Shouts erupt in Arizona House as fight over abortion ban engulfs lawmakers

  • The Arizona Legislature devolved into shouts of "Shame! Shame!" on Wednesday as Republican lawmakers quickly shut down discussion on a proposed repeal of the state's newly revived 1864 law that criminalizes abortion throughout pregnancy unless a woman's life is at risk. The state Supreme Court cleared the way on Tuesday for enforcement of the pre-statehood law. Arizona abortion providers vowed Wednesday to continue service until they're forced to stop, possibly within weeks. House Democrats and at least one Republican tried to open discussion on a repeal of the 1864 abortion ban, which holds no exceptions for rape or incest. GOP leaders, who command the majority, cut it off twice and quickly adjourned for the week.

      If you had a magic wand you wouldn't have been able to get Donald Trump and Kari Lake to flip so fast on this issue. Donald Trump said he worked to get Rowe V Wade overturned so it could go to the states. BUT...he just said AZ went to far and HE will fix it. He's not a judge in the state of Arizona, he's not in the legislature and he's not even a resident of Arizona, how would him "fixing it" be it going back to the States? And let's be frank, if it's up to the states, it's up to the citizens of the states not the tiny tiny minority of Judges or Legislators but the actual citizens.

    I’m a 77 yo woman, so I don’t have a dog in the fight, but I’m extremely angry for the women this will affect. Women are not second class citizens in this country, and we will not accept this move to take our rights away. It is a dangerous, controlling action that will be fought.       This doesn’t effect the current abortion laws one bit. This didn’t change any laws it just ruled that banning abortion is legal. Its literally only saying that it could be a law not that it is a law. It needs to go through the process of being proposed and voted on before anything actually changes. Which is unlikely considering the outcry.

    Arizona needs a top-drawer RICO or civil class action lawyer to sue the perpetrators (Alliance Defending Freedom, Brnovich, Hazelrigg, et al). There were 2 laws on the books, 15 weeks and 1864. The 1864 law was chosen with intent to physically harm women. Women who miscarry or have problem pregnancies won't receive healthcare because hospitals/doctors will be too afraid of jail. Corporations are sued for millions who make choke hazard toys. Doctors are sued for millions for malpractice. Let's stop being shocked and start charging. The only way they'll learn. The stupid justices couldn't have ruled if the case wasn't put before them.

      The decision to uphold the 160-year-old ban on abortion came down to four of the seven Arizona Supreme Court justices.
      Two of the seven voted against it, and one abstained. The five men and two women were all appointed by Republican governors.

    What this means is a lot of young women that will die because they can't get the life saving healthcare they need. There have already been providers that have turned away women needing a clinical abortion to make sure all of a natural miscarriage is gone before sepsis sets in.For those that do not know what that is ,it's a deadly infection from tissue the pregnancy that did not leave the body and is rotting inside her,killing her painfully. This only affects females from 11-50. ...and their children, families parents, husbands, friends, so it isn't just a women's issue. Women will avoid getting prenatal healthcare because every pregnancy is tracked and they are legally going after women who miscarry. Besides being devastating now,a natural miscarriage is criminal. This isn't a win for life. It's stupidity, cruelty,pain ,suffering, and death. For half the country. The female half. We have been betrayed by the Government meant to protect us.

    It is well established law in all states (except Arizona it seems) that when a legislature passes a subsequent law on the same subject, it implicitly repeals any prior inconsistent law on the subject. Arizona passed a 15 week abortion law in 2022. So, it took some mental calisthenics for the justices to conclude that that the 1864 law in fact superseded the 2022 law.

      Arizona wasn't even a state then. They allowed 9 year old to "consent" to marry old men at that time, women couldn't vote among many other beyond antiquated ideas and laws. These judges need barred. There is a law from that time that anyone can force a hearing to remove them. That should actually happen

    Arizona...my home state for all but 5 years years of my life (from 15 - 20 years old)
    I have always been at home in Arizona. Red.....but red with intelligence and morality on right and wrong. Not being that extremist on either the left or right. A nice balance of social issues, as well as the rule of law. Keeping government to a minimal.
    This is an overstep. TOO MUCH of an overstep. WTF is wrong with our senate? I am 45 years old. This law predates me by over 110 years! Almost 50 years before we became a state in 1912! No law put in before we were a state. This law was set in not even a year after we reached territory status. What kind of horse hockey BS am I witnessing?
    For those who might not know the dates of our history in AZ.....
    We became a TERRITORY in 1863.
    We became a STATE February 14th, 1912. (For perspective in time...we became a state 1 month before the RMS Titanic struck her iceberg @ 11:40 PM. (She sank around 2:15 AM on the 15th))
    This law was put on our books in 1864. That is a year after our territory status, and 49 years before we became a state.
    Let that sink in.

    I remember when the Arizona State Senator & a mom Eva Burch talked about getting an abortion on the Arizona Senate floor. Because she has a non-viable pregnancy the GOP Senator walked out of the senate floor, they did not want to hear about how hard it is for her to get an abortion, because of the Arizona abortion law. Because in the past she had failed pregnancy in the past.

The current administration has been operating on a razor-thin majority in the Senate, and two of its members were so dead set against getting rid of the filibuster that they could not even get sensible voting rights legislation through. No way they could have forced through abortion rights laws that would require 60 votes in the Senate to pass.

    The Arizona Supreme Court didn’t do anything wrong by upholding this law. I’m sure there are other laws on the books from the territory day. And the Republicans that control the State house are under no obligation to drop everything and take this up. Eventually someone will introduce legislation to repeal this law. It will pass through the Legislature, or not. And the governor will sign or veto it. This process doesn’t happen in 5 minutes. I have had my life impacted negatively by government legislation. Mostly at the Federal level,and nobody gave a damn because it was economic instead of social . At least it’s a government closer to home you have to deal with instead of 3000 miles away.

    Thanks @ABC15 Arizona for posting this video about affirmative action / supreme court. Here are the viewpoints expressed by Supreme Court justices regarding affirmative action.
    1) This case is about a group called Students for Fair Admissions (SFFA) who sued Harvard College and the University of North Carolina (UNC). They said that these schools were not fair in their admissions process because they were using race as a factor, which they believed was against the law. The law they referred to is the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment*.
    2) The SFFA argued that considering race in admissions did not treat all applicants equally under the Equal Protection Clause.
    3) The Court found that the admissions systems at Harvard and UNC did not pass strict scrutiny and did not have a clear end point.
    4) In the end, the Court decided that the admissions systems at Harvard and UNC were not fair and did not follow the law. They said that the schools' use of race in admissions was not allowed because it was not clear, specific, or fair enough.
    5) However, the Court noted that schools can consider the impact of race on an applicant’s life experiences.
    6) So, the Court decided that the SFFA was right. They said that Harvard and UNC were not treating all applicants equally in their admissions process, which is against the law. They said that the schools needed to change their admissions systems to be fair to all applicants, no matter their race.
    *The Equal Protection Clause is a part of the Fourteenth Amendment that says that every person should be treated equally by the law, no matter their race, color, or nationality.
    *Strict scrutiny is a way for the courts to look at laws to see if they are fair and necessary. If a law or policy is found to be unfair or unnecessary, it may not pass strict scrutiny and could be considered unconstitutional.

    What a stupid supreme court ruling. I'm moving to AZ soon and will sure vote anyone that will protect abortions bc this is absurd. Republicans need to step it up on protecting abortion rights.
