Deputy Burns had a fire mishap on top of his head, his hair went up in a puff of smoke (it was old and dry). He is functional, sort of, he does suffer a little from crispy-brain...he thinks he knows stuff about laws and rights and Supreme Court rulings...like using profanity in public while protesting. if you put constitutionally minded cops in law enforcement:
99% of all laws would be un-enforced.
99% of all laws violate the US constitiution in some manner.
      that is a fact.
      A constitutional Law Enforcement Agency:
will not enforce gun control laws
      gun restrictions:
example - murdock va pennsylvania - scotus 1947 - No state can license, fee or register the exercise of a Constitutional Right. what does this mean? it means that any and all forms of gun registry, fees (for carrying guns concealed or not), and or "concealed carry permits (another word for license)" can not be done in all 57 states (Obama).
miller v us - scotus - no state can convert the exercise of a constitutional right into a crime.
"high capacity" mag bans would be un-inforceable.
any laws that say, "you have to have a permit" to assemble and protest (1st) would be un-enforceable
the 2a would be fully enforced.
the right to film public officials, in public buildings, performing public acts - would be upheld - Sherar v Cullens - fed case law - NO state can sanction and or penalize the exercise of a constitutional right.
You get the idea that law enforcement would not have the power it has now. LEO/lea would not be able to do anything (unless you commit a violent crime against a person (and even then it would limit the fact that they must now use the miranda warning. (btw - scotus just ruled - of a cop "forgets" to issue said warning, you can not sue or redress the greivance)

Qualified immunity is supposed to be to protect officers that don't reasonably know they are violating rights. It's 2023. Things like this are known to be lawful to do, so a cop shouldn't be able to claim they didn't know

    • @invictusbp1prop143
      @invictusbp1prop143 Год назад

Pipe dream. Ending qualified immunity is a cause the establishment started up to distract and preoccupy the peasants…to waste their time on a meaningless cause. And so if they ever end up having to give in and let you have your way to appease you, they don’t care because nothing will change, other than some short sighted citizens thinking they’ve won something for a while. Ending qualified immunity is a lame attempt at treating one of many symptoms of a larger, destructive infection within the system. You’re fighting so hard to try to overcome one symptom while doing nothing at all to address the infection that causes it. Oh you cleared up that abscess on your ass by boiling it out with peroxide for a month. Good for you. Oh, but now you’ve got one on your leg, huh? That’s really strange and unexpected. Cops aren’t scared of getting sued. Most of the violations they commit are relatively small scale and don’t pose a threat of biting them in the ass because the majority of the public does not have the time, resources, or inclination to see a lawsuit of that kind thru to its conclusion. Lawyers won’t take cases on retainer unless they’re big newsworthy public outrage type of cases that they feel they can win with a hefty settlement. Otherwise it’s not worth it for them to bother. So you have to pay as you go if you find so sone who will represent you at all. And if you’re not independently wealthy, it’s not likely to happen. And regardless, hats the problem with qualified immunity…? It gets misused. There is a legit purpose for the doctrine. To protect against frivolous lawsuits that can financially ruin cops who actually haven’t done any wrong. But there are certain judges who de used hey, I can just grant this to all cop in all situations to protect them from getting in trouble and all of our corrupt little schemes can keep on working for us. So those scummy judges do just that. They use QI to protect scummy cops. And if you take that tool away from them, do you think those judges will stop being corrupt? “Well, the gigs up, boys. They caught on to us and made it impossible for us judges to protect dirty cops anymore. We’ve been defeated…. I guess we’ll go back to acting like judges are supposed to act and start facilitating justice again… “. Hell no they won’t say that. They’ll just find other ways to protect dirty cops. You ve done nothing to treat the actual problem, just one symptom. And that one symptom actually had some legit purpose if applied as intended. But that’s out the window. So you’ve accomplished a net negative. Best case scenario it’s a wash. It’s the corrupt judges that have to be addressed. Same as the corrupt, misguided, self-serving corrupt, politically focused prosecutors. They push their political and personal agendas for their own gain…and they only want to advance their agendas to move up and amass more wealth and power. To do that, they need to maintain public persona and a very high conviction rate. That’s what they are judged on. Not whether or not justice is served in the cases they handle…all that matters is % of convictions. To keep that number impressive, they need help. Who’s help? The police. They need good cases with lots of charges so they can intimidate defendants with long sentences and force them into plea deals so they’re guaranteed convictions…and they need cops to be team players at trial. What do cops get in return for helping the prosecutor look like a rockstar? They get their misconduct cases no-proc’d. The DA declines to prosecute when they cross the line with joe citizen and there’s nothing anybody can do about it. And the mayor, or sheriff, whoever is actually at the top of the food chain of local LE agencies, they’re too busy making sure they’re getting their pockets lined to really care about what’s happenin*, they institute a bunch of stupid policies for political purposes not daring how badly they effect the agency, the eliminate standards and hire based on a diversity chart and act like they’re surprised when the agency is in a downward spiral…incompetent leadership and less than optimum recruits…guaranteed decline. Nobody’s demanding accountability because true accountability extends to those superior to those accused of misconduct. And they’d rather just cover for their subordinates than face any responsibility for themselves. Just play politics and keep the vocal minority happy, let the culture within turn toxic, let them forget their mission statement, their mandate, their purpose for existing, and have them generate income and be hyper focused to the point of absurdity on the almighty Officer Safety…it makes for great legal outs when we have no other excuses for the actions of officers. And so on and so on. Without accountability, there will be no improvement. For many years these elected officials have done as they please and done what’s best for them because they knew nobody was paying attention. The public is too busy with social media and worshipping celebrities to pay attention to their government. When they see a clip of something they don’t like, they complain…they bitch and whine and raise hell from behind the keyboard. …then they go right back and re-elect the scummy politicians who are actually responsible. It’s much more fun and trendy to hate on the cops. The new American pastime. But if the mess that s the criminal justice system is ever going to improve, it’s going to require that the public remove their heads from their asses and get involved and do their duty as citizens for a change. Demand accountability from elected officials or get rid of them. There’s no other way.

@paulgreen177 - why would profanity not be "Christ like"?
Jesus went on a rampage in the Temple yelling at and busting up all the kiosks for the merchants and money changers. (John 2:13-25)
Do you really think he didn't say a single swear word in that altercation?
You think he remained completely stoic while they nailed his hands and feet to the crucifix?
The only thing the entire Bible says about profanity is to not take The Lord's name in vain.
      General expletives are completely fine.

Police , who seem to think that their job is to be referees of all human interactions, fail to understand that the entire purpose of the first amendment is to protect speech that OFFENDS! We don’t need protection for speech that nobody is offended by because nobody is trying to ever ban that speech! We don’t need the first amendment to protect conversations about the weather. We need these protections to safeguard our right to express ourselves in ways that may offend some people or even most people. Personally I think the “fighting words” doctrine is absolutely horse shit but it refers to insults directed at some person that have absolutely no social or substantive value. For example walking up to people and calling their mothers whores could be considered fighting words and disorderly conduct. However, walking around say Walmart is the smother of all whores is clearly protected speech.
