    In the case of the abuser being caught in the house of his victim, the reason the abuser was caught was the prosecutor catching tells in the body language and facial expressions of the victims which indicated to her that the abuser was nearby and not only was the victim afraid to be honest, but the abuser had likely told the victim what to say. If the prosecutor deserves major kudos for recognizing what she was seeing.

    For me it’s still legal cat. Not a lawyer but the legal cat makes me laugh so much and bring me nothing but joy. His voice helps too.

    Me, a normal person that's rarely been to court or is involved in any legal stuff, got dressed up, and was stressing about my background, not eating, or drinking while on a zoom call to witness a hearing.
    And then there's lawyers attending zoom hearings naked.

    The “I’m not a cat” lawyer reminds me of the British journalist that was working from home and his two toddler kids bust in on him and the his wife zooms in trying to remain unobtrusive and rescue her husband by grabbing the kids and skedaddling.

    That prosecutor who picked up on the fact that the alleged abuser and the victim were in the same house deserves some serious recognition. That was an amazing display of good observation and good instincts.

    Honestly, I wouldn't have put the abuser and victim in the same house as a fail. That was fantastic work of the prosecutor for standing up and protecting the victim. Plus the judge for handling the situation with grace. They should get a honourable mention for "Most EPIC Zoom Wins"

      If they're both called to court, they're called to court. The court is who gave the restraining order. It's the only time the two parties should ever be in the same room, even if they DO both want to be together. Put a stop on the order first, then reconcile, because you can get arrested and jailed even if the claimant says it's okay. They asked for the order, but it's the court's order. My friend is actually in jail right now because her unstable niece filed a restraining order against her for attention and later was locked out of her house by her partner for acting abusively. My friend let her into her home to use the phone and get niece willingly went in, then called the cops on her. She got 6 months. During a pandemic. It's ridiculous. But she technically broke the law.

    Honestly the guy with the suspended license sitting in a car seems believable. If he does work at other people’s houses with his boss it’s not exactly out of the realm of possibility that he picked him up in the morning, they got to the house they’re working on then told the guy “if you have court at 10 (or whatever) then just go sit in my car and get it done”

    The lawyer chowing down on his lunch made me realize what's happing in some of these. People minimize their program and they can't see anyone else, but they don't realize that their camera is still on and the other people CAN see them. Hahahaaa. That's something my wife would 100%.

      But was he there with her permission? Or did he just show up and refuse to leave, and she was too scared to say anything? Because she knows what will happen after the call if she speaks up and the police might not interfere in time. Bare in mind, we don't hear her say she doesn't want the restraining order anymore. We here HIM say she doesn't want it anymore. Which is a classic abuser tactic.

    The guy who was zooming from his x girlfriend's house had a crazy follow-up. When they tried again he had been sitting in jail, with a continued restraining order. There were new allegations: he had called her multiple times from the jail phone and threatened her to drop the accusations! Jail phones start with "this call is being recorded" so it's just insane he thought he could get away with it. The trial was just insane, he became increasingly agitated and wanted to fire his lawyer. And Middleton is just perfect.

      @@ulrichkalber9039 Yup, up in Canada, there are two special designations...."Long Term Offender", in which case, a) the convict has to do their WHOLE SENTENCE (no parole), and b) they basically spend a period of 10 years on PROBATION afterwards, with more jail time for failure to comply. And above that is "Dangerous Offender", which means the person could be locked away FOR LIFE even if their offenses don't warrant it. Now, under our own version of "Three Strikes", a third offense involving certain violent and sexual crimes reverses the onus, meaning the DEFENDANT has to prove that they deserve to avoid this designation.

    Comical relief aside, these illustrate how a very non-insignificant part of the legal profession is horrendously out of touch with basic contemporary technology. Hell, in my jurisdiction you need to have IT professionals on site because judges don't know how to join Zoom sessions by themselves. I've personally seen prosecutors who fail to read - much less understand - that their cellphones are not downloading WhatsApp pictures because their 1GB internal memory is full.

      Tech illiteracy is a problem that tends to skew older, and since law is a profession that allows and encourages a much longer lifetime of employment/promotion, you naturally end up with an industry where most of the judges and a hefty chunk of lawyers are within the age range most likely to be partially or fully tech illiterate. Very unfortunate, though not all that shocking.
      (What IS shocking is people like that law student, like my guy how are you a child of the info age and you dont understand how a webcam works))

      I work with allegedly brilliant scientists that cannot figure out how to share their screen after a year of this. It's not that they can't learn it's that they won't because they think they're above it. There gets to be a point where it should be considered embarrassingly rude to not know how to use the basic technology to do your job. I think this is equivalent to someone in 1980 saying they don't know how to make a phone call and having their assistant always dial for them.

    10:42 major props to the prosecutor for that case recognizing that the victim was in distress and planning ahead with police in the event that something like this would happen. Abusive partners will do anything to maintain control of their victims, and honestly this isn’t the craziest story I’ve heard in this regard

      I use a physical cover on the webcam and opaque tape over every other camera in the vicinity, including cell phone. On Zoom I mute whenever not speaking and turn off video when my interaction is not required. It sounds like a hassle, but it reduces a LOT of stress.

    For my dissolution over Zoom last year, there was NO WAY I would show up in anything less than a suit and tie. My ex dressed as well as I did. The judge, broadcasting from his basement, dressed casual, but he can get away with it. I cannot comprehend why anyone would risk pissing the judge off by showing a lack of decorum.

      I'll note that some small town judges are OK with everyone being dressed casually. In such venues, the local lawyers know this and basically everyone dresses casually. Someone who attended such a trial in a suit and tie would come across as being overly formal, which could have a negative impact on how they are perceived by the judge and by the jury.
      Mind you, I believe this is incredibly rare.

    The guy who claimed to not be in a car reminds me of the day I took my driver's test at age 16. The car next to me had another teen in it, and the guy giving the test came to my window first and told me I was next after the other kid. So off goes the test-giver, to start the usual inspection of lights and whatnot. I'm busy trying not to freak out from anxiety, but before long he's walking by my window again and says, "Nevermind, I'll be with you shortly." He's got the kid walking with him and they go back into the DMV.
    When the test-giver comes back out, he gets in my car after doing the initial lights test and says, "Yeah, so, that guy has expired tags and when I went to find out who'd driven him here, it appears he drove himself. He's here for his driving test for his license too... he doesn't have one." Oopsie!

      Around here, the test is always in the driving instructor's training car (which has extra supervisor controls in the passenger seat, allowing the teacher or test officer to stop the vehicle). So no option of using your own car, but still possible to illegally drive yourself to the DMV.

      It did apparently originate in jazz clubs in US, in the 1930s but "to go to town" is very common in British English. I don't think it can be called an Americanism, now -- it's just English.

    13:13 the "judge" isn't actually a judge --he's the Solicitor General and in the extended version of the video, he can be seen asking the lawyer to send that delicious looking lunch to him as well.

I read somewhere that the surgery was delayed and was supposed to have been finished comfortably before the court hearing; however, I don't know how reliable that claim is. And even if it's true, as Devin says, there's no excuse for not just getting somebody to call the court and explain the situation.

      Yea, this word misuse has been my pandemic pet peeve. I've seen it printed in newspapers and newscasters have talked about folks flaunting rules. Where are the editors?!
      They're not shamelessly showing off the rules. They are flouting the rules- openly defying them. I said a quiet sad "nooooo" when I heard Legal Eagle say it.

    One of our best criminal law professors was quite a funny dude, but he really liked to be "practical" about his methods. When we had the section about robbery, which needs under German law the use of force, he brought a large kitchen knife with him and waived it around in front of the students. Basically, arguing that this would be the best way to give an impression of psychological force (so, not using the knife, but threatening with it). The guy with the gun reminded me of him.

    Prosecutor Davis is a heckin hero, you can tell by the worry mixed with relief on her face when the domestic abuser appeared on the victim's stream the she had real care and concern for her safety.
