- The plaintiff bought a car and one-year warranty from the defendant. She says the transmission went out and when she went to fix the transmission, he returned the warranty. She’s suing for the cost of new transmission. The defendant argues the plaintiff didn’t know there was an approval process for the warranty, but she just wasn’t approved. He even sent her a refund, so it’s not his fault she didn’t get the warranty.

His whole dealership needs to be audited to see if he's done this to anyone else in the past. If so, he needs to be sued and needs to be shut down and/or go to jail.

I agree. Every warranty he has ever sold needs to have a phone call made to the third party warranty company to find out if he ever bought the warranties the customers purchased.

But it wasn't him. He called the place on behalf of the customer. The judge confirmed someone called and it wasn't the plaintiff. Maybe one of the sales people screwed up?

I own a used car lot. I have sold a couple of warranties with this exact company. I have only been in business since the end of last year and only been a member with C.A.R.S. for about 6 months. But the warranty company seems to be pretty good so far. C.A.R.S. warranties are legit if they are paid for. And I offer them to my customers at my cost just as a benefit if they want one.
All that was missing was his gaudy gold chain. The guy is a scammer and he knows he didn't give the 1,000 to the warranty company. Guarantee you this isn't the first time he's committed fraud while selling a vehicle.

It was a scam from the very beginning, hence the reason that they didn’t provide the purchasers with a copy of the warranty documents from “Cars”. They didn’t want them to reach out to that company, only to find out that they had no contract with them whatsoever.
I own a used car lot and actually sell warranties with this exact company. Once the papers are filled out and the warranty is paid for C.A.R.S. sends the customer a packet of info on what is and isn't covered and a membership card with their name and the information on the car being covered. This is seriously wrong what the salesmen did in this case and I will bet you if they did it once they did it hundreds of times. This is the type of thing that can put a dealer out of business.
If it were me, my reaction would be that someone is going to be fired for defrauding my customers. I would be enraged if an employee of mine did that. His reaction, especially with Doug, was one of a guilty man.

Most of these scammers are sociopaths who believe that they are smarter than everyone else and that they will never be caught and if they're caught they will never be convicted because they are so special.

I own a used car lot and actually use that exact company. I haven't been in business for all that long but I can tell you that the few customers I've sold the warranties to seem satisfied. I specifically asked them to come in and let me know if the company actually covers what they are contracted to or not and so far every one has had positive reports. I also only sell the warranties at my cost. It's just a service to the customer if they want one.

Big surprise that the defendant never submitted the warranty information or the thousand dollars. What a bunch of scam artists purposely collecting money for these bogus warranties that they hope no one will ever try to utilize
This is so common that it is like the number one thing that used car dealers get sued for. They charge you for a warranty but never submit the warranty. If you come in with a problem they either fix it on their own dime or submit the warranty and then make a claim. This is why these third party warranty companies are forcing a 30 day waiting period before the warranty is in effect. If you buy a used car and a warranty you should get paperwork for that. Because she had no paperwork it seems likely this dealer was scamming people out of their money and never buying any warranties.
Devil’s advocate- if the dealership wants to cover exactly what I bought and act as the warranty provider, I don’t really mind. If they want to pay out of pocket and gamble on it, go for it. Either way, I should be covered exactly as the warranty coverage outlines.

I'd love to hear what happened after that week. And one thing I learned in my Civil Law course was that putting "We're not liable" in a contract does NOT free you from liability. If it did, everyone would put it in.

Me and my husband went through this same deal! Bought a truck at a uses care dealer, warranty was through a third party. Engine blew after four months from the purchase. Warranty was denied. We had no money to hire legal help. So we were sunk. It was our only vehicle at the time, so we had to buy a whole new engine. DONT EVER BUY A CAR WITH A THIRD PARTY WARRANTY.

Seen plenty of cases with legit 3p warranty turn out fine.
I purchased a 3rd-party warranty plan when I bought a used Mustang. They paid to have the transmission rebuilt or replaced. I can't remember which one, exactly. All I remember is that the warranty company did what they were paid to do. It probably helped that I purchased the car from a big Ford dealership, because they gave me employee pricing; as opposed to a ratchet, fly-by-night car lot.
You don't need legal help in small claims.
Some people either don't know how to or are scared to go through the process. I always recommend that people chat with legal aid because they will at least point you in the right direction and explain the process so it isn't as daunting. @@mexicanspec

The judge didn't realise she caught him in a lie when he said he had called the insurance company and they told him they were declining the claim, yet when the judge phoned them they said they had never seen that policy, so he lied to the judge, as it is impossible for the company to decline a claim when they didn't even have the policy. He should be in jail for fraud and theft...
His argument at the end makes no sense. He does NOT have a legally binding contract that says he has no liability. That contract was never executed. He never sent the money for the warranty.

This EXACT same thing happened to me! The warranty cost was $150 but they never sent it in with the paperwork and I ended up a plaintiff in small claims for a transmission against the dealer that sold me my vehicle as well! I think it cost him around $3500 (it was years ago so can’t quite remember)
There should be a Part 2 with cases like this. I’d love to see the outcome.

C.A.R.S. is a national company with a decent reputation. The plaintiff was scammed but soley by the defendant. I own a used car lot and have sold warranties from this company. They aren't in a little office where you can work out a mutual scam with someone. You go to their dealer site, fill out all the info and submit it. A bunch of contracts print off and you have the customers sign those, you scan them back into the computer and send them back. Then, at the end of the month C.A.R.S. automatically debits your account for all the warranties you have sold. You, as the dealer collect the money from the customer and most dealers mark those up a few hundred bucks to increase their profit. But the warranty company has nothing to do with this. And they send the customer a packet containing info on what they are covering and a membership card with the customer's name and the information about the vehicle being covered with a membership number. Just image this as getting a regular car insurance policy from State Farm or some other place online. There is no way that the actual company would be involved in the scam.
The defendant knows about the pocketing of the warranty money too bc he lied and said he’s been in contact with the company and they said they deny the warranty because of the age of the car. If he really called they would have told them the same thing they told the judge, “we don’t know wtf you’re talking about”😂😂. Judge should have pointed that out🤔🤔

I own a used car lot and actually use this very company. Everything is done on the computer with no actual interaction with anyone from C.A.R.S. They have specific rules for the cars they will cover and what it costs. If I was to submit a Hyundai for instance that was a 2001 model with 250k miles the paperwork would print off but within 48 hours the company would call and let me know that they will not approve that car for a warranty. But all the info would be there while filling out the paperwork so I would know before ever submitting it that the car would not be approved. They warranty virtually any car that is less than 20 years old with less than 200k miles though so that pretty much covers most of the used car market.
Gosh! Some people are such liars! The dealer actually let the situation get to this extent knowing there was no warranty. This is a shame.

It was very obvious that the defendant is a scammer from the get go but the easiest to spot is: His claim he talked to the insurance company and they said they're denying coverage and made a vague statement about the car being old. BUT! How was he able to have this conversation with the insurance when the insurance side has no information on this car/contract since it was never sent!?! The first thing the insurance company would've done is opened up the account for that car to even have a conversation with the defendant...he was caught there!
Exactly ..the judge could have called him out right there for saying he talked to them and they said the car was too old, because if they had said it, that was only after he called to see if he could get the car on the warranty...which is what they probably actually have record of, and they denied it. He was trying to be slick when he realized he'd have to pay for the car to be fixed and it was more than just an electrical glitch. He probably called them to see if he could get the warranty to be effective that day and get the car fixed knowing the couple had paid them, and they probably told him they never would have even approved the warranty regardless because of the cars age. He never expected the judge to call them to verify. 🫣😝

This happens all the time with used car dealers lol, people just don't know. The judge used the term "roulette" which is 100% what it is. Here is how it works:
The used car dealer sometimes (not every sale obviously) charges a customer for warranty, but never actually purchases the warranty from the 3rd party warranty company (just like this case). They hope the term of the warranty runs out before anything goes wrong with the car, which is how they profit the warranty cost. If something DOES go wrong during the term, they usually just count it up as a lost scam, and pay the money out of the dealerships pocket to fix the problem, and just tell the customer it was covered under the warranty. This is still profitable to them because the amount of scam warranties they sell with no mechanical issues during the term of the warranty outnumber the ones where something actually goes wrong and they have to pay out of pocket to keep it hidden.
What's crazy is usually the warranties they play roulette with are not 1 year unlimited miles lmao. Thats way too long, and something (even small) is bound to go wrong on a used car in that time frame. Usually the warranties they scam with are 3 month 3k mile warranties (the most popular ones from used car dealers). This idiot ruined his own scam by playing roulette with a LONG ASS warranty on an old ass car, and ALSO telling them the warranty was denied, instead of just shutting up and going fully into pocket and counting it up as a loss and just not telling the customer. He figured he didn't want to take the loss of 1,800 (2800 for new tranny minus 1000 he already made from the scam). He was banking on them just rolling over and taking it, and instead they went to court.
This case just touched the tip of the iceberg of this scam, but its a very real thing. Also, this guy has absolutely done this tons of times before.
I own a used car lot and sell this exact warranty. C.A.R.S. sends paperwork to the customer at their home along with a membership card that has the customer info and vehicle being covered's info. So I guess that consumers need to educate themselves when buying this type of stuff. Since it's 3rd party they need to expect some kind of contact from the company after the sale to validate everything. Otherwise you are right that the customer will pay for something they never got.
Is there some kind of law that says that car salesmen have to have that " look ", you know the look, the slicked back hair, the oily, arrogant demeanor, the expression on their faces that just screams predator. So many car salesmen on T.P.C. that have that look. So much for car salesmen and third party warranties.

I'll never buy another warranty on a used car again. I never needed to use it. It's a rip.off. take a mechanic to check your car before purchasing.
It was obvious that the guy scammed them. If he was legit he would have been happy with the judge's ruling because all he would need to do is show that he paid the third party company. Then he can wipe his hands from all the mess. But since he was upset at the judge's ruling, that was a clear sign that he knew he did not have the proof that he needed because he knew he was being dishonest.
Someone in that dealership, is collecting $1000 for warranty for a third party but not paying/filing the warranty with said company..smh crooks
If the defendant had submitted the warranty to the 3rd party, then yeah, it'd be against the 3rd party. But he (or his agent) took her money, never paid for the warranty, and got caught. Given the amount, if she filed a police report, and presuming this his his s.o.p., it could shutter his dealership.
He called the place for a reason. They have a record of a phone call and it wasn't the plaintiff who called so maybe one of his sales people pocketed the money.
The only warranty company who doesn't robo call people.

This is why folks always and I mean always when you deal with warranties, call before, do not listen to dealers bs , call and verify that your vehicle, house anything is cover then you can deal with the rest and never sign a document that you do not get copies. This dealership is selling ghost warranties, God only knows how many more had fallen from this scam.
I think the defendant and his sales people “sells” the customers on a warranty then doesn’t set it up and hopes the customer never needs it and they walk away with the extra 1k that’s charged!
The guy was a liar And scam artist. The judge should have made a ruling immediately since the warranty company had never received anything from the scam artist.
But the defendant lied , he said he talked to somebody ain’t they denied it
Exactly my thoughts. Who did he talk to when the judge called them and they have no record. Liar, scammer! Case closed pay for this lady’s transmission and try again next time
I agree the defendant is a lyin sack of poop but go to 14:40 in the hallway Doug asks the plaintiff twice if she ever rec'd the "Cars" warranty... she says no but her husband goes shifty eyes and pokes her... lol what the hell.
@10:07 the Judge states that the warranty company said they had a record of someone calling in November and that coincides with the time line both the plaintiff and defendant laid out. I'm not saying the defendant isn't a scammer but the warranty company DID have a record of his call. And it is also possible he was too busy greasing his hair to keep track of what his sales staff was doing so he wasn't the actual crook in this situation.
Each time he collected $1k from the customers and since there's a miles/time limit on the warranty, he was counting on the small percentage of customers would use the warranty.
