The judge has been too lenient with the prosecutors. How can new evidence be given to the jury after both parties have prepared their arguments.
I believe what someone else said. The judge most likely wants the process to play out and have the jury decide. Instead of outcome based on a technicality.
Prosecutors: it’s the same file. We didn’t change it or modify it. We sent it as it was. Defense: the name on the file was change and the file has a modified date compared to the original file. I rest my case

@@rrickarr I arrived at the conclusion because Kyle was running away yelling "friendly" over and over from a child molester who had threatened to murder him earlier in the day. Then Kyle didn't fire again until he'd been hit, knocked down, and beaten with a skateboard, kicked in the face, and had a gun pointed at his head... all by prior felons who either abused kids or their girlfriends.

A lot of people think he’s spacing out or losing his train of thought due to his age but he isn’t, he’s carefully thinking out his words multiple steps ahead and making sure he doesn’t put his foot in his mouth so he’s being very smart.

This judge is amazing. I too can see him being very careful in choosing his words. I also like his comment about not allowing media into his courtroom again. Kenosha will end up in flames again, no matter the verdict, as people are just waiting for an excuse to riot.

I don't usually say anything, but All prosecutors must make sure ALL evidence is turned over and received properly.

They’re taking a long time because there is NO DOUBT that he was defending himself, however the court has given them very strict parameters regarding the definition of “lawful self defense with deadly force”. It’s so terrible that the life of this young man hangs on a technicality. The prosecutors KNOW he was defending himself so they laid into the technicalities of the definition. It seems like at least one of the jurors is paying attention to that legal definition. It doesn’t matter what the criminal history of the deceased is, they are leaning into the fact that you can’t shoot people simply for chasing you. But the defense leaned into the motion that his life was threatened verbally prior to being chased thus justifying it (regarding the unarmed guy who had the plastic bag).
It’s a mess. I can see how the prosecutors could get a conviction on 2 charges with these technicalities but not the others (reckless endangering safety, use of dangerous weapon, and maybeeeeeee 1 of the murder charges for the guy who was unarmed). Other than that I don’t think they have much to stand on.

A new tape of an incident should never have been allowed into evidence once the jury got the case. That is serious grounds for a mistrial. Especially since the prosecution did not provide the same video to the defense. They were given a shorter, altered version.

Prosecutors are ethically required to do justice, not to "win." Not giving legal advice, but often, as a matter of law, doctoring evidence can undo an entire case as "fruit of the pois.on.ous tree." Also, the appearance of impropriety used to be frowned upon.
The jury doesn't even know that literally 100% of the people who physically assaulted Kyle had criminal records, either for violent sexual assault of minors or domestic abuse, that includes "jump kick man" whose identity was hidden from the defense until now. These people weren't killed because they'd strangled girlfriends or assaulted children, but it shows the kind of people who were threatening Kyle.

Nah. What he said is that he asked the detective to send it over email to the defense. I bet what happened was that detective got not delivered reply due to size of the attachment limit so he compressed it (took him 20 min) and then he sent it again. Either way it's state's fault. They are clearly "technically challenged". For instance even their "expert" who they brought to the court couldn't explain how image interpolation works. Utter incompetence.

Oh there is plenty ways to tranfer an uncompressed file. If someone doing high-profile murder cases isn't aware email systems routinely compress files to ease transmission. I would say that someone is not qualified to participate in a high-profile murder case such as this.

Personally, I think its a case of being outright dishonest. How many times has the judge dressed down the prosecutors because of their behavior, this is just another example of them getting caught doing something that they shouldn't be doing. The judge is at liberty to accept or deny the mistrial request for any reason whatsoever right? So if the jury somehow declares guilty, he can grant the mistrial request. And if not guilty, he can deny the request.

@@emersonurbina8042 its the states burden to prove the guilt its not up to the prosectuer. and they arent making baseless claims just because you dont understand the reasons why they are objecting doesnt make them wrong lmao. they are arguing over the bags becuase if a pixel was added in that wasnt there and the program chose to make it black it could make him appear to be pointing the guy when the picture is so mall that the gun would have been a pixel and the state cannot guarantee that pixels werent added in as the placement and color are chosen by artifical intelligence and they have no way of knowing where they were added. this is the reason they are arguing over the different qualities. when something is enlarged it is not a 100 percent authentic copy as the interpolation has altered what is being seen. if the gun is a pixel or two long the program could have easily chose to add pixels in front of his body and make them black. the pictures they are looking at super blurry they can just see something black in his hands in the enlarged photo they are arguing like you can clearly see the gun being pointed but its not the judge even laughed and commented on the blurry of the photos and said he couldnt see anything. a fake pixel could be the difference between convictions. they have every right to argue about a computer program created by human to interpret what it sees and how are these Ai algorithms are programed are by people who work for less then minimum age and click on photos to refine the program. Everyone just assumes everything is the same and i give them props for calling out non government programs that no one can check how it works into question...

The evidence was mishandled. The prosector should have gotten together with the investigators first and decided how to obtain, identify and classify the evidence. They probably needed a warrant as well. You can't just AirDrop items for evidence without a legal chain of custody. This is no really any different than a prosector who is present on a murder scene picking up evidence outside of process.
Rittenhouse's first defense attorney had the video. It was that defense attorney's obligation to guve it to the new defense. Further this defense was given a copy albiet not the HD version. This defense watched during the entire trial as the HD version was being played. The HD footage doesn't prove Rittenhouse's innocence. The defense was not prejudiced in anyway.

Self-defense period
The prosecutors even know it’s self defense. Their entire case lies on a technicality! The court gave very strict parameters for the definition of “lawful self defense with the use of deadly force”. So they’re not deliberating over wether he was defending himself or not, everyone with eyes who has seen the videos knows he was. Those 12 jurors are in there are going to make a decision based on a technicality and it’s SAD. The only charge that this technicality might stick on is the murder charge against the unarmed guy who chased him, but the defense did a good job making it clear that he verbally threatened to kill Kyle prior to chasing him. So it’s really up in the air…. Which is also incredibly sad.
Regardless, it should be a mistrial due to this issue with the video evidence. Everyone deserves a fair trail and this no longer seems fair now that this video issue has come up

Speaking as a forensic technology specialist with over 14 years of experience in the field, the prosecution lawyer's point about not knowing that the file would be compressed is factually impossible. Despite not being able to airdrop, emailing the file would have prompted the prosecutor as to what size of file they want to send. It would be very interesting to see the particulars of the files to work out who is lying here.
They should be sending in a zip file, and verifying the size/date/time/crc.

Mistral with Prejudice. They changed the file name and sent a compressed version on purpose. That's prejudice. Game over. The receiving email client does not compress a file. The sender's email client or phone does the compression before sending.
This politically motivated prosecution should have never gone to trial. Instead of focusing on the real criminals who burned down the city, they go after a kid that was looking to support law and order.

google mail doesn't compress video files for you, that's something you have to consciously do.
Giving the jury a new high res video of the same video they saw and formed opinions, can clearly at the least cause confusion. This judge should look at the shenanigans of the prosecution in their totality, and dismiss the case with prejudice e.

There really isn't to many fair trials nowadays, they might want to convince themselves they are fair but that just isn't true. Many people are guilty in the publics eye before even any evidence is heard. This leads to plea deals because they have no chance to win even if they are innocent. You can say you are innocent all you want but if the Prosecution wants to push agendas you are screwed. SERVING 6 months or ten years for a crime you didn't commit. Most take the pleas.

Since the legal standard is "guilty beyond a reasonable doubt", I think evidence that is so poor in quality that it needs to be looked at over and over is perfect evidence of reasonable doubt. None of those jurors are expert at interpretation of grainy and poor videos. They all saw it once already and the request to see it agin demonstrates how low the quality really is. They are all doubting what they have seen. I'd say "no" to the request.

Ok so with regard to Gmail. If the file you are attaching and sending is larger then what is allowed? The Gmail application alerts you that the file is too large and that it will be COMPRESSED... So whoever sent AGA the file to his Gmail account.
They had the full file and GMAIL compressed the file attachment. The defense is entitled to the full non-compressed file. It's also not their fault that the AGA was not aware that the file would be compressed by Gmail. The state crime lab, however? Should know that will occur, probably do, and should have made them aware that would occur.
