  • What can you do with licensed fabric? Is there a difference between what the legal protections are and what's practical for your creative business?
That's exactly what we're going to cover in this week's episode of Ask Kiff.

Thank you for explaining what license fabric is. Also the proper way to use fabric.

I am posting a link to your youtube videos on my three Facebook groups. I have 54,000 members in one, 5,040 in another and just a few hundred in the third but there are many small business creators on these groups who will benefit. Thank you for having the guts to put this information on the internet and being so generous with your talent.

Thanks for the video! Clearly explained & helpful info. BTW, I wear glasses, too, & constantly had to push them up. Then I got Keepons from Amazon, & they’re fantastic! (Not affiliated, just a fan 😊)

This has been really helpful. I'm starting a face mask Etsy and I'm hesitant to use licensed fabric because I simply can't afford the legal fees Disney could throw at me. This really eased my mind.

I’m wondering if this applies to the U.K.

Question: I am curious about tax information. It was collected automatically when I sold on Etsy but selling through Paypal requires me to apply the tax rate based on my customers home town and county but only if my customer lives in my state. Do you know if this is going to change or any way to protect myself if I sell to someone in the state and do not notice they l live in my state until I ship out the package? I usually go back and void it all and start over but if I have purchased the lable outside of the 24 hours to reprint it or change it I have been known to just let it ship and pay the amount myself at the end of the month.

Sales tax has gotten WAY more complicated since the Supreme Court decision last year. Now you have to collect it for states other than where you live if you meet certain thresholds. I've got some content coming on this topic, but for now if you search "collecting sales tax after Wayfair" you'll find some good resources!

would this pertain to like shoe design as well? like for example if I wanted to make a product that resembled the gucci print but add different symbols would that be legal?

No the laws discussed in this video would not apply to that situation. This video is specific to taking fabric that contains licensed content and using it to create a fabric. Not designing your own print.

I sell products made with licenced fabric. I did everything you said to avoid the trademark infringement, such as saying "mask made with licneced Harry Potter fabric" instead of "Harry potter mask", and putting disclaimer there to make it extra sure it's clear I am in no way associated with the brand. My listing still got taken down probably in a sweep. Some of my products are hit and others are not. Should I reach out to Warners Brothers to ask what I can do to amend it (I saw on reddit someone did that and the person from WB actually told them what they can do to operate within the acceptable range)? Or would that just draw their attention which they may strike everything and take my shop down?

Update: I reached out and they reinstated my listing in the condition that I word my disclaimer like this:
This is not a licensed Harry Potter item, it is made with licensed Harry Potter fabrics. [busienss name] is not associated or affiliated with Warners Bros

Is it safe/legal to sell clothes made from fabrics bought at a fabric store that don't have characters and logos, but have solid colors, stripes, floral prints, seersucker, etc.? Excuse me if the answer is obvious, but I'm kind of paranoid after finding out about licensed fabrics, lol.
    And are you a lawyer?
