Hello and welcome, Lori Lee. Using a zip tie would be considered a method so it is definitely not copyrighted I included several articles from the copyright law that specify this. Don't forget to like and share. Thank you, Lori.
Hi thank you so much for this information you are so so nice to be sharing this information with us. I made two wreaths and had them on my Etsy shop, well I just deleted them cause I’m a bit flustered lol. One was a wreath with a stuffed Olaf from “Frozen” in the middle and the other was also from Frozen it was a plate with a picture of Anna and Elsa. Can I not sell them?
Hello Carolyn! You are very welcome and I’m happy the video was helpful. As for the wreaths, I wouldn’t take the chance cause you can get into a lot of trouble. Anytime I make a wreath with Disney characters, I don’t sell them and give them as gifts to friends and family. I hope that helps. Thank you, Lori.
I knew it there’s a crafter online and she has a disclaimer on her video that her method using a few different tools she uses that you can’t use it. Then it says her wreaths r too. So I was wondering about that. Thank you for clarifying and making this video!
Alicia Tengwall copyright laws do not cover methods nor did they cover ideas. It is of course professional courtesy not to copy someone else’s wreath. A wreath can be considered a work of art so to copy it exactly would definitely be a violation. Out of professional courtesy I do not copy other peoples works of art if I like what they did I change it and use my own ideas. I have included multiple articles in the description that you can read that specify exactly what the copyrights cover and what they don’t.
Hi, thank u so much for this video! It really is useful But I have a question I want to start a small business and it’s clay on mug . What if a customer asked for Disney characters , is it okay or not? I will do it cuz the customer ordered so is it allowed or not?
Hello Hessa, You’re very welcome and I’m happy you enjoyed the video. It’s not allowed and especially with Disney and copyrighted. It’s not worth taking the risk and illegal plus you can get charged thousands of dollars in fines. I hope that helps. Thank you, Lori.
So I'm a little confused, I'm in Ohio and Bengals are in the playoffs, so I thought about making a couple Bengals wreaths for local Bengals fans, that would be against the trademark?
That’s a great question. You can make wreaths using the same colors but if you’re using a sign that says “Bengals” then that would be copyright. You do have a less chance of getting in trouble if you’re selling the wreaths in person verses listing them online but I can’t say that it wouldn’t be risky. I hope that helps. Thank you, Lori.
Another question. If I want to demonstrate how to use something such as ProBowtheHand and make a tutorial on it, have I violated any laws? I think it would be appropriate and courteous to ask the creator/inventor for permission, but is it unlawful if I don't get permission? I watched you make a bow on it in one of your videos, but not sure if that would be considered a tutorial on the ProBow. I have made a video tutorial of making a bow with the ProBow and have messaged Regina about it, but haven't received a reply yet. I haven't uploaded it yet. If she doesn't answer, can I upload it without violating any copyrights?
Sweet Tea Designs Connie Smith McManus no you have not violated the right. Provo the hand is a patented equipment. The only infringement would be if you tried to re-create the pro bio without having written permission from the patent owner. Demonstrating how to use it is perfectly within your right. It is trying to re-create the actual patented item that would be protected not the use of the item
Thanks for all the great information you have shared. What if someone gives a tutorial, gives you the exact name/# of products used in making it. Does this violate copyright?
Yes if it is a trademarked item it would be a violation even if you bought from a place that has a license. Their license does not apply to the buyers only them. So in other words, if you went to craft outlet and bought a grinch face you can use it but not sell it.
Doesn't the item that is created by someone have to go through a copyright process to keep others from copying it? For example, if you make the pineapple, but the person who made it previously hasn't had it copyrighted, it's not against the law to copy it. Just wondering...
Sweet Tea Designs Connie Smith McManus no you do not have to register a copyright just saying copyright or using the (c) is enough. Registering a copyright is really just an extra layer but not required. All original works of art are essentially copyrighted but the important thing to understand is that the method is not copyrighted and the idea is not copyrighted just the actual piece that’s made
Michelle Chattha if you use the team ribbon that actually has either December or the name on it then that is a trade barked item so you can certainly use it you just don’t want to sell it that way.
Patricia Gibbs it would be considered a trademarked item I do know that a lot of people make them and sell them however there’s always that chance that they could consider that a copy right infringement. Movies are included in copyrighted items. And since those items are trademarked they would require a license in order to resell
You are so helpful. Thank you!

Thanks for explaining this issue to others. There are people that do try to say that using everyday items like zip ties can be copyrighted.

Bobbie White Same here and I like being adventurous and trying to do something different it’s not much fun copying other people’s things

What about Patented or Patent Pending items? Can you use it or do a how to video on how to make a lesser/different version of said item?
No, you can't they are all copyrighted. Thank you, Lori.
Can you put, “Go Utah” on a wreath written in your own writing & design, would that violate copyright or patents?
Hello Marsha! No I don’t believe that would be violating anything. Thank you, Lori.

can you use the football generic items with the teams ribbon?
Michelle Chattha if you use the team ribbon that actually has either December or the name on it then that is a trade barked item so you can certainly use it you just don’t want to sell it that way.
Lauri, can I make and sell a jack skeleton wreath

Hard Working Mom , thank you Lori. I’ll be very careful in the future I appreciate your business videos
I watched your pineapple wreath, you did it way different.
Thank you, Alicia. Yes, I have that one very different. Thank you, Lori.
I have a question, what about if you use Ohio State ribbon? I just bought Ohio State Ribbon.
Alicia Tengwall you can use it but not sell it unless you have a license
Hard Working Mom I can’t sell a wreath that I made using that ribbon? Or do you mean I can’t sell the ribbon itself?
Hello.
Hello and welcome, Alicia. Like and share. Thank you, Lori.
