    Lets all help to not make the government and lawyers make money of us and just get along because trust me, they loveeee charging people for domestic violence, its the easiest way for them to make thousands over a simple arguement.     Just listening to this entire video makes women not want to call the police on their abusers and put up with the trauma, placing them at higher risk in danger because you’re implying that they “need” a lawyer or you’re going to go through more bs. Your message was too pushy about hiring a lawyer for every situation that no average blue collar worker could afford, especially nowadays. The video has good content information; however, you seem very hungry for clients. So much for protecting the vulnerable victim.

    My boyfriend forcibly confined me and beat me (literally to the point where my actual EYEBALL was bleeding and I couldn't see) until I signed a false affidavit that he wrote (I had previously charged him cuz of seven years of abuse, and he wanted to avoid conviction cuz he had priors). I'm just wondering how his lawyer was able to submit the false affidavit? I thought that if the lawyer knows the affidavit is false, they can't--in good conscience--submit it? Isn't that malpractice?

    My boyfriend complained to a friend about a minor argument we had. This "friend" made an exaggerated report against me. Neither of us wanted charges and well - now I have a no contact order and im kicked out of my place. Staying at a shelter now, even though charges will be dropped well have to convince the crown attorney that the very helpful report is false. The fact that anybody could make a baseless anonymous report on a couple and be proud about it makes me sick.

      Yes that law needs to be addressed. The crown doesn't care for the victim nor the aggressor especially if it means finically ruining both parties. They just want their numbers up.

    Now let me tell you what really happens in Ontario. If you are charged with a crime and are in a police station, after interrogation you will be told your charges. If you have no priors and the charges are minor after a hearing in front of a judge or justice of the peace you will be released on your own recognizance and a promise to appear. If not you are held in custody, and then transported to the local detention centre. You are then x-rayed, strip searched and given a orange jumpsuit to wear. The cops took all of your belongings at the police station. You are then escorted to your new home on a range, in a cell with a cell mate. Your only form of communication are the range telephones, but you can only place collect calls. You better remember those important numbers because you sure don't have your cellphone. You then can apply for legal aid if you qualify, and now you have to find a lawyer. The range usually has a list of lawyers and their phone numbers posted, they all take collect calls. After that just try to enjoy your stay, you will spend months doing dead time before your case gets to court. If you are lucky, your lawyer will get you bail.

      Yep! 👍🏼 Once a case is terminated the conditions cease to be in effect -- unless the court imposes another form of contact restriction, like a peace bond 😬

    I want help , my boyfriend used to blackmail and once had choked me , the day he got arrested he broke my phone and I was so depressed as it was my mid term exam that I called 911, it’s been 10 days now and he’s in custody , he’s very aggressive and immature I would say but I don’t want to ruin his situation and mine as I’m continuously feeling bad for him , that he’s in jail coz of me , I don’t want any future with him but I can’t live normally as long as someone is in jail coz of me, can anybody help me please

    They charge me in Canada I do not live in Canada. I'm not been there in years. They called me and told me there was a charge card my stepson made the charge. He made a fake account in my name. They said I was up there when I was not. We have Border Patrol records print but I cannot get heard before a judge prayed because the Canadian lawyer will say you have to come up here and be arrested before we can tell you anything or get anything. Meanwhile the information was recorded by the cops. False proof to extradite you from another country they have to have a hearing with your country. The Canadian cops don't like to do that. Fine because my the government of where I'm at is extraditing Canadians for identity theft and fraud trafficking because of the **** sites hosted in Ontario. Because the lazy Canadian cops and prosecutors will not go after these entities for the fraud.

      Thanks for your support 🎉 A charge does not mean you have a criminal record. A “criminal record” is the outcome of two distinct processes: 1. being found GUILTY of the charge (either because you’ve pled or were found guilty by a judge), and 2. you’ve been CONVICTED following the finding of guilt. Having said that, all sorts of other information can turn up on what people call “background” or “criminal record” checks ☝🏼

    I was charged with mischief to property. Nothing in connection with "domestic assualt" the day i was charge we actually only had a argument. Its disgusting and causez more issues than anything. Rules need to be changed.

    This court system is a joke. I been fighting for the contact order for 5 months now and even with my partner requesting the removal since the day of my first court appearance it always denied. It's causing more problems and issues as well as financial crisis and mentally damaging than anything.

    Ontario is becoming a communist country. The complainant does not have a say in any of the court procedures. Cops did not disclose that charges would be automatically laid. Bottom line "don't ever call the police". Prosecutor will delay and delay and delay.

I ask in the case that the end result where after 5 to 6 months it gets put on the record that 'no criminal offence whatsoever took place' and the charge(s) are withdrawn. Can one sue for damages in cases like these and if that is the case, what are the possible outcomes and odds of success?

      That's a really great question. There are definitely potential civil dynamics flowing from any criminal proceeding, but the law in relation to police and prosecutors is extremely strict. Best to talk to a civil lawyer who specializes in that area for further discussion. 👍

      @@shaffielaw I plan to as the penalty of no contact for that long exceeded the peace bond requirements in the final court date, ie. Written revocable available that should have been available from the start. Wasn't Tamara Lich finally released because of risking the detention exceeding the likely penalty? In our case, that is what happened and with no approval of either party.

    How often does anybody anywhere in Canada get charged with perjury in any jurisdiction? Never heard of one person charged any year. Might happen but it is like an urban myth... Or legal myth.

      That’s a really great question, Storm. We can’t speak for all of Canada, but our firm has never had a client charged with perjury. As mentioned in the video, perjury charges are quite rare - perhaps because of how challenging they are to prove in court.

    Ok. Should I hire a lawyer to get an abuser finally charged? Got evidence, witnesses, police reports, spreadsheet of unending new incidents of harassment and crimes... Three charges for breach of EPO.... But still no charges for domestic violence or abuse despite all the reports and evidence. Police did not interview witnesses, examine evidence, or lay charges.... Only the release conditions from EPO breach charges are giving the victim any relief. Usually these EPO s get transformed into mutual no contact orders in Alberta... Which is highly unjust for victims. They treat the victim same as the abuser.... Not fair. An easy unilateral bureaucratic fix for police and justice system. Can be freely used by abuser to gaslight the entire world and continue to abuse the victim by making her out to have a restraining order against her in the defense of the real abuser.

    Well what I can tell you from experience is in BC they don't always get enforced my ex was allowed to stalk me and harass my family call the police to report it dispatch says it's a breach then an hour later some other douche cop calls back and says they don't care intimidation tactics are allowed. That's how court cases get lost too witness don't want to testify and sometimes victims get murdered also due to lack of due diligence and law enforcement also. Courts are stupid if they think giving bail conditions means criminals will abide by them.

      Great question. Unfortunately, there's no one-size fits all timeline. Getting the order lifted depends on multiple factors including the seriousness of the allegations; up-front done work by the client; the position of the complainant; the sensibility of the Crown; and yes, budget. Best to get a skilled criminal lawyer on board to help you.

    No contact is made to destroy unhealthy relationships. My gf went to the cops on me, got out on bail next day, in 3 weeks we were in public and she got mad at me in public and was yelling, police show up out of nowhere and i went to jail for 3 weeks. Would have been there till trial if it wasnt for my lawyer. As much as I wanna talk to her, i cant put my freedom in her hands again. I hope she miss me

      Yup, If you are the respondent in a no contact order, you better consult an attorney and abide strictly to the terms of that order. The petitioner cannot “give you permission” to contact them while that order is in effect. No contact means no contact. Often the petitioner will allow contact (on the down low) and just not report the contact to law enforcement. However, all it takes is the petitioner suddenly deciding that contact is unwanted and reports it. A nosey neighbor or a family member who is aware of the no contact order and gets wind of the contact can also report it. The bottom line is that if a respondent violates the order, the circumstances don’t matter. You will be arrested and most likely taken to jail.

    my daughters partner wants his dropped in an attempt to lesson the time hes looking at for dv strangulation while my daughter was only 8 weeks pregnant. hes manipulative and extremely dangerous as this lethal attack was his first attack on her..he has no respect got the law and uses other inmate accounts to intimidate and contact my daughter.. this is extremely traumatizing to my entire family within the same household..

    Ya this whole no contact orders is complete bullshit. Based on the research that I have done, many people are suffering unnecessarily as a result of this policy. I can safely say this is doing a massive amount of harm.

      Yep, my girl called because she thought that the police would calm the situation down. Eben tho she was beating me first and all I did was push her back and yelled at her. They charged me regardless and now I can't even see her until it's done. Which could take a year. This is completely destroying our lives because she decided to make one phone call

      That request has to be initiated by the petitioner. The respondent has little to no input on getting a no contact order dropped. Even if the petitioner requests to have one removed, it’s entirely up to a Judges decision. The Judge will normally want to see some kind of proof that both parties are attending required classes (battery prevention), a mental health evaluation from one or both parties, and individual counseling. The primary purpose of a no contact order is to provide safety to the petitioner. Until a judge is satisfied that the threat to their safety is no longer an issue and that both parties are actively moving towards reconciliation, they are very unlikely to amend or remove the order.
