      They just got sued for another incident and it settled for $175 I just 4 days before this happened..he knew that th iij a shit might blow up,and you can bet he knew about it the very next day..he waited to see if karen garner was going to lawyer up and pursue this case....he knows theres a problem before this happened and he let it go on

I can guarantee you that if this shitstorm never hit the media and Ms. Gardener's family were the only people aware of this, the exact same Chief would be putting out a statement that reads: "we have investigated ourselves and we have found no wrong doing. I stand by my officers and their actions"
      You just KNOW that's what's happening right now in an alternate universe where the media hasn't picked this story up.
      They're only sorry because they got caught.

    What about the sergeant, the supervisor in the field, who appeared on scene and approved the officers taking Karen Garner to jail for six hours without first getting medical attention? He held her jacket that had blood on it and asked about it on video! The sergeant needs to be fired and charged with endangering her by omission and failure to intervene! It is very questionable whether the remaining Loveland officers know right from wrong, unless, of course, they are caught on video doing wrong.

      He straight up see the supervisor Tyler Blackett watched the video as hopp was saying “wait for it you can hear the pop haha” and then Blackett made fun of her along with Austin hopp laughing about her injury. He Asked hopp and jalali if Karen should get a “felony” for god sakes for what happened. Jalali even mentioned to both Tyler Blackett and hopp that she’s complaining about her arm and they did nothing. He is just as guilty!!!!
      Oh and by the way Tyler Blackett is now working for Boulder police.

      Any monetary settlement that a victim gets should come from the police retirement fund first, then the balance from the municipality. If their retirement gets gutted when they abuse their power, maybe the reasonable officers will stand up and stop the sociopathic officers...

      @@philipem1000 have you ever tried to file a complaint against a police officer? If you can even get internal affairs to take down your complaint (which is a big if), the "investigation" typically consists of asking the officer involved if he/she thinks they did anything wrong. They obviously say "no" and the complaint is deemed "unsubstantiated", nothing happens, and it doesn't go on your record. With these cops bold attitude and blatant disregard for this woman, along with the fact that they were all in it together, it is incredibly unlikely that this was their first rodeo of bad behavior.

    Chief knew about this for months and did nothing. It was not until it went to the media then he did something about it. Then he let the 2 officers quit and NEVER FIRED THEM. CHIEF YOU NEED TO BE FIRED ASAP. END QUALIFIED IMMUNITY NOW!

      Chief will be called to testify in the trials where it will be shown by a good lawyer that he was aware earlier than he is saying he was. He will then resign. He is ultimately accountable.

A plaintiff who prevails in the lawsuit is entitled to reasonable attorney fees, and a defendant in an individual suit is entitled to reasonable attorney fees for defending any frivolous claims. Qualified immunity is not a defense to the civil action. The act requires a political subdivision of the state to indemnify its employees for such a claim; except that if the peace officer's employer determines the officer did not act upon a good faith and reasonable belief that the action was lawful, then the peace officer is personally liable for 5 percent of the judgment or $25,000, whichever is less, unless the judgment is uncollectible from the officer, then the officer's employer satisfies the whole judgment. A public entity does not have to indemnify a peace officer if the peace officer was convicted of a criminal violation for the conduct from which the claim arises.

      Colorado did way with qualified immunity, but the limit an officer can be on the hook for is $25,000.00. The department is responsible for indemnifying their police.

      @@janetciminello9599 Lawyers are beginning to win alot of these brutality cases because of the public sentiment when they can manage to get the body cam released to the public.These incidents have gone on forever,its just in the past the lawyers couldn't get the courts to prosecute the cops .Now the body cam has made it to where they can force a lawsuit,and lawyers all over the country are winning alot of money for the clients of these cases...l expect this case to fetch at least a million easy .They just settled one 4 days prior for $175 k right here in Loveland.same lawyer...you go girl!..

I tried to file a complaint against an officer in Golden once and the lady in charge of investigations was like, "I know that officer and he would never do that." She wouldn't even take down the complaint, let alone investigate. Some people are evil, but the willful ignorance perpetrated by so many others causes almost as many problems

    I'm viewing this from an impartial standpoint. I don't live in the US.
    The fact Ms Gardner has dementia was not a critical element in her arrest. The bodycam footage clearly shows:-
    She was no threat to the officers.
    Other than saying "I am going home" and trying to walk away slowly she offered no resistance yet the arresting officer thought it appropriate to wrestle her to the ground and handcuff her hands behind her back.
    On arrival at the police vehicle the second officer applied leg restraints!
    Without justification the arresting officer grabbed Ms Gardner slammed her against the police vehicle where it's clear her shoulder was dislocated. He then wrestled her to the ground a second time where she sustained additional injuries. This is excessive use of force which the DA believes warrants criminal charges.
    From the time the D.A's office became involved it took less than a month to bring charges!
    It doesn't matter how many times Chief "T I C E R" repeats the claim "I support these charges".
    it doesn't improve his credibility.
    His surname has FIVE letters his name has been in the media since this travesty of a arrest was made public by Ms Gardner's Lawyer. Why Chief Ticer thinks we might misspell or mispronounce it is a mystery!
    I'd say having his name mispronounced is the least of his worries! Chief Ticer needs to accept:-
    As chief of police the buck stops with him.
    A suspect was booked into custody with significant injuries and received no medical assistance.
    No charges were brought and she was released.
    Her family engaged a lawyer who will have contacted the department. A lawsuit was filed. The lawyer obtained bodycam and cctv footage showing what happened from the department.
    It was only after these videos were released on social media that the department took any action.
    The officers were allowed to resign!
    In the circumstances Chief Ticer's statement that he took action "as soon as I became aware" lacks credibility!
    If what he says is accurate then he's failed as police chief because it's his job to be aware of what's happening in the department and his responsibility for the actions of his officers and the welfare of people in custody!
    In the best case scenario it seems his position as chief is untenable.
    Ms Gardner and the people of Loveland deserve better!

    as one woman pointed out at a town hall the police chief either knew about it and did nothing or he''s incompetent at his job. Either way he needs to go. This is further supported when he claimed there are excellent stop gap measures in place for review of use of force. Clearly not the case if it took 8 months and a federal lawsuit to come to light

      Now we need justice for Ms. Antanique Ray and her daughter Nekia Trigg in Forney Texas. The 18-year-old daughter, Nekia, who had just received the regular high school diploma, was shown on the body cam video of Kaufman Sheriff's Deputy Conner Martin. Nekia was shown walking on the sidewalk and obeying all laws. Conner Martin threw her down onto the ground, and lay down on top of her for 5 long minutes almost stopping Nekia's breathing. The Kaufman Sheriff's Dept. justified Conner's behavior by saying that they had received a 911 call claiming some Black woman was jaywalking to commit suicide. However, that still-unidentified caller said more than once that the jaywalking Black woman she saw was wearing KHAKI PANTS, but the videos clearly show Nekia wearing WHITE SHORTS. The mother, Mrs. Ray, was also thrown to the ground and handcuffed, just as one of the mothers outside the Robb Elementary School in Uvalde TX who only wanted her child to live, was handcuffed for "interfering."

He failed to ensure the woman was given proper medical care as the Sgt. on duty. He needs to be put up on charges too.

    The media asked nothing but a bunch of softball questions. No reporter asked who is "we" that he claims didn't know since his Sgt., knew about the incident. A supervisor knew of the incident so the department knew that day. Another officer that was not involved in the arrest also watched the video with the other two officers. Why didn't that officer report it?

    If I was Chief, any time someone was injured by one of my officers, I would want to know immediately. I would review the video footage and any other documentation. I guarantee you these officers would have been fired and charged a lot sooner than this. Also that Sgt Metzler, would have been fired and charged as well. He threatened that person driving down the street, who tried to intervene, with arrest. So not only was Metzler aware of that lady being abused, he prevented the person who was driving by, from stopping the assault. That makes him an accessory. The District Attorney and the Sheriff need to go as well as the town council. This lady isn't the first person abused by this police department. They also abused a man who ended up having to have shoulder replacement surgery. Google Preston Sowl to get an eye-opener on the thugs working there. The Sheriff acts like this was an isolated incident. It's not. Now the police department is bragging that they have instituted training regarding how to treat people with alzheimer's symptoms. I've got a novel idea. How about training your officer's to treat everyone with dignity and respect. Walmart in that town isn't any better. They need some training also.
