A Florida Airman was killed by a LEO because someone reported an argument between a man and a woman in an apartment. The argument was on a FaceTime call. So that causes a bit of a problem with a 911 call. Additionally, in Iowa, you are not required to give your name is asked to identify yourself.

Most people don't understand what stop and ID means. Stop and ID, quasi stop and ID, or no stop and ID: Regardless of the state, a LEO still has to have RAS that a crime has, is, or is about to be committed in order to compel someone to ID. There is not a single state in the US where LE can simply demand someone ID himself/herself absent RAS.

I don't think an allegation from someone who heard an argument rises to the level of RAS. Unless the witnesses claims to have seen a physical altercation.

The Target example happened in San Angelo, Texas. He got a nice check out of it after they kicked his ass. This is a must watch.

Your caller seems to be quite misinformed on Iowa law.

"Involved in that crime" what crime? What was reported (by who knows who) was arguing between a man and a woman.. No crime. Sorry, this is exactly the problem..

What can you do if a passenger voluntarily gives you his name and DOB but it’s fake and you know he’s most likely wanted. We have no charges on male passenger. My state does not have a mandatory ID Law.
Turn loose or take to jail and print?

He has obstructed. Had he said nothing than unless you have some other info to say he is wanted, then you cut loose. But providing false info, that is delaying/obstructing with the intent to mislay justice.

He did not have to identify himself. We knew he was lying and thought he was a wanted sex offender he resembled. He admitted to be on probation and stupidly gave his correct DOC number. I guess he did not think we could run a DOC number. He was identified and charged with providing false ID.

@@stockyardfabricationandfen659 Yea you had a reason to detain, he gave ID info, that you could clearly tell was not valid. Seems like a good arrest/Cite to me. Had he said nothing, then per Hayes v. Florida, 470 U.S. 811 (1985) I'm not sure you would have PC to take him to the station and fingerprint. However per Pennsylvania v. Muniz, 496 U.S. 582 (1990) you could probably have a mobile fingerprint and do it all right there.

Tell people the truth abt cops. Once a person gets a police badge, and is issued a gun, tt cop confuses himself with a demigod!
Police seem 2B under the impression tt a citizen's rights begin, and end with the cop. This is a vy dangerous situation 4 the citizenry.

loud arguments are not a crime. hes already confirmed that hes from that address yes. interview the caller and the suspected woman involved. and if a crime was committed go find him. otherwise for all you know it could have been the tv too loud and the third party caller is some crazy karen or some old lady who cant tell the difference between arguing and pulp fiction.

Those 1st amendment auditors just want to waste cops time, when 8 cops show up to intimidate them, they are just spending man hours on nothing. The auditor wins. Probably funnier to just let the guy stand out there in the cold for hours and ignore them. The gopro battery drains in about 4 hours.

Good answer in how to handle it, for a variety of reasons. Perhaps your reasoning for doing so is poor, but a valid result all the same.

Maybe the cops are wasting their own time. Police have a legal right to make someone ID or they don't. If police don't have a legal right and choose to intimate to try and get ID that's their choice therefore they are wasting their own time.

@@markmixon1121 But we pay their salaries. Time is money, they are wasting tax payer dollars.Especially when what these so called "auditors" really want is a lawsuit so they can get payday.

@@bleebu5448 time is money in the private sector where you have to produce something that someone else wants to turn a profit. Government workers take money away from others and pay themselves with it not having to produce anything. So time is not money for them it's just time until they can collect a check for the rest of their lives for not working.
Many auditors were abused by police and do things that are legal that the police don't like and sincerely want to invoke change so police are somehow held accountable for breaking the law.

@@markmixon1121 Just because something is legal, doesn't mean you should do it. But I stand by original comment that if the cops ignored the guy, he eventually would go a way. No one will watch a 4 hour video of a guy standing outside a cop station on RUclips.
