or unethical either. But having some new media producers criticize "old media" and/or RUclips for not doing more to recognize and respect Fair Use but then turn around and claim that Fair Use shall not apply to them is plain hypocritical. Lastly, we have worked behind the scenes to help so many channels tackle unfair and excessive takedowns while encouraging them to respect the spirit of the law moreso than simply the letter of the law. We have also worked behind the scenes with RUclips since 2008-ish to push for many of the positive changes over the years. Is the system perfect? No. But we believe that we are respectful of rights holders both "old" and "new" and fully respect the law, so having anyone accuse us otherwise publicly when we reached out to them privately is simply unfair and uncalled for. While some may chalk this up to jealousy and envy, I think it's a lack of understanding of the law. But if you have an issue, my door/email inbox is always open. AK

Although using their videos may be legal, it is immoral. They do not want you to use their videos, but you continue to, even though you can just go ask someone else who is willing to allow you to use their videos. By using their videos against their will, it is almost as if you are rubbing the fact that you can in their faces. If you are trying to make money using other people's videos, you can at least get consent from the creator.

It is a shame that soups were not included in this list. Pho is a daily staple of the Vietnamese, Cambodian and the Lao. It is also becoming very popular in the United States. The thing that makes it popular is the fresh flavor and the versatility of ingredients, just like the Banh mi. Also, I know curry chicken is probably considered an Indian dish, but it is also served in Vietnamese and Thai restaurants.

They actually filmed the footage, you know, did actual work that cost money and used people to set it up. As they've said in their own comment, they don't want their property being used as stock footage. You can claim hypocrisy and defamation, but the fact remains that you could've (obviously) chosen any other Asian cooking channel out there, but instead you chose to use a channel that expressed disagreement with you in the past. That's an antagonistic move regardless of legal standing, like saying, "Hey screw you, we do what we want! FAIR USE!" Well, of course people are going to call you out on a bullying move like that. Why is it so hard for you to respect their wishes?

It's kinda confusing to us Brits when Americans use the word Asian for Chinese, Japanese & people from the same region. Here in the UK, when we say Asian, we're referring to Indian people, Pakistani people & people from that region. If we want to talk about the Asian people Americans are talking about we would call them by their country, so Chinese people, Japanese people etc. But you're right, Indian cuisine does deseve it's own list. Indian food is absolutely amazing! I have Indian family members & my Uncle who's Indian is an awesome cook of the most amazing Indian food. He can cook up the best Indian feast you've ever had in your life!

For some reason, in America, whenever we try to make food that is supposed to be Thai-style, peanuts often get included just because the most popular Thai dish in the US (Pad Thai) is usually served with peanuts. It's weird, especially since Pad Grapao seems to be much more popular in Thailand than Pad Thai (& I would say Pad Grapao is a better tasting dish as well), but most people outside of Thailand don't seem to know about it.

And now, people are discovering _chahan_ , the Japanese take on Chinese fried rice.

Believe me, whether or not you like our channel or not is moot; in fact, Fair Use exists specifically to prevent people from limiting who can create what content. This is absolutely a matter of freedom of speech and expression and the fact that you think this is about your driving hours to film cooking recipes and eating food shows that, with all due respect, you need to get over yourself (and sure, you think the same about what I'm saying; I see both sides even though legally we are right and you know it). That said, YES, we also add many sources on our "black lists" as a matter of professional courtesy. To keep repeating: "[s]top threatening legal action if we try to protect our work" is bordering on defamation and if you continue to misrepresent what we said then we will consider that option (for defamation, not copyright). All I did was i) explain Fair Use which you clearly lack an understanding of and ii) mention that until you educated yourself on the matter, you should not issue takedown's because yes, there have been precedents to that end. But, for the last time, one does not need your permission so long as it's used within the parameters, which it is. That said, out of courtesy we will not use your content in the future. Our entire position herein is based on not receiving a response to our reply (I can gladly send you a screen grab of the email thread showing only the emails we sent you, with no replies received). In any case, I hope this resolves the matter.

shinmusashi44 I am Cantonese born in Vietnam, raised there and partly in France I have studied Japanese at the university in ICU (Tokyo) for five years I have since lived seven years in Thailand. I can compare the way all those Asian people pronounce oher Asian food names it's not always perfect but sometimes it is. Moreover I havent said EVERYBODY from North America, I have mentionned a North American accent, didn't I? There is a difference. I know some Canadians (white) speaking Vietnamese almost perfectlybut they are extremely rare. My point was HER pronounciation with a North American accent, she is not even able to pronounce simple vowels correctly, you get my point now? However I pointed it with a touch of humour which obviously you didn't get as well.

[Added later to reflect them saying that they did indeed reply to us: we never received their reply to our formal response after the first clip in February 2016. I give them the benefit of the doubt that they did indeed send an email, but I can show you the email thread showing only emails from us to them and nothing back. Had we received it, without admitting any wrongdoing, we would have not used footage in a second clip out of courtesy. This second clip was actually researched and completed in Dec 2015 but published in April 2016. So not having heard back from them, we didn't go back to flag any further use as 100% of people who receive our responses finally understand how Fair Use works and/or realize the promo benefit.]
With regards to Copyright in general, since so many of the critics are clearly so misinformed: I realize that given the ability to comment online, people are quick to say something even though they ought to research the subject and hear both sides. Even though given how we use third-party footage, indeed we don't need to ask permission, originally when we started doing so we would ask. By and large, everyone welcomed it as promotion and as we grew in output, given tight turnaround times, we stopped asking for permission simply because, and I say this respectfully, indeed permission is not required via the Fair Use exemptions provided under Copyright Law. I find it very hypocritical for some to pile on and accuse us of one thing or another when those same people shout #WTFU otherwise. Are those keyboard warriors suggesting that Fair Use should only apply to traditional media companies like movie studios, record labels, video game publishers but not RUclips producers? Do all channels we feature welcome and approve of this? No, I will not lie. But that is a reflection of their lack of understanding of copyright law or hypocrisy; for example, the odd Let's Play channel may object to, but those are the same channels that themselves feature third-party footage from video game publishers... yet turn around and cry foul when we feature short portions of their content in a Transformative review. Now that all said, with regards to Simon and Martina, we did receive a takedown some ago and we issued a counter-notification in the same way we would do so with a traditional media company. We took the time to respectfully outline Fair Use, explain that we view it as promotional and beneficial, and highlighted that they ought to be careful because indeed, in these days, the tide is shifting increasingly in favor of Fair Use and if (upon being informed of our rights via Fair Use) they disagreed, they could simply provide us with cases and precedents supporting their argument. They failed to do so. Why? Because they probably don't understand or like the law. Moreover, I explained in fairly diplomatic and friendly terms (granted tone gets lost in email) that if they issue a takedown against a given channel, some channels would not solely issue a counter-notification but also sue them for actual damages (example Lenz vs Universal Records, Michelle Phan versus Kaskade, and many other cases). We never threatened them of anything, however; if anything, we gave them a clear line of communication to myself to voice their disagreement or discontent, which legally we don't even need to do. It was the polite and fair thing to do. They chose not to reply, but have now decided to go online and defame us. That upsets me and makes me very angry. And if we find them misrepresenting our position and attacking our reputation, then yes, they have crossed the line (are we suggesting in any way that we will pursue them for defamation? No. But is what they are doing harmful to our reputation? Yes, of course it is... hence why I am explaining all of this in very transparent terms to explain that what we do is not illegal or unethical either. But having some new media producers criticize "old media" and/or RUclips for not doing more to recognize and respect Fair Use but then turn around and claim that Fair Use shall not apply to them is plain hypocritical. Lastly, we have worked behind the scenes to help so many channels tackle unfair and excessive takedowns while encouraging them to respect the spirit of the law moreso than simply the letter of the law. We have also worked behind the scenes with RUclips since 2008-ish to push for many of the positive changes over the years. Is the system perfect? No. But we believe that we are respectful of rights holders both "old" and "new" and fully respect the law, so having anyone accuse us otherwise publicly when we reached out to them privately is simply unfair and uncalled for. While some may chalk this up to jealousy and envy, I think it's a lack of understanding of the law. But if you have an issue, my door/email inbox is always open.

It's kinda confusing to us Brits when Americans use the word Asian for Chinese, Japanese & people from the same region. Here in the UK, when we say Asian, we're referring to Indian people, Pakistani people & people from that region. If we want to talk about the Asian people Americans are talking about we would call them by their country, so Chinese people, Japanese people etc. But you're right, Indian cuisine does deseve it's own list. Indian food is absolutely amazing! I have Indian family members & my Uncle who's Indian is an awesome cook of the most amazing Indian food. He can cook up the best Indian feast you've ever had in your life!

For some reason, in America, whenever we try to make food that is supposed to be Thai-style, peanuts often get included just because the most popular Thai dish in the US (Pad Thai) is usually served with peanuts. It's weird, especially since Pad Grapao seems to be much more popular in Thailand than Pad Thai (& I would say Pad Grapao is a better tasting dish as well), but most people outside of Thailand don't seem to know about it.
