Im going to simplify this for everyone. Hold each property in its own trust and have one llc as the beneficiary of all the trusts. If one trust is attacked legally you transfer all other trusts associated with that llc and assign them to a backup llc that you already have created and on standby as the beneficiary before a judgment makes its way up to the beneficiary LLC associated with the remaining properties held by a trust.
Its such an honorable and admirable thing for someone to give their time to help teach people or share what they know. Good man

This video was great. The first one I've seen so far that showed me how to do the land trust with or without an llc, to limit liability while increasing personal financial privacy. This put all of the prices of the puzzle together for me. I now have a much better understanding of those particular details I was unsure of how to properly do. I wanted to structure everything the right way the first time, and I'm excited to start implementing this technique.

Kris & fellow investors, you can form an LLC who's sole role will be to be your "Trustee" Company to all your properties.
Use a WY LLC
Make sure your LLC job is ONLY to be your trustee.
Of course you will be the "Managing Memeber" of the sole desicion maker of All your companies.
No need to worry about anyone else.
yes, this is very true, BUT paper intensive, I dont know if everybody is ready to keep multiple LLC's registered, dealing w/ taxes, paper, yearly certs. etc.etc... You can layer this thing to the hills, but remember we must unwind it all at some point.
@@krishaskins If anyone is at the point where they need start to use "Land Trust" for what ever reason, then they would need proper structuring. Having said that, a "Trust Holding" LLC is very little maintenance in the scheme of things, the meetings are simple and the taxes are as a "Disregarded" since it would flow to who or what ever entity you have it set up.
Guys and Girls if you are investing thousands or hundreds of thousands on One property don't be cheap and cut corners. When you standing in front of the "Man" is too late.
Do lots of research and learn from many.
Specially lawyers who specializes Mostly in Real estate investors. Same goes to Accountants. Local 89$ accountants don't work.
Kris, I usually don't comment on site but I absolutely see how hard you try to teach. and I see that your "Trust" forms are very very cheap! That tells me you want many others have access to it. FYI to all, that would cost at least 2.5K with a good competant attorney.

@@friedlliese3116I would create a WY LLC and I would be a Manager manage position. WY LLC would be the trustee of the Land Trust then I would signe as the manager of the WY LLC.

You never want to be the Beneficiary on a Trust ,the Beneficiary will always be your Estate. If a individual passes away then the Trust is gone also. The beneficiary should always be your estate. The tax bill didnt disappear in the land Trust you spoke off it gets added on in the sale and becomes attached to the new ownership. Yiu need to read the Treasury Department (Questions and Answers About Trust 0049) from the Department of Treasury.
It can be with allodial your name is the estate titles, but if not, it passes to new buyer, possibly?

Won’t you end up creating disposable trust One after the other, or having to sell trusts to buyers or quick deed house to buyer dissolving the trust? Assign from resignation of current trustee, and assign to successor trustee buyer's side possibly?
As per my understanding, the beneficiary of land trust does not hold legal or equitable title. The beneficial interest in a land trust is considered personal property . Isnt personal property immune from creditors?

On the GRANT DEED is better to put the trust name first or trustee name?

Yes, u can do that. Just assign it over.
Deed of Trust is a mortgage document that record shows owner gets the loan use the property as a collateral.
Some Lenders care about transfer to land trust or LLC , May call the loan back. You can not say bank does not care the transfer.
Quit Claim is cheapest so use a QC-Deed if you are transferring from your name or llc name that you own into a land trust you created.

On page 9 EXHIBIT B Beneficiaries, say I listed 2 beneficiaries, for those 2 can the percentage of interest be 100% for each? Or does it have to be 50% for each?
For example, me and my wife as beneficiaries.
not sure about that, but I would think it's only 100% to go around. Whenever we do them the 100% must be broken down not a total of 200%.

Kris... appreciate you, sincerely! If entering a lease option, your business llc should be on lease & option contract. No land trust because, no title transfer, correct? Try to explain these steps.
U can put ur LLC on the lease. I wouldnt put the trust on the lease. Itll be hard to explain to the judge.
What did you mean by you added the Trust as an additional insured?
If you alter the trust agreement at any time (For example adding and removing beneficiaries), do you also have to change the deed?

So im in colo i had investors that were gonna purchase my home they had me out in a trust they needed more time to get payoffs so they filed bk7 put his name as trust for our address. They said they coukdnt do that and accelerated the sale filed a personal bk 7 on him what did he do wrong

Not really sure why I am not seeing any of your replies to the questions, Kris, but I saw an att'y today that recommended naming a mysterious trustee - someone with whom you have no known association, perhaps a lawyer - this should not be expensive because it requires so little time, have your trustee resign immediately, do not record the name of the backup trustee, because it is yourself. That is correct, on some deals, esp if I'm taking it sub to, the time is everything. But, if I've only got a small amount out, I'm willing to gamble w/ time. So, the less money I have out, it doesn't really bother me...

Anderson associates says to use another for Trustee 1 for 6 months and you as the 2nd, they resign then you take over but you can’t be both Trustee and bene. They are the name on paper and if anyone snoops they show them the resignation but don’t know who’s Trustee now

yes, u do have to put all your info for the LLC, but that's not who's going on title. the trust is on title.
You do not have to put your name on the LLC as an owner an Irrevocable Trust can be the owner of the LLC just put it down as the Orginizar never put your name or social on a LLC as an owner or on a Bank account.

Ok good question, u get the trust set up before u go to closing. The buyer on ur contract is the trust, then u create it so the deed gets drafted in the trusts name

So if you are selling your beneficial interest in the trust, that's basically the same thing as selling a trust. So the trustee remains the same, so the new buyer will need to appoint their own trustee or have a trustee they don't know, is that right?
well, most buyers won't know what's going on, SO they'll want a new trustee, but they don't have to. It's up to the buyer. You'd be surprised as much as I scream about this stuff, peeps still don't have a clue in our industry. It's mad simple as well..

The purpose of a Trust is to hide you soooo if your dba has you name on it I CAN SEEEEE YOU and sue YOUUU!
A DNA is only a nickname a ein is what separates you from the ownership because of the seperation of entities a land Trust is garbage in the eyes of the courts because you will still have the liability because there is no asset protection

What is a legal description of a property exactly
If the beneficiary is individuals, lawsuit can go after the individual. Need to be LLC can avoid the liability.

If u have to sign it, u can change the trustee to somebody else since you're the beneficiary as well. No problem.
Hey Kris, If you acquire a property via Sub-to, would you put your llc and the sellers name on the trust (Exhibit B) to prevent triggering banks do-on-sale clause? Or is your LLC name good enough? Thanks!
That's a great question. And some investors do that to have a document showing the owner is still the real owner. Or sometimes investors put the seller's name only, THEN transfer it into their LLC a day later. The fact is, what is our intent? To me, intent means everything. I feel like it can be looked upon a fraud IF you set it all up and intend to transfer it later, which is why I just put it in my LLC from the jump, good question...

well, the most amending we do is to change the beneficiary and/or the trustee. Those docs are included.....

Well, I never thought about losing the original trust, it never leaves the file cabinet but i guess i could have them in different locations.
Just type up another Trust agreement. A the Trustee Deed can be obtained from the recorders office. Now if you did not record the Trustee Deed and you lose that then you DO nOT OWN THE PROPERTY. LOL
