What constitutes unlawful interference with a motor vehicle? Does it have to be more than just touching? Or could they claim that charge. Very good to see you back!

@IamJigle hate to tell you but words matter, he is just entitled thinking its his. Actually you should read the law on impersonating a police officer it has nothing to do with what he says, there are no special words. I think you will find he is a police officer and he was just lying. Whats new.

Legislation is not Law. It's Corporate Policy that applies to all persons (fiction) incorporated or not (aka Government employees). The New Zealand Police are a private for profit Corporation. They like all the New Zealand Government Agencies have a Dunns and Bradstreet Number as they're all Registered Businesses who need good credit to apply for loans.
I see this was five months ago. So the six month window in which they have to bring a charge is almost up. Have you got an update? Did you complain the IPCA? Just a few observations though. You asked the second officer if he was a constable, and he replied no! He wasn't lying. He is a Police Authorised Officer, attached to the CVST as a Vehicle Safety Officer. So he's non sworn, therefore not a constable, which as you know having been one yourself is a sworn position. You are correct in saying if you did that to a police officer you would probably be arrested, but a police officer is allowed to use reasonable force on people. And while it isn't his own vehicle, he's responsible for it. However that's a moot point. Your biggest problem might be it is obvious you went out of your way to provoke that encounter. If it goes to court a Judge might not look favorably on seeing that.. Your two previous videos where you were stopped at check points you did a lot better. Both times the police officers stuffed up. I am not surprised at the detectives doing that, but the first officer was actually attached to a traffic branch, so should know the DIC process perfectly. There isn't a lot to it. I can still relate it word for word years later, and you obviously know it too.
Hi Thank you for your well thought out response I made a complaint to police they immediately handed it off to IPCA so I withdrew the compliant as I have no time for the IPCA waste of space in my opinion. Yes correct impersonating a police officer, if is a police employee no offense dosn't have to be sworn, whether he is payed yes/no technically make him an employee, not gonna go there however Section 15 of the Transport Act is possible I have more video of him inspecting trucks, does that make him an enforcement officer?, hehe someone said he looked like Kieran McAnulty MP, but I don't think its him, Police wouldn't provide his details not even his QID which he must have if employed Reasonable force in the execution of his duties, Its not criminal, but I think I will go the civil route for the assault, 2 years time period for that. Disagree, filming a police vehicle, everyone in NZ must be allowed to do that, he then gave an unlawful order and expected compliance and when he didn't get it he used force. Acceptable probably not, let the Judge decide, it can get expensive though. Yes detectives don't usually do the EBA's, when I was in the job I got a couple of calls from a detectives. "if you are free can you come and do EBA for me" which I didn't mind I use to like doing them. The civil case for the Ashhurst one is still proceeding through the courts, Crown Law stuffed up big time more on that another day, and have made some interesting arguments. Anyway be interesting to see what happens, Crown Law best lawyers in the country Police and Attorney General involved and the resources of the government against some dumb nutter pensioner, what could possibly go wrong. Anyway thank you for your comment.
@@kiwifreedomThanks for the prompt reply. The non sworn Vehicle Safety Officers are enforcement officers, there is provision in the police act for the Commissioner to appoint non sworn employees as such. So yes they can stop trucks for inspections, and issue tickets. They can stop other vehicles too but they generally concentrate on trucks. And yes he would have a QID. Nothing wrong with filming a police car, but a Judge might agree that you had no right to touch it after he had told you not to. As for the detectives doing the checkpoint, often happens when a district isn't going to meet the numbers for the period so they turn everyone out on the street to stop vehicles and get the stats up. The district Manager looks bad if they fail to meet the targets.. I'm surprised the Sgt didn't know better though. Agree with you about the IPCA, they come up with some odd decisions. They need to go out on the front line and deal with what police have to deal with, see if it's as easy as they think. Just re this particular incident. I think the officer could have handled it better by asking if you wanted to have a better look at the vehicle, and opened the door so you could look inside. Nothing secret about what's inside a police vehicle. Doing that would have de-escalated the encounter. Ive watched a few more of your videos and I see some officers did that. I presume you are doing a similar sort of first amendment activity that is very popular in the US. Might be difficult to do in a small country like NZ though. I notice the S/Sgt knew who you were and that you were ex police. Have you stopped doing it?
@@WillDouglas-z1h Hey good to know they are enforcement officer's we didn't have them in my time. yup we use to get the SAP hours thing all the time, for the next 2 weeks you will code everything to seat belts doesn't matter what you are doing. I presume it still goes on. Have to disagree with you about the "you had no right to touch it" you are wrong, very famous case law says "An individual can do anything that is not expressly forbidden by a rule of law. A public Authority can only do what legislation allows". If you can tell me what rule of law that says I can't touch a police car I'm all ears, just because a police officer says not to touch it doesn't mean anything unless there is a law backing it up. As far as I know there is none, its the hardest thing for police to learn is that people don't have to do what ever police tell you, and when they have a camera on them, they can't lie about it afterwards. Its what Auditing is all about that's what peoples rights and freedom's are all about. I'm just there, not trying to provoke anything, I don't mind if an officer act's properly or improperly I just want to record it and publish and let people make up there own minds. Personally I hope they would do a good job so they can be shown in a good light, but unfortunately that is not always the case. Yes de-escalating some police just can't help them selves, their ego's take over seen it so often when I was on the job. Auditing works in this country, it's just different, small county, good intel system (cops can write lots of BS about you), everybody seems to know me, some want to chat, others just walk the other way or drive off, I don't mind I'm really easy going about it all, they are all very polite these days, there are the odd one or two that haven't got the memo. I've been doing some, but nothing worth putting on YT funny though. A funny one the other day I was in the station doing an OIA thing and they had the door to the back open people at the counter, cop just sitting in there playing on his phone and all the CCTV cameras visible, so I just filmed it all while they were off doing my OIA thing, cops walked past never said a word, never closed the door, that's the way it should be, if they don't want me to film they should close the door that's on them, I can film anything I can see from a public place (a couple of exceptions of course).
@@kiwifreedom I think the VSO got introduced back in the late 90s. they needed people who were qualified truck mechanics and there weren't enough such people in the police that wanted to join the CVIU as they called it back then. So they created the non sworn enforcement position. It wasn't unique though, Auckland Motorways had non sworn Support Officers who had traffic enforcement powers. Re police telling someone to stop touching their car. If the officer tells you not to touch the car and you refuse that could well be classed as obstruction. Depends of course on what Judge thinks, and these days Judges seem to be more concerned with letting offenders off than penalising them. When a multiple rapist on home D gets let of breeching a couple of times with no penalty then someone who refuses to stop touching a car sure isn't going to get anything. And I agree there is a lot of Intel on people in NZ who do what you do, there are a few of you. Most no where near as polite as you are. The big advantage for police in having just one police service in a country with a small population.
You come across as a disgruntled ex employee, trying to make a point about how entitled you are to film in public with a toxic, aggressive tone. You intentionally go out of your way to impede or interfere with everyday policing duties with the desire to create a scene and capture it on film for subscribers and likes online. It's hard to believe you were ever a Police employee with the negative spin you put on everything that you record regardless of the interaction. This channel is evident that you clearly weren't cut out for policing and the NZ Police is better off without you.
Amen to that. Totally distracting and impeeding Police's attempts to do their jobs. This guy is just as bad as an 18 year old Gen Zer saying going on about how offended they are.
Do a youtube search for "Auditing". Its about just obeying the law, and just making sure the govt respect my rights, its the police who mess with me, anyone should be able to go up to any govt car and inspect it, the public paid for it that's you and me. Unfortunately police think they have more powers than they actually have.

what happened to you brother, been over 7 months hope you are alright. loved watching all the vids during covid but noticed no recent posts
Well done, they can be very intimidating
hahaha yeah I think its called legal intimidation.
First watch from UK, keep up the good work!
What constitutes unlawful interference with a motor vehicle? Does it have to be more than just touching? Or could they claim that charge. Very good to see you back!
Sect 226 (2) crimes act Intent, dishonestly, interferes, just touching doesn't give you those ingredients of the offence.
Love these vids do you also do them in auckland
Keep up the good work against these tyrants!
Trust me mate if you come to Oamaru to film you are not safe bud you recording in Oamaru nz is like risking your whole life
Your the man Bro ! thanks for the case law !
"..my vehicle"? His personal vehicle has police markings?
The other guy is probably Non Sworn, and should have said so. Non Sworn officers are not Police Officers and so is impersonating a police officer, and is a criminal offense. Looking forward to the follow up.
Keep up the good work. "Safer communities together" is their moto, is it not.
Why focus on the intricacies of someone's words. You know what he meant by that. Also I would love for you to find a court that would prosecute the second guy cause he didn't say the special words for Kiwi Freedom's camera.
@IamJigle hate to tell you but words matter, he is just entitled thinking its his. Actually you should read the law on impersonating a police officer it has nothing to do with what he says, there are no special words. I think you will find he is a police officer and he was just lying. Whats new.
@@IamJigleThat's your slave mentality. Who do you think the car belongs to? It's the people's car paid for by the people. He may wash it but it's not his. It's all in the wording. The people built this nation, not a gruberment.
A non sworn officer can not make an arrest and his testimony in court will only be as good as any other civilian. Solicitors will not tolerate it. 270 min sworn officers were employed with NZ Police recently. Don't be fooled again.
*270 non sworn..
Hey mate been watching few your vids now bloody good work. I noticed in 1 your vids your seen people you use to work with so wondering if you use to be a police officer?
yes he was a Cop in Palmy for 8 years
Look at comfortable Robbinsons eyes, he's not happy bing told what to do, good on you mate I love seeing your videos keep up the great
I got arrested and held in custody for at the prison for something someone aqused me of the cops arrested me about half an hour after I got home from work I told them I was at work all night so I couldn't have been were she said I was go and have a look at the video footage from work and that will prove I was at work on the door of the club all night and never left they said it's not there job and never gave me a phone call so I couldn't let the boss know couldn't let everyone know because of that I lost my job and know know one new were I was my brother arsk the people across the road and that's now he found out were I was and went and got my lawyer ho got me out of there and showed that the cop that arrested me lied in his report lied to the judge but all he got was transferred to do it to someone else and to keep him safe
❤ hi Nan great to see your back up veiwing again , had missed your stuff , wondeered how you were going ......great stuff thanks bud .welcome back ..❤
Yeah doing alright mate
This man is a legend. When will you upload more?. I would love a video on steps of standing up for my rights when police officers talk. Thanks G
I would be horrified if my life amounted to walking around and causing unnecessary problems saying things like "Freedom of movement" "I can touch anyones car" You are just wasting their time and trying to piss them off.
Are people not allowed to obey the law.

Sorry to see you not posted in a year.

How can the police investigate themselves?
The King can do NO Wrong
Everybody else is !
Love the way that they claim that Police vehicles are "mine" or "our" and yet when they stop the public they frequently lean against their private vehicles. As you were clearly not attempting to enter or damage the vehicle then he had no reasonable lawful excuse to touch you. Common assault every day of the week.
so true mate, perfectly legal to learn on anyone's car. As a rule I don't touch them but is a cop is dumb enough to tell me I can't do something I'm legally allowed to do, then his ego is gonna get shattered.
Do you have a contact? Have a good place to audit 😊
good to have you back mate keep it up
Bro I'm going up to court in Hastings for refusing a passive roadside test I pleaded not guilty court day is 29/6/23 got any hints?
Is the court day for a defended hearing or a just case management ????
What is the legislative reference? What is the legislative description? Is the charge a category 1 or 2? Was there only one charge? Have you had a case review hearing?
Got the DTs?
This guy must have no job how do you find the time to do this
He's retired.
Great work dude!! Can you do the sydnem police station in christchurch that would be awsome 👌

It's NZ Police's mission to make sure everybody's belted up.
Sorry, let me correct that. It's NZ Police's mission to belt everybody.
that other dude looks like an authorised officer, it’s on the back of his hiviz, any idea what that is?
The one with the radio on his hip is a police officer he is a senior constable due to the stripes on his shoulder. The other one where the hi vis police vest is a qualified mechanic not an actual police officer but has certain powers hence why it says authorised police officer. These guys are known as “god squad”

Sorry I don't get this stuff its not the law I know.
Hi Thank you for your well thought out response
I made a complaint to police they immediately handed it off to IPCA so I withdrew the compliant as I have no time for the IPCA waste of space in my opinion.
Yes correct impersonating a police officer, if is a police employee no offense dosn't have to be sworn, whether he is payed yes/no technically make him an employee, not gonna go there however Section 15 of the Transport Act is possible I have more video of him inspecting trucks, does that make him an enforcement officer?, hehe someone said he looked like Kieran McAnulty MP, but I don't think its him, Police wouldn't provide his details not even his QID which he must have if employed
Reasonable force in the execution of his duties, Its not criminal, but I think I will go the civil route for the assault, 2 years time period for that.
Police investigating their own. What could go wrong?
Greetings from Oz.
I have no doubt they will find themselves perfect.
You sound like a corrupt cop.
Amen

What made you start messing with police if you were an officer once? not trying to be rude just curious.
Do a youtube search for "Auditing".
Its about just obeying the law, and just making sure the govt respect my rights, its the police who mess with me, anyone should be able to go up to any govt car and inspect it, the public paid for it that's you and me. Unfortunately police think they have more powers than they actually have.
