  • Several homeowners in Cheviot were surprised to learn the city determined many sidewalk slabs outside their homes are suddenly a safety hazard -- and they're on the hook for the cost to fix it.

    Why are homeowners responsible for repairing the sidewalk? That is PUBLIC PROPERTY not private property. If I have to pay to fix it then it is MINE and trespassing charges will be filed....and a fence might be put up.

    Ummmm I'm pretty sure it's the city that put the sidewalks in, not the homeowners. I'm sure they didn't ask the homeowner if they wanted them. BS government crap

    I live in a small town in Missouri and they try this every winter. They publish that we are responsible for keeping the ice and snow off of the sidewalk in front of our house. If someone falls, it's our legal responsibility. I called the city and told them that if I'm responsible then I have ownership. I am going to paint my side walk in the summer and put up cones and no trespassing tape in the winter when there is snow and ice that I can't remove.
    They of course told me they own the side walk. It makes no sense to me. But at least I have it in writing that they own it. Im still going to block it off this winter and see what happens.

      Don’t you have more important things to do than to block off your sidewalk so innocent people… some disabled…cannot walk their route to do the things they need to do? Do you ever walk on sidewalks outside of people’s houses? It’s part of living in the city or suburbs. You are responsible for taking care of your sidewalk. If you don’t like it….you could move to a more rural place where there are no sidewalks to maintain.

      @@TerrisaVenus no. It should not be anyone's financial responsibility to take care of something they do not own. It is the city's responsibility to maintain their public works. It is not MY sidewalk - that is the problem. If it were mine I could paint it, I could do whatever I wanted with it but it is not mine. They clearly stated that in their email to me. I am not physically able to clear ice off of the sidewalk. Where I live we rarely get snow we get three or four inches of solid ice. So for safety, because I cannot clean off the ice, I will block it off. They can walk around it, in the street, that way if they fall on the ice, it is the city.

    The fact is the sidewalk belongs to the city not the homeowners. A class action lawsuit would solve this con. You can’t block the sidewalk. You can’t paint or make changes to it. You can’t stop people from walking on it. Why? Because it’s public property owned by the city. These folks are being played for fools. If it’s the homeowners property shouldn’t they be able to do away with the sidewalk and plant grass. Classic case of we own and control it but you gotta pay for it. By this logic they must be held liable for street repairs in front of their home to. 😂 and also to point out when you do a property survey the boundary lines don’t include the sidewalks nor the strip of grass between the sidewalk and street. It’s simply not your property. Case closed.

      @@williamwilson6499 I do own property jerk. My property lines do not include the sidewalk nor are the residents responsible for maintaining the sidewalk, it’s city property and they maintain it. You cannot legally be forced to upkeep someone else’s property. This case would definitely win in a higher court.

    Our sidewalks get covered by the city. My wife tripped over a water shutoff sticking out of the middle of the sidewalk and when I called and complained they came out that same day and tore up the sidewalk and relocated the water shut off to the lawn. Every year the village comes out and replaces hundreds of damaged sidewalks that are tripping hazards. That’s the words they don’t like hearing “tripping hazard”

    The city installed the sidewalk as part of their easement. That strip of grass between the sidewalk and street is also part of the easement, the water meter is probably located there. The tree belongs to the city, I bet that man doesn't pay for tree trimming or removal. If I'm forced to pay, that means it's mine and I will remove 100% of my sidewalk in what is now my yard.

    We had the same in Anderson. The positive it was added to our property taxes so deductible.

    My little boat made the front page of the Washington Post. Took the motor off and put folks in wheelchairs in it to evacuate it. It’s wide, deep and has a plate floor. Groves area.

    Paint thinner gets rid of the orange x. Plus if its your sidewalk, put up a toll for others to use. Otherwise. They can walk the street.

    My parents had to pay to replace sidewalk at our house in Hyde Park in the 70s. Worst part is they tore up and concreted the flagstone between the sidewalk and the curb also. I guess that's been the policy for 50 years now.

    If it is "public" infrastructure, it's public responsibility!

    I am glad that our home is on one of the cul de sac's in our sub-division and not on the main roads with sidewalks. Homeowners get hit with fines and warnings when their cars overlap or block the sidewalks in front of their homes. We expanded the driveway at our home where 5-6 cars could park on our property and no one could bi&ch when our driveway was full. Well they could bi&ch, but we were in our legal rights. Shalom

    Since when does an owner to adjacent City or County property have to pay to maintain that City or County property ? ... Not only NO, but HELL NO ...
    We do not own, all the way to the street... An area near the street is owned by the City, County or State... It has what's commonly thought of as: public egress or similar terms... If an area has no curbs or sidewalks, people are allowed to walk, or have public egress a certain amount if feet, from the centerline of the road.
    This certain amount allows the City, County or State at some point, to install such conveyances if needed to improve the roads, provide sidewalks for people to stay safely off the roads, provide curbs to park next to, and provides an area for such utilities as power poles which hold phone, electric, cable and the like. The areas are also about five foot closer to your home from where these poles are installed, as that allows space for equipment to replace and or maintain the poles.
    Therefore, we do NOT own this area where utilities and sidewalks are installed... And DO NOT pay for such improvements directly... However, some amount of fair dollar amounts can, if voted to allow, be added to your taxes ...
    Yes we now the lawns between the curb and sidewalks... We shovel the snow out there... But we can not install, maintain, or replace sidewalks that are in fact, City, County or State owned... Therefore, we should NOT be billed for their upkeep ...

    Just remove the sidewalk entirely. Nothing to graffiti with orange x's, nothing to get charged a fee for ever again. It's the homeowner's property, so it's their choice whether to have a sidewalk or not right? O.o

    Homeowners are generally also responsible for snow removal of sidewalks adjacent to their homes

      I've have lived the majority of my 60 years in the Los Angeles area and never has a homeowner touched a sidewalk, the city maintains them. If a sidewalk is damaged then you contact the city and tell them to fix it!

    This has been the case for over 100 years. Or, don't you remember the Monopoly card that assessed you for "House and Street Repairs?" That was not made up from whole cloth, it was and still is a fact of life for property owners. I still can't get enough of these "I'm independent" people who don't realize WHY cities are designed around the idea of the common good. Or would they rather just leave the sidewalk bad and risk being sued if someone falls and gets hurt in front of their house? Grow up!

      This is what Taxes are for. The greater good. Increase the taxes .01% and the sidewalks are covered. That way nobody gets bent over because the city laid a poor foundation for the sidewalk 30 years ago.
