Legal question here, If a man who has been born and is alive and a fetus have the same full rights under the AZ law, but the women however does not have the same rights when she is carrying an unborn fetus who has the same full rights of a male who has been born and is alive, but then what if that fetus is a female? Then does she, the fetus have the same rights or does being a female fetus make her like a living fully alive female who only has some rights, but not the same as a male? I'm not sure how you can give an unborn fetus more rights that the already fully alive women carrying that fetus. How does that work?

If they're going to use an 1864 abortion ban, they should have to use 1864-level medical knowledge to determine when a person is pregnant! They had no pregnancy tests at that time, no ultrasound, and no way to hear a fetal heartbeat. Because of many factors like poor diet or the medicines they took such as mercury and lead, period timing was unpredictable. The only reliable measure of pregnancy was "quickening," when the baby can be felt moving. This usually happens at 16 to 20 weeks.

It seems that the majority of the Arizona Supreme Court have forgotten a basic principle of legislative interpretation - a later law on a subject trumps an earlier law on the same subject and so courts must interpret the two laws to give effect to the later law even if it does not expressly over rule the earlier law.

Doug Ducey signed a bill in 1922 that had language stating if Rowe was overturned then it would automatically trigger the 1864 law into place in Arizona. Once again men with no medical degree or background or knowledge of women and what happens in our bodies when we are pregnant and they are making laws from the 1864 Supply to us now. Legal question here, If a man who has been born and is alive and a fetus have the same full rights under the AZ law, but the women however does not have the same rights when she is carrying an unborn fetus who has the same full rights of a male who has been born and is alive, but then what if that fetus is a female? Then does she, the fetus have the same rights or does being a female fetus make her like a living fully alive female who only has some rights, but not the same as a male? I'm not sure how you can give an unborn fetus more rights that the already fully alive women carrying that fetus. How does that work?

When Obama spoke at ASU, I cancelled my classes and told my students that if they went to see him speak and wrote something about it, I would give them extra credit. I don't usually offer extra credit, but I knew something historic was in the making. Finally some proper analysis of the decision although it fell far short of what is needed.
It seems that the majority of the Arizona Supreme Court have forgotten a basic principle of legislative interpretation - a later law on a subject trumps an earlier law on the same subject and so courts must interpret the two laws to give effect to the later law even if it does not expressly over rule the earlier law.
As a man I really don't get how people can so intrusive ly be in the personal business of others. I would point out ALL of this measured against the Preamble of the Constitution of the United States does NOT promote "justice" "domestic tranquility" or a "a more perfect union". Someone needs to revisit Roe

It's grotesque that the judges ignored a 21st-century Arizona law allowing up to 15 weeks, in order to reach back to 1864 for something they liked. As bad as Alito going back to the early 1600s English witch hunter for support for overturning Roe.
