- The plaintiff is in court because he claims the defendant, the landlord of his late girlfriend, wouldn’t allow him to retrieve his belongings from her apartment. The plaintiff is suing for stolen items. The defendant argues the plaintiff was never a tenant. When the plaintiff’s girlfriend died, the woman’s brother got all the rights to the apartment’s contents. Therefore, the defendant believes he owes nothing.

I am a property manager of residential properties for over 30 years. If not a power of attorney the person resident reports aa the person to contact in the event of an emergency. You are correct, landlords don't get involved. It's the resident friends/family to resolve.

i usually dont like landlords because they do steal deposits but i never heard of a landlord stealing a used tv or a used computer from a tenant , especially since they dont want to give a tenant any excuse to win in court . the judge was wrong and there was ZERO PROOF other than some comments a guy on the phone made that still proved nothing . i dont believe the plaintiff .

I’m guessing she did do some rough justice, but we just didn’t get to see it. The only things he had receipts for were the microwave and vanity from Lowe’s. No way the depreciated value for those was $700+.
It’s because everyone commented he was a mooch. She didn’t want to award him for anything the deceased woman likely bought herself or gifted him. Also he could have stolen these items or bought them second hand. Receipts are proof of what he lost.

I hold my regular receipts for a year and purge in a shredder in January, but yes, like you all the “big boy” buys for much longer. I keep those receipts in a special folder in my filing cabinet because I had to drag them out a few times (like for a washer or something). Hell, I keep some for prosperity (like the very computer I purchased with my own $ 20+ years lol).
I kept a receipt for a TV for 14 years. I kept receipts for my rental to this day and my appliances were damaged from a hurricane, my lawyer asked for the receipts, I still have them after 12 years.
Thank God for honest, non-biased people. Stephanie's brother didn't have to help based on the family not liking the plaintiff but he just told the truth and helped expose that deceitful landlord (who I thought was actually right at first).

I don't agree with the judge's decision. I think the Plaintiff should have been awarded every single penny he sued for. If a Defendant or landlord behaves in this manner, even stealing low value items, it should be punished. I totally believe this Plaintiff.

Whether he was homeless or reliant on his sister doesn't matter here; there are always unseen layers to a situation. What's important is that he effectively presented his case and demonstrated that he didn't receive all of his belongings, possibly due to the landlord's involvement as the judge suggested. The late sister's family believed he was taking advantage of her, but it appears the defendant may have played a role in exploiting the plaintiff, as indicated by a phone call to the deceased sister's brother supporting the plaintiff's account. Like the judge, I base my judgment on the preponderance of evidence presented.

I have a suspicion that the defendant told the brother to change the lock because he was upset that the plaintiff was living there and not on the lease, and THEN the defendant stole the items as a form of 'payment' for the lie.
So the landlord encouraged the brother to change the locks to do an illegal lockout, then told them to put aside Ernest's things so that he could steal it all. Why didn't the judge include a rough justice amount for the lap top since the brother on the phone even mentioned it?...

I'm a property manager and if the deceased's family doesn't come get their belongings without about two weeks. Then we will call the family as a reminder. After that we'll call a local charity or shelter to come pick up their belongings for others to be able to use. We would never steal them or throw them away.
