  • Doctors in 1864 did not yet understand basic medical hygiene protocols and even the basics of reproduction on a cellular level were still being sorted out. But now Arizona women have to live under abortion restrictions that were passed at that time.

      Yeah that’s insane they should have just outlawed it if they didn’t want it in South Dakota, though at that time Roe v. Wade was in effect so they couldn’t. I guess it just shows how far people are willing to go to try to save people who haven’t been birthed yet, I don’t think good ends justify bad means though so yeah good thing Roe v. Wade was overturned so states can decide for themselves the laws for their state and people aren’t trying to pass a law where you can legally murder someone of a particular profession. Although at least they are being ideologically consistent in their view because they see abortion as legal murder so they wanted to make it legal to murder legal murders. Still is egregious though to make that bill. Thank God for the overturning of Roe v. Wade so states can decide for themselves and violence from both sides is minimized and some resemblance of peace can be had. Thats good governance in a nation that hasn’t had much good governance lately.

      They had no pregnancy tests at that time, no ultrasound, and no way to hear a fetal heartbeat. Because of many factors like poor diet or the medicines they took such as mercury and lead, period timing was unpredictable. The only reliable measure of pregnancy was "quickening," when the baby can be felt moving. This usually happens at 16 to 20 weeks.

    Article VI, Paragraph 2 of the U.S. Constitution is commonly referred to as the Supremacy Clause. It establishes that the federal constitution, and federal law generally, take precedence over state laws, and even state constitutions.

      Yes, and that’s why overturning Roe has had such a devastating effect on the country, because now there is no federal law that can protect women from forced-birthers enacting draconian laws like this, where a woman can’t even have surgery to remove a completely nonviable embryo from her uterus. Something that has zero chance of becoming a baby. Now she has to wait until she becomes septic and is about to die (“to save the life of the mother”) until a doctor can perform a D&C procedure aka an abortion. If it’s too late, and that woman dies anyway from sepsis and can’t take care of her other children who have already been born, or has such damage from septic shock that she is infertile, loses her limbs from infection, or myriad other horrific complications from letting an infection run rampant in a persons body, than that’s what has to happen. Laws like this don’t take into account all the nuances that can happen when a woman becomes pregnant. And doctors aren’t given the latitude because of the way the law is written to make the decisions that are needed on a minute by minute basis.

    When this law was enacted, it would still be another five years before the Transcontinental Railroad was completed and somebody could take a train/s between the East & West Coasts. Back then people travelled by Stagecoaches and nowadays, we think nothing about flying across continents & oceans in hours. Heck, it would be another 18 years before Thomas Edison out open the Pearl Street Station, the first centralised, commercial Power Plant, in lower Manhattan.

    If you want to get rid of ancient laws that no longer make any sense in today's world, how about at least modifying the Second Amendment? You know, the one that was passed in 1791, 233 years ago?
    1791. When the best available firearm was a Musket. An un-rifled, smooth bored, barrel loading Musket with an effective range of only 50 yards and a rate of fire, in experienced hands, of just 3 rounds per minute. Not a Semi-automatic with an effective range of about 600 yards and a rate of fire of 45+ rounds per minute. Or even more if the Shooter can pull the trigger faster. Or a powerful handgun that can be concealed in a pocket or a belt loop.
    Just a thought. 🤔

      We should require that gun owners be members of a well-trained militia available to protect their state and state government at need. Sort of like a volunteer guard that trains in case there’s some kind of emergency. Yeah, each state could have its own Guard. Since there’s already lots of cops, they should also be training to act as rescuers and first responders for non-shooting emergencies, like floods or earthquakes. Gun owners could each have a 6 chamber bolt action rifle and a similarly low capacity, lower speed handgun. They would have to spend a few months training full time so they can be evaluated for competence and character, and then spend 1 weekend a month training or volunteering in a relevant task.

    My wife just gave birth to our third child. It's amazing how progressive little babies are: They always want to be on the move - they prefer if the stroller is moving. They prefer being held while their mother and father are moving. They thrive on mixing things up and changing their scene.

      Yes, the Selective Service exists, and it is still in force for gaining legal rights. The problem is that this is compelled service in a volunteer law enforcement position. The volunteer law enforcement group no longer exists, but if that law is on the books, every male could be fined from $50 to $1000 for simply living in the state because the law is still on the books, and their Supreme Court is crazy enough to force that statute to be real. This is probably never going to happen because their Supreme Court has no bias to make that statute a reality. The problem is that it exposes the bias as the Supreme Court actually did it for the abortion statute. Selective enforcement of law compared to those repealed or amended.

    This is why judges and politicians should not be allowed to serve a lifetime term position for their backward ideologies, that's what senior retirement homes or insane asylums are for.

      New Mexico lucked out in that it's population centers were north of the Union/Confederate divide during the Civil War. AZ is pretty much Alabama but without the southern hospitality.

      AZ was a territory and had quite different borders. The north half of the territory was Union and the south half was Confederate. And NM clinics aren’t “booming.” They’re overwhelmed.

    You fail to mentioned that pro abortion laws unequally affected minorities. Yes history and the mindset of people then were positive in some areas and not good, to say the least, in many other areas. We have the luxury, today, of looking back, and judge that time.
    How will people judge our time 70 years from now were there is more and more pressure put on to allow the killing of the unborn as well as the just born.
    Devaluation of human live and the human spirit is pervasive and unconscionable.
    Imagine a time when the magnificent human embryo becomes so valuable to a community that if any parent at a difficult time in her life can totally rely on that community to take full responsibility for that life.
    Politically, corporately and economically the human being has been commodified and has no more unique standing in this world as it should.
    It is for this reason that, for example in Canada, assisted suicide can be accomplished for young and old alike.
    We in Canada have the highest legal assisted suicide rate in the world.
    If we can do it to the most vulnerable, the unborn and the one just born, then we can do it to anyone.
    Yes we are a society in decline and have not reached the bottom yet.
    It will be disastrous.

    There were 1,026,700 abortions in America. The most in over a decade and the first time over 1 million babies were aborted since 2012. There are over 2813 babies aborted daily in the country and I still h want seen a post with the names of the women who have died because they can’t get an abortion. I’ll pray for you all.

      Not quite all but the branding is still actively used because people still raise and brand livestock and people still steal them. They might have been amended in potential imprisonment but not much. Also Murder laws came from way before then. I personally think that law was for specially protecting women from an abusive relationship because 1 they recognized it as a life 2 they were settling a Territory that took Months for people to get there sometimes required populations to grow. As a military/Law social and economic necessity.
