What a poorly planned or rehearsed opening statement... The defense did an incredible opening but this is just despicable for the State. How they could go forth to try her is beyond me. Shameful. The only thing I got out of the states opening statement was a good nap.

Mr. Prosecutor. Tooooooo many characters to keep up with in your opening. Tooo confusing. Just give basics and introduce them as needed when witnesses. 😡

she can bring a civil suit against the state for negligent prosecution

@@ktermalkut8332 That is false. Anyone who is arrested under a Probable Cause Indictment cannot sue anyone including the State or the Common Wealth.

@@2bcYT check Barry Morphew's civil action against the state for his false arrest, failure to provide him with exculpatory evidence etc. The guy was in custody for a long period of time before the Prosecution decided to drop the case, which was without prejudice meaning they can bring the prosecution again.
The Prosecution also LIED to court claiming they knew where the body of his wife was. Her body was found ACCIDENTALLY when there was a search for another body.
Legal fees are COMPENSATORY damages - what the victim actually lost. I am not sure about the law in MA on emotional distress etc. However PUNITIVE damages which is generally much higher will likely be fair game with the CORRUPTION involved

@@ktermalkut8332 Hey. Yes, well aware of the Suzanne Morphew murder. She was trying to leave her SO when she died, too.
Barry never had a murder trial. Apples and Oranges.
Karen will be convicted and she can appeal the jury's decision or she'll be acquitted. In which case, she should thank TB for witness tampering.

Opening statements need to be succinct, with the summary of the alleged crime. This is not what is happening. Way too many details out of order that are irrelevant to the main charge.

I think it's a terrible accident. She was drunk, backed the truck a bit, didn't know she hit him or bumped him since he was still holding his glass, and he was also intoxicated, probably dazed and wandering in the snow.
