Well, it's technically legal for a citizen to handcuff another citizen IF they're making a legal citizen's arrest, but to make such an arrest you have to personally witness the crime if it's a misdemeanor, or you have to have strong probable cause to believe the person is guilty if it's a felony. Problem #1 is that normal citizens aren't trained to know what constitutes 'probable cause' nor the line between felony and misdemeanor, nor are they trained in knowing how much force they can legally use to detain someone. Problem #2 is that a citizen has no protections when making a citizen's arrest, so if you injure the person, you're civilly liable, and if you're WRONG and they're not actually breaking any laws, now you're guilty of assault and false imprisonment. Police are allowed to detain you on SUSPICION of committing a crime if they have probable cause to do so, citizens are far more limited in that regard, and for good reason. Editing to add: There is no circumstance where a citizen can handcuff someone because they're upset that he barged onto their property and caused a commotion. The guy in the video was, without a doubt, guilty of false imprisonment, assault, trespassing, etc.

They are baiting him, its a double trap. They knew he probably had an ID and that he had a gun. After reading him his miranda rights, they are free to ask him questions that can be recalled or used against him in a court of law. By his lying they put him in a situation where a plea deal will be worse for him. However if he had told the truth or said he did those crimes, then he would have certainly been even more doomed. In this case lying protected him, but he should not have talked without a lawyer. What this guy did was not okay at all. But I will say I feel bad a man of this stupidity who is trying so hard to control his life, fail so many times.

Every law enforcement agency should have some bilingual officers in their departments. It makes people whose English isn't perfect or can't speak English feel relaxed, especially in places where there is a large number of immigrants moving into the area. There should be officers who can also use sign language.

The woman's story was very believable. She wasn't trying to think what to say, she was very clearly describing what happened without thought. When asked about the gun being holstered ,she quickly showed how he was holding it .

I love that she refused to let the perpetrator take the cuffs off when he offered, that is, when he knew he messed up and he'd given her evidence. She didn't want her word against his when she had proof and wanted the officers to see it. He was playing checkers and she was playing chess.

Often Vietnamese women wear the pants and can be far more agreesive an unpredictable than their husbands. If there is a fight they usually take the lead. You might understand this when you listen to the video of the woman who told her husband to go inside and she will deal with it. She also told this to the defendant. She is the boss.

For anyone wondering what happened since its hard to find online, I looked it up with the Pinellas County Court. He plead guilty to false imprisonment and was given 18 months probation. I believe the falsely personating an officer charge was dropped. There was also a stipulation with his plea deal that he surrender his firearms and not own firearms and undergo a psych eval.
Thanks. I don't think taking his firearms away was necessary. The dude used to be a cop and he got pushed to the edge, having to deal with a belligerent woman. Obviously it's wrong, even a little strange, but it makes a little more sense that he has a background in law enforcement. Given his demeanor, I'm fairly certain this was a one-time thing and, having been punished, he's learned his lesson. But hey, I'm not a judge.

I have to say, having someone who can speak your language in a situation like this must give you much relief. I really love how they make an effort to get someone out there who can ensure the lines of communication are as clear as possible
Without question, if they hadn't this would have gone done very differently... Best case, the husband & neighbour both would have been arrested; worst case, the victim & husband are arrested solely on this garbages lies. It's essential that all parties are able to fully communicate regardless of language issues. There's no excuse for language barriers, law enforcement have a number they can call to have an interpretor translate any language digitally. Any with such language issues, carry a card on you at all times that clearly states your language needs in the local language & that if presented, means they need an interpretator to communicate.
Yes they spoke English just fine, but if someone can speak their native tongue they can be more expressive and more accurately describe the situation. They can use their own idioms, and having someone understand another culture's customs can go a long way to better understanding a situation, especially if someone is upset.

There are nuances that can be vitally important; having someone that speaks the native tongue helps with interpretation, not just translation. Also, watching this video (and video title) after the fact, we apply our own context; their English isn't so broken. But when you have no context and no Intel, you're going into a situation with a blank slate.

She explained that the former officer that cuffed her had come back and said that he would remove the cuffs, she refused and did not allow him to. She did this to show the officers that would later arrive on scene so that the former officer could not deny that he put the cuffs on her in the first place. Smart move.

Not that uncommon at all. Obviously there's so many languages it would be impossible for most departments to have an officer for every language but there are services out there that will provide translation services for departments over the phone. Technology has helped tremendously in that area.
@@paulgeorge9614 it was a she and its best practice to speak to victims in their first language as how the victim words what happened is the difference in arrest or no arrest. That's why she was asked multiple times and they had to make sure the victim heard the suspect say I'm a police officer not i was a police officer. Thats the difference between impersonating a police officer charge or not. Either way they had him on false imprisonment but a good defense attorney could get it tossed using the defense it was a citizens arrest which that defense wouldn't hold water with the impersonating a police officer charge too.

The local police department where I am, hire a translation services firm. They just call the number and then they can communicate with bilingual speakers
They don't even always need translators, even just access to a civilian can help. I worked in a small charity, and we sometimes got non-English speakers who needed help. I made arrangements with the local University to donate translation services...using the instructors, for free. It didn't come up all the time, but they did help with tourists in town from Quebec. They also helped out with a couple that was in town from Poland.

One things that stands out about these bogus cops is that they always have tales to tell of the most dramatic events in history and how they were there personally. I doubt a real cop would go into such detail even if he really did experience those type of things.

Agreed. I had noisy Indian and white neighbors growing up who would scream fight and play loud music all night. We'd call the police and as soon as they'd show up, the music would immediately be lowered before the cops even got out of the car. @Pepi Roni and you do understand how the system works, these foreign language speakers are likely to be forced into communities of other foreign language speakers, giving them no need to fully learn English. Plus, learning a language is hard asf, especially for older people already set in their ways. Try teaching a 50 yr old lady from the boonies how to use a computer and see how she'll need a helper everytime.

Only white people are truly "innocent until proven guilty" in America. I have seen this scenario play out In numerous police encounters involving white officers called on white suspects vs minority victims. They won't inconvenience white suspects with handcuffs or police detention until they investigate the claims of every minority individual involved in the incident first. Then and ONLY when left with no other options, will white police officers put another white man in cuffs. Like a bunch of people pointed out, police were quicker to identify the victims than the suspect.They didn't even bother to search him for the gun that was reported. The mayor explained that they had purposely reported more police employees than there were "to discourage criminals"...as if criminals would know or care. He never did explain why the 500 fake police officers were on the payroll or who cashed their checks. When the question was raised by citizens of Louisiana, the mayor was arrested for something else and it disappeared from the news.

I can imagine the frustration of trying to translate in your own head a language you are still learning. adding the stress of being in a situation where if you cant speak about exactly what happend because you dont know the words then the person whose harassing you can get away with it. having an officer to translate was perfect for this situation because they got both sides of the story plus added detailes that mr former cop didn't mention.
I’d say he probably was an Officer, but if he quit after 9/11 because of PTSD, that was 20 years ago. He’s had a lot of time to sit and think about his glory days where he had that authority. Idk what law enforcement looked like pre-9/11, but it’s probably nothing like what we are used to now.

I came across this and decided to watch it. Glad i did. What i found facinating was watching the local police. Im assuming their behavior was their normal behavior since it was body camera video and its always on in situations like this. Seeing how they conducted their investigation was facinating. I was impressed.

Whats worse, they arent even doing it inside their home, theyre doing it outside. Grown ass adults, out partying in the streets getting drunk. I worked with a few vietnamese people in my 1st job. They spoke good English, but theye volume just went up when speaking their native language. After a few weeks, low volume vietnamese was obvious that they were cussing.
I'm a vietnamese immigrant. Came over to America when I was 5 so I never really developed the loud in-door voice but can confirm... they just speak loudly. Its definitely a cultural thing.

Depends on the community but if a child grew up in a Vietnamese family and strives to one day be a cop, you might have one to speak and understand. From what I understand, Vietnamese people are very tight-knit so you would have the children still steeped in the culture.
I'm very happy to see the law treat this Asian family fairly & with respect, sadly it's not always the case unfortunately. These officers in my opinion did everything right, like a breath of fresh air from what's normal seen on RUclips.

Once we got the translated version, it is so clear that this family deeply respects American freedom and rights and don't take them for granted at all. I appreciate the fact that in America we have police officers that are able to speak other languages. In a situation like this it’s extremely important that the translation is correct.

I can't see what language has to do with most professions. That sounds like something people say just because they think they should believe that. What value does have ten different languages add on a factory floor, or to bank accountants? It is useful in a profession like this where your have to deal with various members of the community. Just having trouble understanding the people you work with adds no value.
Niece has a Russian mom and she and her family all speak Russian so niece does, too. She's learning to read and write it. She's taking Spanish in school. Her little sister spent her first 4 years in an AWESOME Spanish/English day care. She asked me for agua and I was so tickled! And thankful for my high school Spanish! She hasn't had the Russian immersion her big sister did but even just two languages to put on a resume is plus. They just moved across the country and oh, boy, are they missed.

Well, it's technically legal for a citizen to handcuff another citizen IF they're making a legal citizen's arrest, but to make such an arrest you have to personally witness the crime if it's a misdemeanor, or you have to have strong probable cause to believe the person is guilty if it's a felony.
Problem #1 is that normal citizens aren't trained to know what constitutes 'probable cause' nor the line between felony and misdemeanor, nor are they trained in knowing how much force they can legally use to detain someone.
Problem #2 is that a citizen has no protections when making a citizen's arrest, so if you injure the person, you're civilly liable, and if you're WRONG and they're not actually breaking any laws, now you're guilty of assault and false imprisonment. Police are allowed to detain you on SUSPICION of committing a crime if they have probable cause to do so, citizens are far more limited in that regard, and for good reason.
Editing to add: There is no circumstance where a citizen can handcuff someone because they're upset that he barged onto their property and caused a commotion. The guy in the video was, without a doubt, guilty of false imprisonment, assault, trespassing, etc.

They are baiting him, its a double trap. They knew he probably had an ID and that he had a gun. After reading him his miranda rights, they are free to ask him questions that can be recalled or used against him in a court of law. By his lying they put him in a situation where a plea deal will be worse for him. However if he had told the truth or said he did those crimes, then he would have certainly been even more doomed. In this case lying protected him, but he should not have talked without a lawyer. What this guy did was not okay at all. But I will say I feel bad a man of this stupidity who is trying so hard to control his life, fail so many times.

Every law enforcement agency should have some bilingual officers in their departments. It makes people whose English isn't perfect or can't speak English feel relaxed, especially in places where there is a large number of immigrants moving into the area. The woman's story was very believable. She wasn't trying to think what to say, she was very clearly describing what happened without thought. When asked about the gun being holstered ,she quickly showed how he was holding it .
He wanted to remove any evidence so he asked to remove cuffs that didn’t work then goes home to get rid of gun and badge comes back to cover himself this guy is a danger to his neighborhood.

For anyone wondering what happened since its hard to find online, I looked it up with the Pinellas County Court. He plead guilty to false imprisonment and was given 18 months probation. I believe the falsely personating an officer charge was dropped. There was also a stipulation with his plea deal that he surrender his firearms and not own firearms and undergo a psych eval.

Thanks. I don't think taking his firearms away was necessary. The dude used to be a cop and he got pushed to the edge, having to deal with a belligerent woman. Obviously it's wrong, even a little strange, but it makes a little more sense that he has a background in law enforcement. Given his demeanor, I'm fairly certain this was a one-time thing and, having been punished, he's learned his lesson. But hey, I'm not a judge.

I have to say, having someone who can speak your language in a situation like this must give you much relief. I really love how they make an effort to get someone out there who can ensure the lines of communication are as clear as possible

It's essential that all parties are able to fully communicate regardless of language issues. There's no excuse for language barriers, law enforcement have a number they can call to have an interpretor translate any language digitally.
Any with such language issues, carry a card on you at all times that clearly states your language needs in the local language & that if presented, means they need an interpretator to communicate.
I can hear and understand them just fine. Just have to use your ears.
Yes they spoke English just fine, but if someone can speak their native tongue they can be more expressive and more accurately describe the situation. They can use their own idioms, and having someone understand another culture's customs can go a long way to better understanding a situation, especially if someone is upset.
@@jeb5137 I agree with your sentiment. Being first generation Canadian, I grew up in a Cantonese speaking family. There are nuances that can be vitally important; having someone that speaks the native tongue helps with interpretation, not just translation.
Also, watching this video (and video title) after the fact, we apply our own context; their English isn't so broken. But when you have no context and no Intel, you're going into a situation with a blank slate.

She explained that the former officer that cuffed her had come back and said that he would remove the cuffs, she refused and did not allow him to. She did this to show the officers that would later arrive on scene so that the former officer could not deny that he put the cuffs on her in the first place. Smart move.

Not that uncommon at all. Obviously there's so many languages it would be impossible for most departments to have an officer for every language but there are services out there that will provide translation services for departments over the phone. Technology has helped tremendously in that area.

That's why she was asked multiple times and they had to make sure the victim heard the suspect say I'm a police officer not i was a police officer. Either way they had him on false imprisonment but a good defense attorney could get it tossed using the defense it was a citizens arrest which that defense wouldn't hold water with the impersonating a police officer charge too.

They don't even always need translators, even just access to a civilian can help. I worked in a small charity, and we sometimes got non-English speakers who needed help. I made arrangements with the local University to donate translation services...using the instructors, for free. It didn't come up all the time, but they did help with tourists in town from Quebec. They also helped out with a couple that was in town from Poland.
All you need is a diverse police force. With proper hiring practices they could have officers who speak most of the most commonly spoken languages.

Plus, learning a language is hard asf, especially for older people already set in their ways. I have seen this scenario play out In numerous police encounters involving white officers called on white suspects vs minority victims. They won't inconvenience white suspects with handcuffs or police detention until they investigate the claims of every minority individual involved in the incident first. Like a bunch of people pointed out, police were quicker to identify the victims than the suspect.They didn't even bother to search him for the gun that was reported. It’s so valuable having people who can speak multiple languages working with you in any profession.
I can't see what language has to do with most professions. That sounds like something people say just because they think they should believe that. What value does have ten different languages add on a factory floor, or to bank accountants? It is useful in a profession like this where your have to deal with various members of the community. Just having trouble understanding the people you work with adds no value.

Niece has a Russian mom and she and her family all speak Russian so niece does, too. She's learning to read and write it. She's taking Spanish in school. Her little sister spent her first 4 years in an AWESOME Spanish/English day care. She asked me for agua and I was so tickled! And thankful for my high school Spanish! She hasn't had the Russian immersion her big sister did but even just two languages to put on a resume is plus. They just moved across the country and oh, boy, are they missed.
