This is a scary situation in California because of AB392. If he’s threatening to harm others, slippery slope but I’d probably stick around but disengage. But if he said GTFO of here and he’s by himself, I’m gone and maybe come up with a plan to surveil him and take him away from home. This is f’d situation.

If he is homicidal he is a threat to 3rd parties. I would have treated this as barricaded too. Considering the order, i would contact the judge and mental health also regarding the escalated situation. Here, we no longer respond to threatening suicides if there is no 3rd party threat. Dispatch will give them a hotline number. If they harm themselves we will respond but not if they are alone and suicidal.

@@ToddThought One of our guys had his ear bitten off on a mental call. Then the family attacked the officers trying to get him off. We charged the family members. Our agency looks at it as no crime is being broken. We did have some push back from fire and medical but if they are just threatening and they know we aren't going then they are no longer dispatched either.

0:57 - "Immediately began yelling GTF out of here". At this point, all these Officers who didn't leave are guilty of Trespass(while armed). Note, this happened BEFORE the threat/grabbing the gun. The exigency was CREATED by the OFFICERS. Kind of like doing a knock and talk, then throwing a Molotov cocktail thru the window, then using the burning building as exigency to enter.
Any Judge who signed the original order would probably sign the search/arrest warrant if they are told about what happened.

Nice explanation but we know it could never work peacefully in the situation described, especially in the Florida police state. He would be taken down violently, probably with many new holes in him. Florida is where politicians and judges believe cops can do no wrong and have absolute, not qualified, immunity.

He was not acting erratically until the cops showed up (from the information given). So we have cause and effect. From the information given, the police immediately started threatening him (yelling and cussing at him first, he reacted to being threatened). If the police would have gone in that house at that time, he would have been killed and possibly injured a cop in the process. The SWAT team will shoot peaceful people awoken in the middle of the night who come to their door with their hands up (Kloepfer, lawsuit filed and pending in North Carolina District Court) So, probably not a good idea to call those guys.
