Arizona Supreme Court Revives 1864 Abortion Ban Passed Before Women Could Even Vote

    In a historic ruling, Arizona’s conservative Supreme Court has upheld an 1864 law banning almost all abortions in the state. The court sent out this warning: “Physicians are now on notice that all abortions, except those necessary to save a woman’s life, are illegal.” The 160-year-old law predates Arizona becoming a state and was passed decades before women could even vote. Although Arizona’s Attorney General Kris Mayes said she will not enforce the “draconian law,” the ruling sent shockwaves across the nation. “The central strategy of the anti-abortion movement is to roll back the clock to the Victorian era, because they know that they cannot win through the democratic process,” says Amy Littlefield, abortion access correspondent at The Nation, who says conservatives supporting these unpopular restrictions face an uphill battle this fall. “Democrats are banking on this being a huge way to lift their boats in the next election.” Activists are preparing a November ballot measure to enshrine abortion rights in the Arizona Constitution, and reproductive rights will be a key issue in the state’s closely watched Senate race.

      It gets even crazier. A judge appointed by Lincoln while the territory was still a contested Civil War battleground just created the law from the bench. It wasn’t even created by an elected body. It was created effectively under martial law.

    the 1864 abortion ban was enacted before women or black people could vote. This document should be disqualified and held in contempt as it does not represent the will of all the people in Arizona today and violates both the 14th Amendment and 19th Amendment. This is how far our dear Republicans will go to satisfy their own beliefs over the majority.

Sure I may be white in appearance (I am mixed) but my cousin was killed by the abortion ban and she was black. Her child is left motherless and fatherless because of the abortion ban in her state. Forced pregnancy is and has always been a form of rape and slavery that my cousin’s ancestors were forced into and the fact that you want that back is disgusting.

      There's no scientific consensus on when human life begins so your point is moot. Once a fetus is born it has the same rights as everyone else. Giving it rights over the woman carrying it denies the human rights (bodily autonomy) of women and girls.

      This is about a difficult decision that a rarely happens in a woman's life time, this is about a womans right to choose how to deal with said situation.

    This is a prime example of a lack of separation of church/religion and state. I think the right to choose is a personal one and lawmakers making laws based on religious beliefs should be voted out of office. That said, I think the financial cost of the procedure should be on the burden on the individual and not the state unless the result of the pregnancy was due to a documented assault. The argument that a life is being taking should only be had between the person seeking the abortion and their higher belief system and no one else. The law should be at the federal level to allow women the choice to choose. If anyone disagrees and wants to counter the comment I will not entertain anyone with a response. I said my piece on the the topic and my opinion won't change.

      After looking up what fetuses ACTUALLY look like to 12 weeks, I'm like "naw, nope. Not a person."
      Which the personhood thing is irrelevant in my mind. If I needed to hook myself up to my mom for 9 months to survive - I would not have that right without her consent. I don't see why fetuses should have rights no one else has.

      Let's see... there were seven on the panel, two women and five men. Four voted in favor, including one woman. Two voted against, including the other woman, and one recused himself after an anti-abortion post he made surfaced. So 57% of the total staff voted in favor, and 75% of the votes in favor were men.

    you should see how they help their homeless in the state of Az .. I see it first hand.. they rather put funding towards useless art centers or multi billion dollar light rail systems that hardly many people ride.. last year in the summer I brought a 75-year-old guy to a homeless shelter after trying to fix his vehicle that he was sleeping in well anyway, the motor completely shot he ended up having to junk it, I went to the shelter in Mesa. Do you know if they told him when it was 115° out that day only women and children... I actually looked inside. There were only like one or two people inside at the time the facility could have helped him but instead I let him sleep in my car that night I told him I can't do it the next day, and drop them off by the local library... yeah, help in Arizona is pretty pathetic, the qualifications to even collect anything is pretty crazy and they actually will give you money for being a refugee but not if you're an actual person that needs help and you're a citizen I find that interesting to... but yeah, there are other things that Id like to say, but I'll leave it alone.. the only thing that is pretty good that's coming out of what's happening is the police seem to be getting better in the way they're handling the public now. More forgiving and lenient... mainly because they have major lawsuits. I think they're reworking the system.. as for abortion there should be a rule,, anything up to when a baby can survive on its own outside the womb world record is like five months.And a week .. the baby was saved, but it still required heavy prenatal care.. make the cut off time five months that's more than enough time after that, you need a doctors note to save your life or serious complications. Five months is more than enough time ,, there should be rules in place. But yeah, you should never remove it. And forgive me for any mistakes with the punctuation. I'm using talk to text. Doesn't always work correctly.

      How Did the Judges Vote?
      Justices John R. Lopez IV, Clint Bolick, James P. Beene and Kathryn H. King voted to enforce the 1864 ban. Lopez wrote the majority opinion.
      Chief Justice Robert M. Brutinel and Vice Chief Justice Ann A. Scott Timmer voted against enforcing the ban, with Timmer writing the dissenting opinion.
      Associate Justice Bill Montgomery recused himself from the case in November 2023 after an anti-abortion post from his Facebook account surfaced. Montgomery denied a motion from Planned Parenthood to recuse himself but later reversed his decision, citing "additional information" coming to light.

    Pro choice or pro life aside, I find it scary that the attorney general is openly allowed to say her office will or will not prosecute anyone because of her personal beliefs. I thought those people took an oath to preserve the law. My concern isn't about abortion directly, but more so the attorney general.

      This law does not fully make exceptions for the health of the mother. She has to bring the pregnancy to term and suffer through her pregnancy before its "the life of the mother"....which we saw in Texas, is subjective.

      @SDA704 do you know why the Supreme Court ruled against Roe v. Wade? Biden ran on a few things, and I'm sad that you were scared into voting for him for one issue when we have several. A president can have the best impact when we have a congress that actually speaks for and not against the people it represents. However, people vote for Bozos due to one letter or silly culture war issues. A lot of people and politicians weren't pushing it to become law for various reasons and some were waiting on their time to shine.

      @SDA704 if you care about women's rights. It makes more sense to look at state levels than federal. Even without bans many states made it difficult to have access. Texas does everything to make it harder for doctors, MO used to have 1 I think. Even if it were legal federally what does that have to do with the conditions set forth in the state. Presidents aren't miracle workers and its time people pay attention to who is on their local ballots messing up their states.
