    I was fighting with my boyfriend and he put me on the floor and later on tried to choke me so I scratched him. When the police arrived I told them I didn’t have any injury or property broken ( I lied because he broke my iPhone screen ) and since I have no injuries at the moment but he does I got an assault charge. He has chocked me, hit me, left me bruises, and wound on my hand in the past. I have no pictures because he would make me delete them, what do you think I can do? I am so scared, I don’t want to ruin my life because I scratched him 😔 I’m scared.

      I’m so sorry this happened to you. You need to get a lawyer if you haven’t already and be totally honest with them. They can only properly defend you if they know the facts. They know the laws and your rights and you know the case. Your lawyer will review the disclosure (police file) with you to look for inaccuracies and completeness surrounding the events. Do they have photos of his injury? A recorded statement under oath? Did you say anything to the police on scene that could have potentially corroborated your boyfriends version of events? If they don’t have these things, their case is very weak at best and you have a good shot at things going favorably for you. Your lawyer will take your version of events and approach the crown prosecutor. They will try to poke holes in their case and instill that there is no reasonable prospect of conviction and it’s not worth taking the case to trial. Sometimes, depending on provincial policy the crown will be hesitant to drop the case. In which case, at the preliminary hearing, when the crown cannot produce reasonable evidence you have a good chance of it getting dropped. Keep in mind, though the police took notes that day from your boyfriend they CANNOT use “The complainant told me XYZ happened” as evidence. It is hearsay and cannot be used to prove the truth of the matter. They CAN say “my observations lead me to believe the assault happened.” And then it just opens the can of worms of what exactly was observed by the police. Usually, they’re not around when the alleged crime occurs so they’re banking on witness information. The best thing you can do right now is get a lawyer!

    Charges dropped? Easy! Just do what my partner did: he wrote a false affidavit, forcibly confined me, then beat me so bad that my literal eyeball was bleeding I was blind out of it. I signed it because I knew if I didn't, he'd keep strangling me and murder me that night. I was bleeding WHILE signing it cuz I couldn't handle the thought of my family having to deal with me dying. It's crazy to me that lawyers will press their clients to get their wives to sign affidavits that are so obviously bullsh*t. HOW do you live with yourself being complicit in such disgusting violence against an innocent person?

    Can you sue back for defamation and lying. It is 10 years old that is happened and no record or injuries. Two of my kids changed me for hitting with wood spoon . In the middle of separation from my ex

    I've requested mental health diversion for my ex-fiancé. I wrote a lot of notes for the Crown attorney about his mental health, trauma, diagnoses, meds, side effects, and how he is a good person who always wants to rescue everyone. I said if this happened to any of his female friends, he would rush to rescue them. I explained that he's such a feminist. I am not sure if he has a chance of mental health diversion. I had no injury, but he strangled me which is fucking serious. He slapped me. He threatened rape and murder. I was in shock and we were in public and people were asking me what's wrong and what happened and the words tumbled out of my mouth but I never meant to report it. They called an ambulance for me but police came for him. I pleaded with the police not to take him to custody. I don't know if he can get mental health diversion...

    Hello, I recently got a 2nd DUI and the first one took place when I was 16 years old no license nothing and I did everything I had to do probation, AA, Morgue, got all certificates and I got it sealed/dismissed, got my license at 18, now I am 21 years old and regret this moment of course but I over drank and crashed in the highway against some rocks and got some fractures but that’s taken care of, the insurance, the car is taken care of so i don’t have to worry about that now, I got my 2nd DUI, I did get a lawyer but I just want to know if you have an idea of what I will be expecting? In the state of California. This just happened almost 2 weeks ago

    now.... if my sister broke into my parents house that i live in also and i pulled her arm to the door and she wouldnt leave bc she was hysterical and stuff and i called the cops (bc it was like 9:30pm and i needed to sleep), this is domestic violence? the cops are pressing the assault and battery charge on me not my sister and she told me she wont even go to court tomorrow but now im so anxious even tho its a magistrate case and i start nursing school next month. is there any chance i will be getting criminal charges??????

    I am really taking a deep breath today after listening to you carefully Sir, I am a victim in my case it was only a slap matter now I realized my mistake I want my husband back to home. Incidence happen on 11 dec and no disclosure till now.I wants to reconcile my case but according to lawyers they can’t do anything without disclosure plz guide me if something can be done before the next court date. Next date is 8th June

      I am feeling guilty that I am also responsible for that condition but now no solution prosecutor is not allowing to my husband without PARS to come to the family and live.

    Great video. An American defense attorney on RUclips named CLR Bruce Rivers says that in DV cases the men are usually unwilling to pay attorney fees, & never take any accountability for their actions. Have you had similar experiences?

    She filed for an OP first, then divorce. The OP was granted and I was ejected for 1 year. The judge let it expire, but gave her exclusive possession of the home.
    In a moment of weakness, I went to our street. A stranger's car was parked on my driveway, so I breached the curtilage to see who's car it was and who was in my house.
    I did not know she had Blink installed. She became frightened that I was on the property, so she filed for another order of protection.
    Will I lose? Have I blown it?

    I do not understand why I lost my order of protection defense because I had blocked my mother in law's phone number. I was ejected for 1 year. The reason is because my wife simply sobbed in court.

    This is amazing. My boyfriend is being charged with assault because he pushed me. Pushing!! That's not worth a criminal record whatsoever.

    You are an amazing strategist. Alot of lawyer don't look outside of the box within the bounds of the court to find the best results and have a tunnel vision
