    Last story: The HOA board was obviously running a scam and should have been legally held responsible for that and served jail time!

      and imo, all hoa’s are nothing more than an extortion racket and an excuse for people to get on a power trip

    The HOA story once again shows why, if they have to exist, they should be heavily regulated and disbanded when they violate the rules.

      the court should have held every single ‘hoa board member’ liable for all court costs and fees, as well as the ‘management company’

If the members of the board break rules, violate the contract essentially committing fraud then any payments should have to come out of their pocket not HOA funds. The homeowners shouldn't be required to pay for the boards mistakes or illegal activity. I also think it's BS when they lose a court case that they try to raise HOA fees to recoup any money lost in a court case, bc again it shouldn't be the homeowners job to pay for the board's mistakes

      Many HOAs seem to do shady stuff and need to be consistently held accountable for what they do and how they manage and interpret the CC&Rs.

    This is another reason I hate HOA's. If they do something illegal and you take them to court, win or lose, you will still be paying for the court costs

    DI water system story: Seems like upper management didn't know much about what their department even did. Oops!
    Red shirt story: One of the rare NICE IDWHL stories. Well done OP.
    HOA story: I'd say the HOA board and management company got greedy. Time to elect a new board and hire a new management company.

    Last story: El Predicto says the HOA shysters will try to raise the already excessive monthly fee so they can recoup the legal costs and the garage money they thought they were going to screw the members for. I wonder what they get for $400 per month, since we hear from others that they don't pay that much a year.

      If they paid for the garage when they bought, the garage is part of the property, and attempting to strip the garages from the properties is illegal. Just because it does not have a separate title, but likely is listed in the purchase agreement as plotXX, also known as Unit xx, and which is size and description, which also has an exclusive use element of garage YY as part of the deed of sale.
      Has to be there in some paperwork, as after all the sames agreement has to match the property physically, or the original agreement can be deemed invalid, which opens an entirely bigger can of worms.

      They can certainly try, but the fact that the court ordered the board and the company to pay for the costs and not the HOA means that if they attempt to raise the fees by more than a nominal amount, the home owners will have a good chance of getting the price rise disallowed in a court case, and possibly get some people in big trouble for contempt of court since they're trying to circumvent the court's order that they pay the legal costs personally.

    Only problem with winning a court case vs an HOA with them having to pay court costs etc is they just assess the homeowners what they need to cover the cost and I'll bet some extra to fill some pockets.

      That would be another court case which very likely would end up with people in jail for contempt of court since the court ordered the board and the management company to cover the costs, not the HOA. Raising fees or doing a "special assessment" through the HOA would almost certainly be regarded as a blatant attempt to circumvent the court's order.

    Last Story - Unable to not think that maybe someone on the GOA board missed out on a garage and decided to get one another way! So glad the OP and others won the case against the greedy HOA! So sad a little power goes to people's heads!

    Wont stop the HOA later on perhaps a year later from raising the Dues in a closed meetings due to the lawsuits then doing it again the next year and then next year. Cause it is what HOAs do. Not until Every Single HOA is Dissolved every where

      Closed meetings are no-no's. I see another round of court hearing to chastise the Board for trying to sneak through changes. The board should be held responsible for the cost of drawing up deeds for the garages that were purchased, back dating said ownership to the date of purchase of course. Then the Board members should be voted out and replaced. Maybe it is time to find a new management company to take over the minimal duties needed with the understanding that they will not participate in any activities that are strictly within the purview of the condo/hoa board.

    Umm, there seems to be an omission in the Garage story! If this were a true story it should have ended with the HOA management being ousted and charges laid against the individuals concerned that tried to financially confiscated property by deliberate misrepresentation to a court of law. Makes you wonder why such stories exist.

      They exist because of lazy people who submit writing prompts to AIs and then post the results to reddit while pretending that it's something which really happened. The AI does not have sufficient general knowledge (in the form of the rules it uses for shuffling words and phrases) to know how to write a realistic story. Even worse, it doesn't know that it doesn't know. It has no way of detecting that there's any gap in its knowledge, so it just makes up stuff which would (or even could) never happen, based on what word-and-phrase-shuffling rules it does have.

    Garage Story: If you had to pay extra for a Condo with a Garage vs. an identical Condo without a Garage, then the Garage is part of the Condo and you Own it. Period!
    OP and the others should have asked the Judge to include an Order that the HOA Board and Property Management Company were NOT permitted to make a Special Assessment to cover those Legal Costs. They must pay for it themselves and/or make a Claim against the HOA's Insurance Policy, NOT use the money they get from the Membership to pay it.

      The OP said that the board and the management company were ordered to cover the costs, not the HOA. If they attempted to cover the costs through HOA fees, that would be another potential court case which they'd not only lose, but very possibly find themselves in jail for contempt of court since the court ordered that the board and the management company cover the costs.

    I’m surprised the HOA didn’t have a clause in their regulations requiring residents to pay all lawyer and court costs arising from a lawsuit no matter who wins, so that you still lose even if you win the lawsuit.

    Last story: A Condominium has a Condominium Association ("CA"), not an HOA -- they are legally different. The CA owns everything in the Condo other than the units -- that is called "Common Elements." When part of the Common Elements are designated for use by one unit owner or a limited number of unit owners, then that is a "Limited Purpose Common Element" (LPCE). Examples of LPCE are a designated parking space, the porch or balcony on a unit, or in this case, specified garages.

    Last story did not go far enough. The HOA could add fees for the maintenance of the garages which would be just as bad.

      No they don't unfortunately...in the US Legal System, all too often, those with the most money win a Lawsuit regardless of the Merits of the Case and HOA's usually have FAR more money available to them than a single Home Owner does because they can suck money out of ALL the Homeowners in the Association with Special Assessments...
      As many other Reddit Stories have mentioned, the OP had a hard time finding a Lawyer willing to take on an HOA even though the OP had an Iron Clad, Rock Solid Case against them...

      @@HappilyHomicidalHooligan As an attorney who used to represent Condo Assns, HOAs and Co-ops, I can say that you are incorrect.
      The judges carefully focus on the merits of the cases, and usually the party with the law on their side prevails. The winning side is then entitled to recover attorney's fees in these kinds of cases (but not all). In areas where there are a lot of Residential Associations, there are attorneys who specialize in fighting those Associations, and who often succeed -- if the facts are on their side.
      Additionally, some judges tend to view these cases as a David (homeowner) vs. Goliath (Association) battle and tend to make presumptions in favor of the homeowner.
      I also acknowledge that some Associations are badly run, sometimes for the ego of the board members. However, there ARE good Associations, and bad owners who become a nuisance to the neighborhood.

    cute kid in the story with the orios :) there is probably a lot more interaction like that one out there than karens demanding things from people that dont work at places (lots of those is probably false or make the persons look a lot worse. tobad the storys like the young kid one dont usualy get shared because people dont think about it or its not storys considerd interesting by channels because most people probably feel they are borring etc. i personly love storys like that one from time to time, its also nice to see some of the storys where the hoa is helping with problems like the one where the towtruck company they have contract with went rouge and started towing all the cars that was even slightly out of line without even beeing called to the place and the hoa did not have any problems with any of the cars parked on the parking space. (That is acctualy one of my favourit hoa storrys out there )
