    i'm the guy that originally started the P+ project and i wanna say that your explanation of how nintendo basically ruined Project M is the most complete and accurate summary i've come across yet, at least from what i know about what happened. another thing worth mentioning would have been VGBootCamp (GimR) removing all Project M VODs from their channel in hopes of nintendo collaborations for tournaments.

    My advice for anyone making mods for Nintendo games or Rockstar games games DO NOT ANNOUNCE THEM BEFORE THEY'RE COMPLETE, I know if you make a big mod you want to make it known they exist but when it comes to these two companies announce your mods AFTER they're finished so they have a chance to be spread around before possibly being annihilated for eternity, like AM2R

    I find it funny how so many Pikmin fangames have been made, but barely any (Maybe none, i'm not sure) have been taken down. shows how much Nintendo cares about Pikmin.

      While Nintendo didn't file a lawsuit, they did send a legal threat according to the composer Chris Huelsbeck.
      So no, the word "only" has never applied even in 1987.

      Many ripoffs are often made overseas, especially in places like China, and as such it is either impossible or way too expensive for Nintendo to pursue legal action since the copyright laws of Nintendo’s home country do not apply overseas

    Interesting enough, Some of the fan games are still available for download. But the one thing that really needs to stop is Nintendo's broken DMCA bot and Nintendo's DMCA team in Japan. Also, for some weird reason they haven't been taken down re-uploaded musics which leaves us to interesting theories and questions about their DMCA bot that's broken

    Something I think people should keep in mind is that the copyright laws in Japan are really weird and have not been changed in a long time. The laws pretty much say that even the tiniest use of someone’s intellectual property is copyright infringement and that is must be gotten rid of. That is why you will see Japanese companies do things like this that seem completely uncalled for. I’m not saying this to condone what Nintendo has done, but to sort of see where their mindset is at.

      @@bucketbutters866 Sega does the same thing. Sega of Japan shut down the fanmade Streets of Rage 4 game. All the fan endorse stuff is mostly Sega of America or whatever. Sega do the same thing as Nintendo, but only the Japanese departments because of what OP said before.

    Non-fun fact: Nintendo doesn't just send cease and desist to fan games but to online tournaments, products, and even RUclips channels. They send a cease and desist to the big house after they were going to use a special mod called slippi for Melee. A person called captain Alex created special Joy-cons in tribute to Etika who is a Nintendo fan. Unfortunately, Nintendo demanded that the Etika Joy-con must no longer be sold. And then, RUclips creator SML got a cease and desist from Nintendo, telling him to stop using their Mario plushes because he uses them inappropriately.

      Nintendo was actually right in taking these joy-cons down. Starting from this question... Why Nintendo would take down a third party themed joy-cons? Because there's a lot for sale and none was take down.
      The creator of the "Etikons", didn't had the rights to make these joy-cons, because the actual person passed out. Also, the creator of this custom joy-cons was trademarking and actually thinking in getting money from a thing that wasn't of his.

    Honestly I wouldn't be surprised that if Uranium were a modern fan game, then it's development time would be much shorter. The game started development in 2007 (since it released in 2016 after nine years), probably using Flameguru's Pokemon Starter Kit (basically Pokemon Essentials before Pokemon Essentials was a thing). The fan game community would have been massively smaller, and there wouldn't have been as many QoL features and tutorials (especially since RUclips was still pretty new at the time). Nowadays you have plenty of tutorials and public scripts for Pokemon Essentials.
    I think the main reason why Uranium was taken down was because it got super popular. Pokemon fan games/rom hacks ending up like Uranium and Prism is actually pretty rare.

      @@KingOskar4 yeah, rom hacks are different than games.. its cause rom hacks just use an official game and add some stuff to it, changing some core mechanics, adding or removing things in said game
      fan games are self explanatory, games made from the ground up

    One really big fan project that I remember was Pokemon Brick Bronze on Roblox. One of the biggest games on Roblox in 2015-2018. Nintendo took the game down but the developers made a new game called Loomian Legacy.

      It’s unfortunate that pbb got taken down.LL is a great game but has suffered a content drought and only recently had started to show that they’re working on the game.But, who can blame them for their demotivation when they worked for pbb for years and got taken down by Nintendo

      Was looking for someone to talk about PBB and LL.
      LL still remains as one of my favourite games of all time. I've made a bunch of fan art, plus the PVP scene is very fun. Can't wait for the Halloween Event later today!
      (Also, I have a PVP Green Halloween Ikazune. It might be Pure Nimble, but I couldn't care less. :D)

    With AM2R I can kind of understand it as they were working on an actual remake of metroid 2 and didn't want the game to lose sales due to the fan project as they were released within a year of each other. Does it suck they took legal action? Yes. Can we do anything about? Not really since it's their IP I do hope some day we can get more fan mods without having to worry about Nintendo taking them down as some mods breathe new life into some series

      Fan games are practically free marketing to the official products so they would make the official franchises even more popular.

    This topic is so interesting to me because it shows a devide between the law and the morals of most people. A fan remake/remaster, be it of a game, movie or whatever, is copyright infringement and, in this case, Nintendo has the legal right to strike down every such project that violates their IP.
    But on the moral side; Do we want the games of many childhood memories be legally inaccessible except for the company that created them long ago and now doesn't give a shit about them, their history and legacy? Do we want the preservation of such things by third parties to be illegal? I don't think many people would say yes.

      Luckily, Shigesato Itoi has the rights of the Mother/Earthbound franchise which Nintendo cannot take the fan games down without his permission. So it's safe to say that Oddity and Mother Encore will be just fine (hopefully).

    And this isn’t even the most insulting move that Nintendo has ever made, it’s infuriating that a company that I thought valued fun and the community now only values themselves more than anything. Their games prints money and they lose nothing if a fan game is out there, but they still take it down which makes absolutely no sense. If it ain’t monetary value, then what is it?

    Another pokemon fan game was pokemon brick bronze on Roblox. It was very popular until it was taken down in a mass ban wave of Nintendo games on Roblox. After its deletion, It was remade and rebranded as loomian legacy, but it isn't as popular anymore.

      Oh, nevermind. I went onto to Roblox to see how many players it has and it has 1.2k. It's been having around 500-600 recently, so that's good.

    12:47 About that, Mario Royale has been resurrected about a year or two ago, and the team behind it have been working on a Deluxe version of it alongside a remake of the original. While Mario Royale Deluxe is not playable just yet, Royale Remake is playable and available publicly.

    There was actually a pretty big Pokémon fangame that was made entirely on Roblox, called Pokémon Brick Bronze. If I remember correctly, it included every Pokémon, rather than skipping out on over half of the previous games’ (albeit using 2D sprites), basically a Pokémon game that reflected on everything they had done prior, and the game, to the point I managed to reach awhile back, was really well made for the platform. Anyhoo it got the axe, kinda understandable, but plenty of people were, and still are mad.

    Another notable one is Pokémon Prism, cause that was a ROM patch, which technically *isn't* illegal. Worst part about that is that it was taken down like, a week before the full game was scheduled to release (Except for post-game I think), which was just salt in the wound, especially since that project at that point had been worked on for... 8 years I think? :/

    I'm *really* hoping that Nintendo turns over a new leaf when it comes to fangames, but I wouldn't say "Don't make fangames, it isn't worth it" as even though there's been takedowns I still see a bunch of fangames around. I just wanna play more Mario lol, cool video! :D

    I like these new types of videos from T3rr0r, if you want to do them instead of the funnier, more satirical previous ones, than do as you want.
    But the more important thing is that you managed to pull it off *well* . These more informative, researched, and analytical videos actually mesh decently well with the editing, mostly because it's decently consistent. I think it'd be better to either tone down the editing for moments without jokes, or make more jokes and add more meme editing. It's a bit off, but still much better than other RUclipsrs, example L.S. Mark. He always made analytical, more serious videos, however, his editing has devolved from being professional throughout rather than using random, incoherent memes while he's talking about something he'd want to take seriously. I think it's nice you kept the GettyImages and meme sound effects which you always used, however, I just want you to make sure the editing of your videos is consistent and funny, along with lining up with what you say. Mostly just because it's kind of immersion breaking and your channel is still great.
    Keep up the good work, man. Excited for your new videos and I hope the editing just gets a little better.

    I'm very surprised that Nintendo didn't nuke Mother 3's fan translation despite being aware or atleast knowledge it's existence like they did it on purpose, hhhhhhmmmmm... Speaking of Mother 3, there was a fangame of Mother 4 but they made it something original instead and changed the title to "Oddity", because they're afraid if Nintendo nukes them just like AM2R fangame but some similarities are still there like the graphics and PSI powers just renaming it "ESP". Too bad it's not released yet, just the trailer.

    Nintendo is currently the "Apple" of consoles. I can prove it in six points. As these traits overlap with Apple as well.
    1) "Unique" quirky design philosophy to the detriment of performance or usability (Drift drift drift, hardware lagging behind on an ancient NVIDIA tablet GPU due to their insistence on the form factor. Took two revisions to make a stand that wasn't total garbage.) And when called out on it? Gaslight the consumer! Joycon drift isn't real! Ignore those class actions! Also you have phones don't you? Don't you know VOIP on the same console you're playing the game on is hard?! WHAT DO YOU MEAN THE PSP DID IT A DECADE PRIOR?!
    2) Almost intentionally spiteful consumer relations (Each E-shop being it's own walled garden that doesn't carry over to the next series of consoles and handhelds fundamentally stripping you of what you paid for and saying "Buy it again" without actually offering it again. Complete ignoring of consumer desire or requests.)
    3) Nothing drops in price, ever. Because dropping prices would "Damage" your perceived value. IE: Any first or second party game will be full retail price until the heat death of the universe on store shelves. Switch still full price despite the fact every single part on it is just about a legacy bulk buy holdover component by now.
    4) Overbearingly Litigious, Sue detractors, sue fans, sue people who work with you, sue people who work against you, sue everyone! Also write up some more bizarre draconian TOS while we're at it!
    5) False perception of an underdog despite being one of the most profitable in the market.
    6) Fingers in too many pies, when you're already doing too little to address and support your core market and first party hardware and software. (Themeparks! Movies! Lego sets! Smartphone games! Labo in schools! )

      the selling merch thing is completely understandable to strike down, since that’s making money off of THEIR copyright, however the mods and fan games being struck down is stupid. the whole striking down stuff like this is to protect their assets, since not protecting it enough can it get taken away legally. even then, they’re doing way too much. sega is a prime example of what’s best for the fans, letting them run wild, even if sonic has been rather lackluster in the games department the past few years.

    Honestly I hope Nintendo don't sue Luigibonus for this. He made Super Mario Construct and Yoshi's Fabrication Station and they are both amazing Super Mario Maker 2 inspired fangames. He also has a Discord server and I am one of the members.

      @@indoraptorgamer650 they do ask if you dont want to see it and even give you a "enable content warnings" option, from the start I feel like the switch is just a small indie game console. To prove it, just go onto the eshop. Tons of indie games like firewatch and of course ddlc, I feel like Nintendo doesn't really care about what they have on switch as they dont really care about the console and are too busy working on "other things".

    If I was a game developer/had a game company would I would be completely fine with fan games if:
    - the game it is based on an old game that isn't sold since years (I wouldn't be against piracy of the original games that I haven't sold since years to be begin with)
    - the game is for free (donations are ok)

    Right, so the only fan project I can understand them for striking down is AM2R. Now, I've 100%ed every 2-D Metroid game and am a huge fan of the series, so ofc I played AM2R instead of the original Metroid 2.
    The reason why I totally understand them striking it down is because it just so happened that AM2R was releasing just as Nintendo was finishing their excellent remake of Metroid 2. Metroid: Return of Samus. So, in this one instance, it was very likely that AM2R could affect the sales of Return of Samus. I mean, I never bought Return of Samus because AM2R existed, so there was no reason to buy it.
    All the other fan projects though? Bizarre. I can't tell if it's a uniquely Nintendo thing because of scars left over from every time they've lent out their IPs in the past, or if it's something to do with Japan's toxic work culture.

    A few months back, Nintendo DMCA'd the Metroid Prime 2D fangame as well. They had released a demo of the game and my god it looked BEAUTIFUL. I don't know if it's still being developed in the shadows but damn it's sad that Nintendo does not like to support fangames when they in most case would not get financially hurt. Who knows when they will be like Sega and see that people actually do this because they love their franchises and make fangames out of that love.

    I’m a fan modder, myself. There’s a lot of things to consider with these projects that Nintendo would go out of their way to silence them. Yes, it’s not a great outlook for Nintendo to be taking legal action against these projects, but these particular fan games do step into a gray area where Nintendo can inject legal action.
    Nearly most fan mods for Nintendo games usually will go under the radar due the way they are often distributed. Most fan games will be released as a patch of custom assets and modified files which are then applied to your obtained copy of the company’s owned game. In layman’s terms, it’s like placing a piece of paper with custom code over the original to trick it to behave differently. Think of Mrs. Pac-Man almost as a fanmod of the original Pac-Man.
    As long as money is not involved, usually, fan mods themselves will not be targeted with cease and desists. This is probably the actual reason why Project M and Project + have been targeted, since the cash prize distribution during tournaments are considered monetary transactions. Technically speaking, a provider or consumer is making monetary payments for Nintendo’s property to be played without their consent in conjunction with a created patch modification, which is what makes it cross into the gray area where a legal intervention can ultimately end up falling on either side depending on the argument made. A cease in desist would be the safest surefire call of action on Nintendo’s behalf. They don’t win, but they don’t lose. They protect their property from having an opposing threat in their eyes, and move on.
    Fan mods still may not be completely immune to takedown. That may depend on the IP holder and their own tolerance for mods for their work. The Pokémon Company for example is technically not owned by Nintendo. Nintendo only owns a rather significant amount of stock within the company itself. I’d imagine that The Pokémon Company could very likely still attempt to take down an ambitious fan mod if they really viewed it as a threat to them. They seem very monopolistic and resentful of any direct competition, and it sounds like they have enough money stashed up to afford to lose a case or two if it backfires. I’d probably stay a safe distance away from having a Pokémon mod announcement go wide spread on the internet, myself.
    Now, fan games on the other hand are what causes Nintendo’s cease and desist ninjas to go on a killing spree. Unlike fan mods, these are projects that are completely built from the ground up utilizing Nintendo’s IP, which is where the line is crossed. Fan mods work because they are distributed as a modification that is applied over Nintendo’s Property; however, a distributed fan game is still a video game that needs to be followed in conjunction with copyright law, and legal action can be made against them if infringement is an issue. Cease and desists are at least only a slap on the wrist compared being outright sued for damages. This is why these projects in the video tend to be targeted.
    I can still recommend fan modding if you are interested in delving into it, since your work will usually not be at an immediate risk. It is still a nice learning experience of working within the confines of a game you are interested in, and the reality is that the groundwork for the game itself is already operational (Hopefully, anyways) so it saves a lot of the work needed to have a playable result of your own modifications. Just keep money out of the picture, outside of perhaps an optional donation site if you can justify having one, and you should be fine. But, if you are going through all of the work to make a fan game, then by all means, I encourage you to go the extra step and make it inspired, but kept original. Trust me, that’s some serious effort you really don’t want to go to waste by getting cease and desisted, and is a time investment that you could even make some money off of later down the road. - Noah

    There was one banger fan game that was unfortunately never mentioned here: a Roblox made little number called, Pokemon - Brick Bronze. A nearly finished masterpiece that was struck down in it's prime and had potential like no other fangame that I have observed, so sad...

    I understand that those are their characters and everything but some fan projects don't even gain a dollar they make it from love for the franchise or nintendo itself, iam 100% with closing fan projects that cost money. cause they gain money from a character that isn't there's.
