    Fun fact: Mario Royale kept coming back after the DMCA situation, many devs took on the game and boy it had it's controversies, I was a spriter for it, but then after a while I backed down with Infringio on-hand. It was a wild ride, hope everybody involved is doing well. Awesome video 👍

    Foxen did NOT use SM64 Maker to make Cursed Castles. SM64 Maker is a simple (yet impressive) tool to place objects, platforms and stars in premade themes. It is not a tool to make a full hack. Foxen played around with it a lot, and that probably inspired him to make Cursed Castles. But the hack itself was made with Sketch Up, Rom Manager and other tools over a period of a couple of years.

      Thanks, yeah this pretty much sums it up. I did make some sort of simplistic versions of Permafrost Palace and Cozy Quarters in Mario 64 Maker before I started work on the actual romhack. It's nice to have been mentioned though :)

I thought I’d mention it and give you a little shout-out, but it looks like I should’ve checked with you. Not Kaze’s fault at all, I guess he just misremembered - it’s my job to fact-check, not his.     I would like to point out that, despite Nintendo's reputation, there is a common theme to all of these C&D letters. Whatever coverage the games received, the letters (for non-Pokemon games where they only co-own the property) all arrived *after* the game was released on the internet.
    SquareEnix, on the other hand...

The creators just can't profit from IP infringement. Nintendo is doing thel least they are legally required to do.

    Man. Getting the DMCA for my Mario fangame really stinks. I put a lot of heart and soul into my game. Until Nintendo is like, "Nope no fangames for you." I was very sad when that happened. But that doesn't stop me from making games. Instead of me making fangames I instead worked on my very own game and still am. So yeah I moved on from making a fangame to making my own game.

      that is what they want you to do, after all. Stop getting as much attention and love for your game by using their franchise. I respect and support developers that take their fangame and redo it to be more original, but we all know that many (most, possibly) lose interest in a project when that happens.. because they were only there "because its a mario game".. sad but true!

      If Nintendo won’t give us a well constructed method to play old games in modern day than I will continue to download their games as much as I want.

      @Spookyu !! *super mario 64 already had rumble in one of the versions. It's a weird amount of effort though, they didn't do the absolute bare minimum and keep them in their original resolutions and aspect ratios but they didn't do a lot of presumably fairly easy things like 60 FPS sunshine and 64, increasing draw distances and LOD distances to counteract for the higher resolution and widescreen for 64. Also they could've mixed the two versions of 64 so it was the same as the original just with rumble and nothing else

While, yes, I was referencing SM3D All-Stars (the limited release is what bothered me more than anything else), other game companies, besides Nintendo have benefited from rom sites preserving their games better than they have. Kingdom Hearts was famously re-made for HD because Square Enix didn't preserve the source code, and the Game Boy Mega Man games were simply pulled from a rom site and slapped onto the 3DS eShop because Capcom lost those games too. If my information is accurate, that is.

      This reminds me of the time when Nintendo took down a fanmade Metroid 2 Remake, and people were pissed. Then like a year later it was revealed that Nintendo was actually making an official Metroid 2 Remake. So the take down actually makes sense for that game.

    Nintendo clearly haven't met me. I'm the sort that, if I get a dmca, I'll simply tell whoever sent it to f off and will just continue making whatever I got the dmca for. I can't be stopped.       In Nintendo’s eyes, it not being for profit doesn’t matter. See, if they make Super Mario Maker and sell it for $60, and a fan makes Super Mario Maker and gives it away for free, someone might be more likely to just play the latter instead of paying money for the former.
      Not to say it holds much water, but I think that’s how they think.

Mario 64 online at least make sense on how that would hurt their sales since it's pretty much directly competing with the regular Mario 64 but the maker and basically mod don't really seem to be hitting that same area.

      @@YdenMk-II Does Nintendo honestly think people are going to download an experimental port of Super Mario Bros. for the Commodore 64 instead of playing an official version? Did they look at that and think "mhh yep that's gonna tank our Nintendo Switch Online sales."
      If Sega, a company that made roughly a quarter of what Nintendo did last year, can openly embrace fan creations like this without losing a ton of revenue, then Nintendo can easily ignore ROM hacks of a game they won't even make available for more than a year. Of course they're in their right to protect their precious IPs but is C64 Mario Bros. REALLY going to make Nintendo go bankrupt?

      @@adirblazkowics7717 They are working on it still, an update back in 2017, but progress is slow, it takes time to develop a proper story, characters, and they're making mostly original assets, so it'll take more time, hopefully I'm up to date with progress, haven't searched for it recently.

    Now I'm curious for a video about SEGA's DMCA takedowns.
    From one side we have the Sonic Retro community/website, as well as SAGE and SHC, and certainly others. And both Sonic Mania and the mobile phone Sonic ports have roots in the fan-game community.
    But on the other side we have the amazing fan-game Streets of Rage Remake taken down.

    I'm surprised there was no mention of Super Mario Bros. X during the Mario Maker segment. That was a fairly popular fangame which released a few years before Super Mario Maker, and boasted a VERY in-depth level editor (which *still* dwarfs SMM2), along with three full campaigns built-in.
    Though then again, if Super Mario Bros. X didn't get DMCA'd, Terraria wouldn't exist. Same developer.

      Terraria was only a month out from when it would eventually release when Redigit received the C&D for SMBX (although Terreria did release earlier than intended because of the leaked alpha).
      but even before that Redigit had made it pretty clear that he didn't have much intention to continue SMBX updates.

    What I don't understand is how he said at the beginning that only remakes of their own games get DMCA'd usually, yet the video includes a fan version of No Man's Sky which is not at all a Nintendo game, as well as Last Impact which also has it's own levels. The 64 Online and 64 Maker stuff I get, but not those.

    I always find DMCAs to be a bit funny. Sure take down the source content, but once one person has downloaded it, you just throw it on a torrent and apply some encryption, and you're good.

    I honestly don't understand why Nintendo DMCA some of this projects. HD remakes I get, because maybe eventually they will either port the old game to a new system or just remake the game altogether (like what happened with AM2R and Samus Returns), but with demakes and sequels? Why do they care?
    "Oh, some fans made a lesser version of our game for an incredible niche and old console no one plays anymore! We better just put a stop to that!!" Why the fuck do they care!?
    And same thing with sequels, so someone made a fan made sequel to a N64 game. Good for them! Let them do it! Why do they care?

    It really sucks Nintendo has a really bad connection with fan games like how a successful dad doesn’t like his own son attempting to help his dad’s workforce and coming up with really cool ideas, but because they’re not the professionals, their ideas always get shut down. I know this will probably never happen, but I just hope Nintendo will be less anti-consumer, because being more open to your fans WILL make more people into you!

    IIRC Kaze would actually upload full .z64 ROMs, not just patches. He doesn't anymore, but that always seemed like something that's forgotten and not mentioned.
    You also have to factor in how even if a number of these creators don't sell their fangames, some of them did accept donations or played ads - which is basically profiting off it.

    It should probably be noted that Kaze has (had?) a Patreon that directly advertised it was for his SM64 hack production. My guess is that Nintendo considered that close enough to making money off of Mario.

    There's also a fangame that was met with a DMCA named Super Mario Bros. X that has a level creator in it that came along years before Super Mario Maker on Wii U, with the DMCA in question being the host website's original address before an X was added to distinguish itself from Nintendo's 1985 NES game, but the game does live on and has a sequel named Super Mario Bros. X 2.

    I'm a veteran of MFGG and I've been making Mario fan games for over 10 years. I'm glad this video is made to let the rest of the world understand the actual situation. Yeah, out of dozens of projects, I only got DMCA'd once. I want to forget that project for it has a very bad taste. It was a mobile runner game for Satoru Iwata in 2015 but it's poorly executed.
    If you want to know some well known projects that were never DMCA'd: Mario Blue Twilight DX (was mentioned on a TV), Toad Strikes Back, Psycho Waluigi, Paper Mario 3D Land, Super Mario Flashback, etc.
    I made a fan game last year, it got some attention but I never got any attention from Nintendo: ruclips.net/video/8ZL53sWlx74/видео.html
    Maybe that's a weak example, I am the creator of the awful series called Mario Turd Feast. Several big RUclipsrs played mine and I haven't heard of Nintendo sent me any DMCA notices. But still...I want to forget Turd Feast exists.

    fun fact: one of the main features of the mario royale mentioned in the final clip was that it had multiple skins players could choose from. it had a discord server where members could submit skins, and the devs would add it to the game. me and a few friends actually wound up making some skins before nintendo took the site down. the skins i made was the angry sun from smb3 and the angry sun from nsmbu, as well as king dice from cuphead. seeing it being mentioned in this video basically gave me vietnam war flashbacks lol

    It just doesn't seem fair that Nintendo does something like this! It's kind of like some company rips apart a drawing a kid drew all because it had their copyrighted character in it! I can understand why Nintendo is doing this sort of thing, but they have gone too far with these DMCA's.
    I remember watching a play-through of Skelux's SM64 hack, Super Mario Star Road, and the person I found that did a let's play on it, which at the time I had found the let's play had been up for about two years. A couple months after watching through his entire let's play, I had seen that Nintendo had blocked all the episodes for copyright, which I thought was unfair. A couple months later, he reuploaded all the videos into unlisted, which thankfully were not on auto-block, which is great since that meant he could just reupload the videos without any initial issues. When he reuploaded his let's play, he had a notice at the beginning of the first episode, stating that he believes that the take down was caused by him linking the download link to the rom. So in order to avoid having this happen again, he didn't put in the download link.
    Presently, I haven't had any issues with Nintendo taking down any of my videos or blocking them for copyright. I had seen that they blocked a lot of music from GilvaSunner's RUclips channel, but some of those same music tracks are still available from other uploaders who seem not to have any issues at all.
    Something I think that should be said to Nintendo would be "If you would have made this game yourself, we wouldn't have to do it for you." And maybe also, "If you are thinking about filing a DMCA on this fan-game, you better change your mind. If you don't want to change your mind about DMCAing the game, it's too late for that because the only thing you could have done to prevent yourself from having to change your mind about the DMCA is not conceive of the idea in the first place."

    I really wish that one of the penalties that could have been levied on Nintendo for various things they've done wrong - for example, its bullying of rental stores back in the day - would have been to permanently ban them from DMCAing anything or even protecting their copyright in any way, shape, or form.

    nintendo are full of shit. remember when they had a 'partnership' (extortion) on youtube where they would get HALF an entire channel's ad revenue if they did LPs of nintendo games, or 70-100% of ad revenue when they claimed a video that had nintendo stuff in it? I sure as hell remember. and that was considered a step up cause before that, they'd sometimes just copyright strike/DMCA takedown channels that had nintendo stuff in it.
    also what they do with the DMCA is illegal in cases where someone uploads video to youtube of a fan game they've made. they can only get away with performing such illegal activities because counter claiming goes to court and lawyers are ridiculously expensive.

      That game looked great, until the base game with 8 characters costed LESS than the 4 DLC characters combined, which was bullshit
      The devs promised more content after the early access, but they failed to mention that it wouldn't be free and that the base game, was in fact, just 10 minutes long
      I got the game for free but i refused to support it by playing, now they added modding, but i honestly don't trust them anymore

      You then get sued and Nintendo sends one of his 50 lawyers to meet you, you essentially loose a lot of money for hiring a lawyer, and even IF you win a court case, they can sue you again the next day
      It's literally an impossible battle entirely dependent on the participants wealth, which a common modder obviously can't match

    I love how Josh was thinking on basically doing an online version of Super Mario War inside Fullscreen Mario. Too bad that it got DMCA'd (and that SMWar stopped getting updated with the tragic passing of its author)
