Craig McLachlan's acquittal shows there are 'no winners' when it comes to allegations: Murray

  • Sky News host Paul Murray says Craig McLachlan’s acquittal shows that “nobody wins” out of legal processes.
    “People who made accusations who ultimate feel the system didn’t stand up for them and the person who have been put through the wringer ultimately to be exonerated by the system,” he said.
    "Nobody wins out of processes like this."
    Mr Murray proposed a system where in cases like sexual assault, the names are withheld until a verdict is reached as both accused and accuser have their reputations tainted by the allegations.
    “People make their judgements based on what they have read on the front page of the newspaper that always screams the accusation louder than the exoneration.”

    The accused should not be publicly named unless proven guilty. Innocent until proven guilty otherwise the accused can be tainted for a long time.

    It is not an even playing field. The accusers does not have pay a dime. They have the police and the OPP looking after them for free. The defendant has to pay hundreds of thousands to defend himself.

      Absolutely spot on, especially when you are looked upon as guilty, until you prove your innocence, rather than innocent until proven guilty. It doesnt just end there either. All the others involved in the case are NOT allowed to corroborate the case outside the courts, yet the judge,the lawyer and the prosecutor can talk about it over a beer or two or twenty or even can strategize the case for a result rather than impose justice. thats when your wealth is tested on how influential your mouth piece is over those long beer drinking sessions. if you somehow ended upwith a legal aid lawyer, fresh out of school, then there is 2 chances of winning the case, and they are out of business, Buckleys and Nunn...the justice system need to be "cleansed".

      @Anthony Marks lol you must be a youngen : ) Buckleys & Nunn were an Australian owned and operated department store chain that were against multinationals and always refused there big offers for their stores and decided to sell to Grace Bros which were again an Australian owned company but not long after Grace Bros were gobbled up by some corporation when they fell to hard times and it all happened in a reasonably short period where the Aussie icon of Buckleys and Nunn were the two chances that we will ever have them trading in Oz again cause they were out of business, hence the saying of two chances of that is buckleys and nunn and they are out of business was a familiar idiom for a couple of decades at least from late 60`s to the late 80`s..

Funny coz I was setting up a stall at the markets the other day and after looking at my work realised that it was what my old man would've called a Heath Robinson construction. Who the hell was Heath Robinson I wonder? I'll look it up some day.

I humbly apologise for taking you for a youngen but my comment had no ill will and again im sorry if it sounded that way. Its always good to know or learn in my case lol the truth of the Australiana stories to pass on to the younger generations. Especially of the innocence and the sincerity of the pre Whitlam years how Australia was truly the " lucky country" When we as kids in Sydney actually looked up to our policeman with with high esteem in the early 70's because they would teach and train us at the "police citizens boys club" all kinds of sports at the communal centre in Meredith St Bankstown North and would quite often join in with us at Graf Park for a kick of the footy or a hit at the nets at tip and run. I cant get my head around how on earth this great country of ours came to where we are at with Chairman Andrews. But i am doing all i can to claim back my country from these corporate cartel gangs that masquerade as politicians in the foot steps and wisdom of uncle Wayne Glew from Geraldton WA (please look him up on YT) im one of the awakened ones and quite often on here commenting and spreading the good word of our supreme law book , the A ustralian constitution, the original 1008 page one and not the fake, condensed version of what the politicians make the ignorant ones beleive the fake re print is the real constitution ... lol any way nice to have met you, may your god bless you. 🙏🏻

      @WWG1WGA its the flawed and corrupt system that allows them or encourages them to do what they have done. prevention is always better than cure as the saying goes.
      we are under the laws of the sea and the UCC with the current system that puts profit before anything, just take a look at the family courts and the amount of misery it can cause to human lives and livelihoods and most heart breaking part is the suffering of the children.
      common law needs to be re instated in our judicial system.

    I do not claim this to be the case here, but I find it interesting that so many women have brought allegations against successful people, while so few have brought allegations against people with lower profiles, could it be that there's not enough money to be had from the less successful people? Just wondering.

    The name of a minor isn't reported partly to ensure that the individual is not burdened for the rest if his or her life.
    Should adults that may ultimately be proven not guilty be similarly burdened.

      There was a case here in the U.S. where a woman who accused a college acquaintance of rape. He was convicted, with no DNA, no evidence whatsoever. After many years in prison (I believe it was 5) she came forward and admitted she made it all up. The prosecutor then filed charges against her. She was convicted of filing a false police report, lying under oath, and some other charges. She was convicted but his life was forever ruined. No amount of money, public apologies, news coverage, or even expunging his record can make up for what he went through.

      I dont believe the accusations were thrown out. There was a trial. The case was heard and he was acquitted.

    I have argued this point before it is said the accused must be named because other potential victims may recognise him and thus come forward.
    But equally why not name the accuser so she maybe recognised by other men she potentially made false claims of sexual assault or rape against .
    Or name neither party and let the legal process take its course.

      andrew gibson and the ABC immediately cancelled that great show because of an allegation. It’s disgusting. The ABC assumed he was guilty. I hope he got a good payout from breach of contract or something. Not to mention all the people who worked on that show.

    Regardless of how much money people have, falsely accusing someone of something like this has a huge effect on their life. They can get fired, lose friends, have family turn their backs on them, b kicked out of clubs and religious organizations, etc...All this can happen within 24 hours of the accusation and the vast majority of the damage is irreversible. Hopefully, the accused has a solid support system. I hope the people who do this face serious jail time.

    It's a case of " tall poppy syndrome". Craig McLachlan had it all- a great career, proven talent: he was truly a star. His accusers have
    blown his behaviour behind the scenes out of all proportion and destroyed his reputation and prospects of future employment as an entertainer. I hope that Craig McLachlan finds his way out of this trauma and gets back on the stage where he belongs.

    Let's start the conversation with the accuser going to the authorities at the time of the offence...Not years after the fact. Maybe you could have saved someone or multiple victims from what you allegedly went through.

      Wrong, it takes a lot of courage to bring a case like this.I know what I witnessed in a classroom as a kid, the perpetrator is now behind bars following multiple charges brought 20-30 years later after the act.You are indulging in classic victim blaming.The assessment of Magistrate Wallington should be taken into account.

    When the Justice system itself is flawed by commercialising in allowing the Uniform Commercial Code to blur lines and muddy the waters, so to speak, innocence will be muddied and blurred naturally.       Craigs partner should be Australian of the year..A woman standing by her man through thick and thin gives us some hope. The scum ABC journalists need to hang there heads in shame. But only lawyers, solicitors and journalists win in today’s society. The judge needs to shut her cake hole. The jury found him innocent. Just because a judge and a couple of stupid journalists believed them doesn’t mean they told the truth. All judges in this country need to be quiet after a trial. The victims on both sides and the jury have the final say. Our judges let scum out on the streets every day and take no responsibility for their actions but want to vindicate supposed victims who have been proven to have fabricated the truth.

It should be about truth and justice not gender, I put this in my comment 2 days ago , but U Tube deleted my comments.
      I also pointed out as you have that the women were coached as what to say on the ABC. Someone working for U Tube didn't like what I wrote and deleted both of my comments.

    it's just as bad for those who have been charged and dragged through the courts only to have the prosecutors drop the charges due to lack of evidence. The presumption by the public is that you are guilty because they lacked evidence. I would ague that not having your day in court is worse as the crazy allegations are never challenged and remain in the public's mind

    My son was falsley accused of rape. He was treated as guilty from the get go until the Jury returned a unanimous acquittal of all charges. 9 years have passed since then and I am still furious about the way he was treated especially when the police recorded in their logs that they believed the accusations were false and malicious but did nothing to try to get to the bottom of why the accuser made the allegations up in the first place. As for the local paper, their reporter came to Court on first day of trial to hear the prosecution's opening statement and then printed a version of it on the front page as though it were a new Gospel! On the day he was acquitted they salaciously rehashed all of the untrue allegations as fact then acknowledged at the very end of their column that he was in fact aquitted. The Jury stated they disbelieved his accuser and thought the lack of evidence against my son and evidence provided by the police medical officer also supported him.
    My son was literally prosecuted based on his accuser's word and her word only. It's beyond parody and I still have moments of rage when I think about it, even after all this time!!

      If the assumption this doesn’t happen if you’re not famous then it’s wrong. Non-famous cases just don’t get publicised. Go down to your local Magistrate’s Court, pick any day and any courtroom and listen to case after case.

      Point is why did all the 'victims' in this case wait so long then all bring cases simultaneously?

      Vinny Bologna This started in an odd year. It was a sexism year. Racism is every even year. all the female actors were calling their agents, "book me a metoo story darling!". Careers were being made on metoo victimhood at the time. But not all of them were that creative. No need, just read the paper, pick up the gist of the accusation and say something similar. That's how the celebrities play.
      For guys like you and me, it's a private affair. Only people who don't know you well think you're garbage. It's a 6 month wait and numerous court appearances whereby you're treated like garbage from everybody in the system, you don't get to have your say except as means to trap you into saying something that can be twisted as evidence against you. You're pressured into accepting guilt because it will cost you less financially but you want justice so you stay the course until you finally get a lonely day in court. Here it's a lottery, lucky if you get a sympathetic cop prosecutor or an idealogue, lucky if you get a sympathetic judge or an idealogue. You sit around and wait until your accuser has that crazy moment, the one where everybody knows there's screws loose. Then feel that massive shift in the atmosphere whereby presumption of guilt switches to realisation of innocence. But it's not sympathy, not even shame, just a realisation. Then you get kicked out of court, no apologies, no feelings of justice, no closure. Relief but no justice. Just your legal bills and months of your life you can't get back. You'll see your accuser treated with sympathy and kid's gloves, likely having used state paid free representation. Your job is to go home and wait for the emotional roller coaster to hit you and try to get on with your life. It's important you process those emotions too so you can avoid the PTSD and learn to trust people again.
      Yeah dude, I've been there.

    I'd like to see Craig take back his role as Dr. Blake in The Blake Mysteries. Also, I would like to say that I am always just amazed at how it is even possible to bring back old accusations and charge someone. If you were that messed up by the supposed incident, why didn't you report it right after it happened? What about Statute of Limitations? It's CRAZY

    If a formal risk assessment was performed about these cases whereby the accusations about a person were made public, and these may well carry some substance. The person being accused, if it's made public will no doubt carry the burden in the public sphere. If the person is proved guilty, then the legal system has done its job however; if the person is found not guilty by a court of law, through its jury of peers, then nobody wins. The accusers are placed in a position of being considered as potential liars whilst the person judged as innocent has a "stain" against their name for future work or relationships. The only winners out of this are the legal teams. They charge exorbitant fees AND who is to say that they don't recommend to the accuser that they should take this to court and that they will win the case? The other scenario is that the accuser just wants to treat the situation to "teach" the other party a lesson. I say; be careful what you wish for because it may backfire and everyone is a loser apart from the Lawyers. Risk assessment is based on Likelihood versus Consequence. If the likelihood is high, the consequence will be swift and lawful. If the Likelihood is low, the consequence may continue to be high, not only for the Accused but also for the Accuser. Moral of the story? Think twice before making accusations and consider your own response rather than some Legal Eagle advising you that you will win from this.

    There should be a law whereby a routine investigation of accusers should take place following acquittal of the accused . If there is enough evidence from that investigation to suggest that the accusers lied in their allegations , criminal charges should be then laid against them . There are those that would argue as has been the case that accusers will be afraid to come forward if they may be subject to an investigation themselves in the future should their accusations not stand up in court . Well , that is , simply , too fucking bad ! No one has the right to use the law as a means of a personal vendetta . It is a complete abuse of justice that wastes the time of many and costs the taxpayer a fortune . Do we have police time and court time to waste on false accusations ? Hell no ! If they accusers are found to have lied and acted with malice , they must be made to pay .

    What if a man is an employee (or a boss) in a small business, or even a government department, and some other employees who do not like him, get together and make accusations of sexual assault. The man (usually a man) is then charged and has to hire lawyers to defend himself. Unlike actors who are better off financially than most of us, that man has to sell his house, to fund a defence; he is likely sacked or suspended from his job; financial stress leads to a broken marriage; and if hopefully he is found innocent the stain is still there. There is no recompense for that man and quite possibly employment or promotion is going to be hard to come by. Where is the justice?

    Make the law equal, not a pay to win system . The courts in Australia have always been a joke . Kangaroo court is a global term . Make the courts tax funded for everyone .     At least he knows who his accusers are and what was said about him. When Karmein Chan was abducted, the police and media called on the public to nominate a suspect and offered a huge reward to pick the right one. 27'000 men were named (including myself) Of these 73 were charged with an offence (not connected to the case) 73 in 27'000 works out to 1 man charged per 370 men named. An anonymous person wrote to police saying I should be investigated. Police contacted my work. I are not even allowed to know what was said about me. People spend hours reading what happens to famous people but no one cares what happened to me. But if anyone wanted to read my story google innuendo test blog.

    We need to understand that under the matriarchy that, if you haven't realized it yet, we are now living in, justice is no longer a case of innocent till proven guilty. Indeed under a matriarchy, you are guilty when you are accused of being guilty by a member of the matriarchy! To be a member you must be born a woman, there are some other lesser classes who are given some status according to the intersectional matrix.

      Spot on. you are on the whim of the complainants statement/ accusation without their accusations being proven authentic or investigated by police to be true. I was caught in that situation when my sister tried assaulting my 88 year old frail mother and i stepped in just in the nick of time to hold and subdue my sister from hurting mum and after getting a mouthful from mum she was disgruntled with me for holding her back and while doing so she sustained minor bruising. she went to. a police station with the bruises claiming that i assaulted her. even after arresting me in cuffs, taken to a police station and explaining the situation and making my statement, what ever my sister claimed stood and the cops did not give a hoot to resolve anything or even to get mums statement and talked to me, treated me like a criminal. I have educated my self in the law for some time when this occurred and took a few simple procedural steps, filed a fine detailed statements on stat decs from myself and my mom with the public records, my case was dismissed without even getting to court. I then questioned there the police involved about the little comment stated under your signature on statement sheets of lying will lead to perjury charges and asked if my sister will be charged for perjury since it was proven that she lied. they were not interested in the slightest. and i left it at that but put in a complaint of the investigating officer (M.Young 4244 const.) of breaching an investigation without due course, besides a whole lot of BS mails of excuses of the cops failngs nothing ever came of it. the whole system is based on processing cases purely for profit. corrupt to the core.
