  • In this video I discuss what married couples in Ontario can expect after a husband or wife has been arrested for domestic assault. This includes an overview of the major legal, logistical and emotional challenges couples should expect from the moment of arrest to the conclusion of the court case.
As a criminal lawyer focused on domestic cases, I appreciate that the challenges facing married couples and their families are unique. I wanted to take the time to address this critical but often confusing area of the law, with the goal of expanding on core topics in greater detail in future videos.

Thank you. This has been an extremely painful and also eye opening experience. I want my husband back in my arms and I also want things to be much more peaceful and loving between us. With the no contact order in place though I can only feel despair as I'm left to what my mind tells me he wants, instead of him telling me. I try to put myself in his shoes and wonder then if this is completely unforgiveable.

The court process can take some time. Be patient, retain excellent counsel, and with a few gusts of good luck you two could be back together sooner than you expect!

What happened? Do u still have the no contact order?

@No. The no contact order was dropped about 3 months into it which the victim witness services said was exceptionally quick. We hired Mr.Shaffi. I hired my own lawyer who pushed very hard as well. We will find out in the next couple weeks if the charges have been dropped as he has gone through 2 anger management courses. Our relationship has been completely destroyed though and we will not be staying together as my husband said that the arrest was the "final straw" and people in his anger management course convinced him that he did not in fact want a child because they were bitter after having one. This has been an incredibly traumatic experience for me overall from beginning to end and I wish I could sue the police department for destroying our lives.

    Thanks man.
I unfortunately can’t go home and it breaks my heart. No where to really go after the first and I can’t believe this court order has made me homeless.
My parents live across the country so I don’t know what to do.

That is awful. I am wishing you luck in this moving forward swiftly. I sincerely hope you can reunite with your family soon and hopefully things will start moving in a positive direction in your relationship from here on out.

That's right. Go to useless therapy and waste more years of your life. Best counselling is Quran and prayer. But if it helps your case to see a counsellor, go for it,
