  • The plaintiff owns a skin care business and was relocating from one state to another. She rented space from the defendant, but she claims the lease was fraudulent. She’s suing for a rent refund and her security deposit. The defendant says she painted and renovated the room for the plaintiff. She argues it’s not her fault the plaintiff backed out, so she refuses to pay.

    Sooooo the plaintiff went down the street around corner because she was trying to get a deal. She knew exactly what she was doing. Unfortunately for the defendant, it backfired. The petty in me would find out everything about the plaintiff's business and properly sub-lease to her competition. I was going to something else but it wasn't nice.🤭

    The plaintiff appears to be struggling to stay focused and articulate her points, often seeming confused and unable to provide clear answers to Judge Milian's questions. The plaintiff (according to the judge) lacked in planning skills to assess the required and needed space for her office. I'm surprised she spoke up and declared 'I'm a real good planner!' The evidence is in her actions, not doing the research; another reason she becomes a litigant. . She appears unwilling to acknowledge her own mistakes or take responsibility for them. The only commendable action she took was contacting the original broker regarding the third-party contract/sublet from the defendant, although it was already after the fact. In contrast, the defendant presented herself well overall, except for her apparent lack of knowledge regarding her contract agreement.

    Michigan does not make Landlords fix mold BUT it does make LandLords fix the Issue that’s causing the mold. So if it’s a leak, or moisture problem; but if you use the word mold in your letter or request the landlord won’t even respond.

    If the defendant had a previous tenant without permission and the landlord never enforced the "only with permission" seems that pervision might not be as enforceable. How long did the landlord know the previous tenant was there? If he was on the first name basis, as the dendant claimed, but never checked if that lease was valid, the landlord clearly isn't checking if permission was granted.
